Supreme Court warns governments against invoking stringent laws as tool of harassment

Representative Image NEW DELHI: Cautioning govts not to invoke stringent laws like UP Gangsters Act "as an instrument of harassment or intimidation, particularly where political motivations may be at play", Supreme Court has quashed an FIR lodged under the Act against people taking part in a demonstration after a communal flare-up arising out of a controversial social media post targeting a religious group, reports Amit Anand Choudhary. It said the accused were arrested and booked under various provisions of IPC for vandalising a shop owned by a person who had put an "incendiary" social media post. Supreme Court said the accused were arrested and booked under provisions of IPC for vandalising a shop and there was no need for lodging a second FIR against them by invoking Gangsters Act six months after the incident. Noting the stringent law was invoked 13 days after an accused's daughter-in- law filed nomination for chairmanship of Nagar Panchayat Khargupur (UP), a bench of Justices Vikram Nath and Sandeep Mehta said, "This timing lends credence to their contention the Act may have been weaponised for extraneous considerations. " Allowing the plea of Lal Mohammad and other accused, the bench said the Act was enacted to combat organised gang-based crime and dismantle criminal syndicates, and invoking the law "based on a single incident of communal violence... is a significant departure from its legislative purpose". It said mere involvement of the accused in a demonstration after the communal flare-up, however serious, did not transform the participants into a 'gang' without evidence of organised and continuous criminal activity. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like What She Did Mid-Air Left Passengers Speechless medalmerit Learn More Undo "The constitutional guarantee of personal liberty acquires even greater significance when extraordinary legislation with stringent provisions, such as UP Gangsters Act, is invoked. While the state has broad discretion in criminal prosecution, this discretion must be exercised judiciously, based on relevant considerations, and in conformity with the statutory purpose. The power conferred upon the state cannot be wielded as an instrument of harassment or intimidation, particularly where political motivations may be at play," said Justice Mehta, who penned the judgment. "It is a cardinal principle of criminal jurisprudence that extraordinary penal provisions, particularly those that substantially abridge regular procedural safeguards, must be invoked based on evidence that meets a threshold of credibility and substantiality. The materials relied upon must establish a reasonable nexus between the accused and the alleged criminal activity, demonstrating actual probability of involvement rather than mere theoretical possibility. When a statute creates serious fetters on personal liberty, the evidentiary foundation for its invocation must be commensurately strong, supported by concrete, verifiable facts rather than vague assertions."

Body of Kuki flight attendant from Manipur to land in Nagaland, take detour around Meitei areas

GUWAHATI/KOLKATA: Kuki flight attendant Lamnunthem Singson, one of the crew aboard Air India Flight 171, will be laid to rest in Manipur's Kangpokpi district on Friday - her body transported via Dimapur, not Imphal, as ethnic violence carves detours into grief. The 26-year-old's remains were released to her family Wednesday after DNA confirmation with her brother. The aircraft carrying her body is scheduled to land in Nagaland's Dimapur airport at 1pm Thursday, with a 250km road journey through NH2 to Kangpokpi town expected to end by 7.30pm. Imphal, a mere 75km from Kangpokpi, was ruled out. The family, displaced from Imphal in 2023 during the Meitei-Kuki conflict, now lives in a rented house in Kangpokpi. The decision to avoid Imphal stemmed from fears of fresh unrest despite official guarantees. Kangpokpi DC Mahesh Chaudhari assured that security measures are in place. "We respect the family's emotional state," he said. Kuki Students' Organisation (KSO) member K Songreng is coordinating the final journey. He said Imphal was "not viable" amid ongoing tensions. "Prayer services are planned along the Dimapur route," he said. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like 임플란트, 지금 시작하세요 [자세히 보기] 임플란트 더 알아보기 Undo A funeral will be held Friday at a public cemetery in Kangpokpi. Local Kuki women are preparing a reception at the family's home, where relatives will arrive from Ahmedabad with the remains. Singson's colleague aboard the flight that crashed on June 12 in Ahmedabad was 20-year-old Kongbrailatpam Nganth8oi Sharma, a Meitei woman from Imphal. Her sister Gitanjali, in Ahmedabad since June 13, awaits a DNA match. "They told us to wait and keep patience," said Gitanjali. "She only sent me a message sharing the flight timing. She didn't talk much that day." Over 200 DNA identifications have been confirmed. "We just need a call from the hospital," she said. Meitei Heritage Society issued a statement condemning attempts to politicise the tragedy. "It is immoral and simply wrong to exploit this human tragedy for vested interests by playing politics over the dead bodies," it said. The crash now trails two long, fractured journeys home.

Govt plans Rs 30cr Gopalpur beach revamp

1 2 3 Berhampur: State govt has decided to develop Gopalpur beach in Ganjam district at a cost of Rs 30 crore, which includes its illumination and beautification, commerce and transport minister Bibhuti Bhusan Jena said on Wednesday. The statement of Jena, who is the Gopalpur MLA, comes in the wake of the alleged gang rape of a 20-year-old college student by 10 people at the popular beach resort on Sunday. The tourism department has already sanctioned Rs 30 crore for the development of the beach, Jena said. "The plan includes illumination of the entire beach from Haripur to Baxipllai, it's beautification, and development of a yoga centre," the minister said. Lack of illumination on Gopalpur beach was an issue apparently raised by the police in the case of the recent gang rape. Opposition parties had also raised question mark about the safety of tourists, especially women, in the state. On Wednesday, Jena visited the crime scene. Chief minister Mohan Charan Majhi has taken the matter very seriously, the minister said, adding that the CM has already directed the police to take exemplary action against those involved in the heinous crime. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like 2025 Top Trending local enterprise accounting software [Click Here] Esseps Learn More Undo The minister praised the police for arresting all 10 accused within 24 hours of the incident. He emphasised the need for intensified patrolling on the beach by inducting another all-terrain vehicle. Presently, there is only one such vehicle at Gopalpur police station. "We hope the crime against women and children wing (CAW&CW) of the crime branch, which was entrusted with the investigation, will complete their probe in a time-bound period and ensure the survivor gets justice soon," Jena said. Meanwhile, a three-member team of the crime branch, led by Inspector General (CAW&CW) S Shyni, visited the crime scene and spoke to the local police. The team also questioned the four teenagers, suspected to be involved in the alleged rape, housed in a observation home. Police have requested the juvenile justice board to treat the juveniles as adults, sources said. The six adult accused were produced before judicial magistrate first class, rural, Berhampur, on Tuesday night. Ritika Jena, the magistrate, ordered them to remain in judicial custody for 14 days after rejecting their bail pleas, sources said.
