Noor Mukadam's murder case: SC urged to review judgement upholding death sentence of Zahir Jaffer

ISLAMABAD: The Supreme Court has been asked to review its judgment upholding the death sentence of Zahir Jaffer for the gruesome murder of Noor Mukadam.
Zahir Zakir Jaffer on Wednesday, through senior lawyer Khawaja Haris Ahmed, filed a review petition against the Supreme Court's judgment dated May 20, 2025.
The petitioner contended that the judgment dated 20-05-2025 relies heavily upon the video recordings, and on that basis the capital punishment of the petitioner has been upheld, without taking into account that neither the DVR nor the hard disk stand proved during the course of the trial.
'On the contrary, the portions of these so-called recordings, on the basis whereof the inference of 'last seen' has been drawn against the petitioner, were never played during the trial,' it added.
He maintained that during the proceedings in the appeal before the Islamabad High Court (IHC) when the hard disk was required to be played it was empty, while DVR was never played, rather portion of video clip in USB, provided by one of the appellant's counsel was played and made the basis of the judgment in the appeal. The USB is neither primary evidence, nor its authenticity is vouchsafed by any forensic report.
He submitted that DVR and hard disk is not proved by PFSA's forensic report as per the law prevalent at the relevant date and time, as neither the scribe nor the executant (concerned forensic expert) entered into witness box to authenticate the same on oath, therefore, the PFSA's forensic report has no credibility.
Khawaja Haris, who has drafted the review petition, stated that the judgment also suffers from an error apparent on the face of the record as it has not addressed the issue of unsoundness of mind or mental capacity of the petitioner that was raised before the apex court during the course of arguments by the petitioner's counsel.
The petitioner's plea of unsoundness of mind or mental incapacity, though evident from his conduct and demeanour throughout the trial, was never given due weight or serious thought by the trial judgment, and even the IHC judges.
He maintained that the record of trial court shows that the question of the mental capacity of the petitioner to stand trial was never taken or addressed seriously as mandated by the Supreme Court in inter alia Safia Bano's case.
A three-member bench of the Supreme Court, headed by Justice Hashim Kakar, and comprising Justices Ishtiaq Ibrahim and Ali Baqar Najafi on May 20, 2025, upheld the death sentence of Zahir Jaffer for the gruesome murder of Noor Mukadam. It dismissed Zahir appeal against the IHC verdict.
The death sentence in rape charge has been commuted to life imprisonment, and 10 years sentence in abduction charge has been reduced to one year. However, it maintained the earlier orders to Zahir to pay Rs0.5 million to Noor's legal heir.
The bench also reduced the sentences of gardener Jan Muhammad and watchman Iftikhar, saying that the time the accused already served in jail is sufficient.
Noor, aged 27 years, was found murdered at Zahir's Islamabad residence in July 2021, with the probe revealing she was tortured before being beheaded. Zahir's death sentence by the trial court was upheld by the IHC, which had also turned his jail term over rape charges into a second death penalty.

ISLAMABAD: The Islamabad High Court (IHC), Thursday, suspended a single bench's order of directing the government to constitute a commission within 30 days to probe blasphemy cases. A division bench comprising Justice Khadim Hussain and Justice Azam Khan issued the order in an Intra Court Appeal (ICA) filed by Rao Abdul Rahim advocate against the decision of Justice Sardar Ijaz Ishaq Khan. In the ICA, the petitioner urged the court to declare the single-bench decision null and void, and to dismiss the original petition as inadmissible. He maintained that the single bench exercised suo motu powers and issued directions without hearing the respondents' version. The petitioner further argued that the original petitioners had multiple legal forums available to them, including trial courts, but chose not to approach them. He said that forming a commission to probe criminal allegations contradicts established legal procedures and precedents set by the higher courts. In this connection, Justice Ejaz directed the federal government to constitute a commission within 30 days to probe blasphemy cases. He issued the directions in petitions filed by the victim families seeking formation of judicial commission to investigate the cases. The bench directed the federal government to form a commission within 30 days to investigate blasphemy cases. It also directed that the commission formed by the federal government must complete its proceedings within four months. In this matter, the victim families, represented by advocates Abid Saqi and Usman Warraich, had petitioned the high court for the formation of a judicial commission. They mentioned a report by the Punjab Special Branch titled 'The Blasphemy Business'. The report alleged that a suspicious gang had been entrapping youth in blasphemy cases and extorting money from them after filing complaints with the FIA in Rawalpindi and Islamabad. The petitioners asserted that this gang is the complainant in nearly 90 per cent of blasphemy cases registered by the FIA. It added that operating under the name 'Legal Commission on Blasphemy,' the group is said to be consisted of both men and women targeting poor and lower-middle-class Muslim families. They revealed that a concerning pattern emerges in the FIRs: out of over 400 alleged victims, 70 per cent are young men and women in their twenties or younger while many of the victims are professionals, including engineers, Hafiz-e-Quran, and degree holders in various fields. They further said that they had approached the federal government with a formal request dated August 4, 2024, seeking the formation of an inquiry commission on the Special Branch's report. LAHORE: Punjab Minister for Information and Culture, Azma Bokhari, has released CCTV footage of the incidents that took place on May 9, stating that all facts related to this tragic episode have now come to light. She emphasised that court verdicts in the cases related to the failed uprising of May 9 have started to come through after two years, marking a significant step toward justice. Azma Bokhari stated that the planning behind the events of May 9, including the individuals involved and the locations where these conspiracies were crafted, has been fully exposed. 'The masterminds and executors of these attacks, particularly those who incited violence and set fire to the memorials of our martyrs, are the true enemies of Pakistan,' she said, adding: 'Such individuals do not deserve any leniency.' She further said that the attacks on military installations were carried out with complete planning and coordination, and now no ambiguity remains regarding who was involved and how it happened. According to her, under the directions of the Supreme Court, all trial courts are obligated to deliver verdicts in the May 9 cases within four months. Taking a firm stance, Azma Bokhari declared that the mastermind behind May 9 and his coach cannot and will not escape accountability.
