Trai's new proposal may help check spam as it complements data protection laws

Mumbai: The telecom regulator's latest move to refresh its consent handling mechanism for checking
spam messages and calls
may have some overlaps with the country's new data protection law but isn't in conflict with it, officials said.
Experts welcomed the move, saying harmonising the two sets of regulations is crucial to check spam as it will make it easier for stakeholders to implement the rules.
Last week, the Telecom Regulatory Authority of India (Trai) opened a pilot for banks and telecom companies to test a solution for gathering and managing user consent.
The approved solution after testing will allow telcos to verify consumer consent in real time before connecting or delivering commercial calls and messages.
The move comes as the Telecom Commercial Communications Customer Preference Regulations (
TCCPR
), first introduced in 2018, has failed to deliver results in preventing spam – largely due to lack of coordination among telcos, price-wars, and non-seriousness among enterprises, according to experts.
The country's new data protection law and its mandate on consent management may well be the much-needed impetus for enterprises to take anti-spam regulations seriously henceforth, they said.
'We have tried to devise a framework to validate the current operational, technical and regulatory aspects of consent registration, and lay the foundation for sector-wise scaling,' a senior Trai official told ET on condition of anonymity.
'Yes, there are overlaps between the two legislations. But those aren't conflicts,' he said. 'For instance, TRAI aims to curtail the practice of collecting mobile numbers through unauthorised data-sharing practice, which ultimately leads to marketing spam. This is also a basic principle of the data protection law.'
He called on telcos to develop a solution which is both consumer- and business-friendly.
Aadya Misra, partner at law firm Spice Route Legal, said without harmonisation, businesses will struggle with implementing two distinct consent regimes under these laws.
'Multiple frameworks increase the risk of consumer drop-off and consent fatigue among users. Combining these frameworks would lend legal clarity, operational efficiency, and better outcomes,' she said.

Misra said the original TCCCPR, which hinged on a robust consent mechanism that allows phone users to control what messages they wish to receive, failed because of a gap in enforcement and industry adoption.
'Most businesses lacked robust consent management frameworks or the technological capability to operationalise consent at scale. This has resulted in fragmented processes that are difficult to implement,' she said.
'If the new pilot can simplify integration, ensure interoperability, and provide a standardised infrastructure that businesses can easily plug into…it may just overcome the friction,' she added.
However, businesses will face initial costs while adapting and upgrading their systems, Misra said.

, agreed that there have been challenges in adoption of existing consent framework and the latest directive empowers the consumers with a uniform consent revocation process.
'However, the adoption may differ from sector to sector, as each sector has its own unique way of functioning,' said SP Kochhar, director general of COAI. 'This initiative will serve as a test bed to assess the feasibility and effectiveness of the system, and it is expected to yield positive results.'
Telecom companies also noted that the consent framework currently applies to only SMS and voice communications but will be incomplete until OTT platforms are brought under regulatory purview. 'This regulatory gap is increasingly exploited, with a growing share of scams and unsolicited promotions now originating on OTT apps,' Kochhar said.

This move aimed at protecting mobile subscribers from fraudulent SMS messages carrying suspicious links. The system requires no user intervention with no application download or requirement of changing settings and works directly at the network level. BSNL now blocks suspicious and phishing links in SMS in real time, stopping them before they reach users. Genuine messages like OTPs, banking alerts, and government notifications are still delivered as per TRAI's rules. The system was first shown at India Mobile Congress 2024 and is now being rolled out across all BSNL circles. It also expands and verifies links using reputation data. Working with the blockchain-based DLT system used by Indian telecom operators, it can block over 99% of smishing attempts, according to independent tests. BSNL's New Tech Wipes Out 1.5 Million Daily Scam Threats BSNL says the system can detect over 1.5 million scam attempts every day. Each month, it flags more than 35,000 unique fake web links and 60,000 scam-related WhatsApp and mobile numbers. This comes as the government pushes to grow BSNL's user base. As of July, BSNL holds a 7.78% share of India's wireless mobile market.

A man has claimed he had to travel from Germany to India solely to reactivate his Jio SIM card in a now-viral post on Reddit. In his post shared on Reddit's 'r/LegalAdviceIndia', he detailed what he described as a frustrating and costly experience. 'Hi everyone, I'm seeking clarity on a situation I faced with my Jio prepaid number while living abroad,' he said. advertisementHe explained that his SIM was deactivated on June 12, while he was in Germany. 'I admit that my SIM was not active for more than six months and they do have all the rights to deactivate. But I was not informed in advance through any official SMS or email,' he wrote. Citing TRAI regulations and Jio's own terms and conditions, he said customers should receive advance notification before deactivation and a 15-day grace period to reactivate with a minimum recharge of Rs 20. 'In my case, my SIM was active till June 11 (SMS proof available) but was disconnected the next day without any grace period. I received no notification about the upcoming deactivation,' he said repeated attempts to contact Jio Care, the grievance officer, and TRAI through email, social media, and consumer helplines yielded only 'automated templates that ignored my actual queries.' According to him, Jio never addressed his question about the grace period. 'The only clear response I got was that I had time till 9 September 2025 to reactivate my SIM, but only through physical presence in India,' he to his frustration, he said the appellate authority email provided by TRAI redirected to a Jio Fibre helpdesk that did not register his complaint or issue an appeal number. He argued this raised questions about compliance with the Telecom Consumers Complaint Redressal Regulations, 2012.'Eventually, I had to fly back from Germany to India just to reactivate my number, which caused me loss of pay and travel expenses,' he said. VI, on the other hand, don't want to lose customers, so even though both SIMs sit in a drawer with me here in the UK for 9–12 months, they have always worked when I've topped up while in India.'Another user suggested a workaround: 'I don't think this happens with postpaid connections What you can try is ask relatives to file an FIR that the SIM is lost, then go to a Jio store with the FIR, get a new SIM, recharge, and enjoy. BSNL rolls out anti-spam protection for mobile users

NEW DELHI: State-controlled telecom operator Bharat Sanchar Nigam Limited ( BSNL ) on Thursday began rolling out its network-driven anti-spam and anti-smishing protection for its over 9 crore mobile subscribers. Smishing, a type of cyberattack, is leveraged by scammers to use text messages to lure unsuspecting users into revealing sensitive information that may lead to financial loss or even identity theft. The solution, developed by Hyderabad-based Tanla Platforms , is activated by default on the network side and does not require a separate mobile application or a change in settings. Earlier, its private sector rivals Bharti Airtel and Vodafone Idea launched their respective artificial intelligence (AI)-driven anti-spam solutions and have seen an improvement in the user experience. 'Suspicious and phishing URLs in SMS are detected in real time and withheld at the network edge, so spurious links are not delivered to BSNL users, while legitimate OTPs, banking alerts and government messages continue to flow under TRAI's DLT/UCC framework,' the Ministry of Communications said in an official statement. The solution detects over 1.5 million scams daily, and identifies more than 35,000 unique fraudulent links and 60,000 scam WhatsApp and mobile numbers monthly, to curb unwanted communications. BSNL had demonstrated the solution in October last year, and it is now being expanded across circles as part of the telco's ongoing initiatives to retain subscribers and reduce spam communications. READ MORE | Mobile apps exploit regulatory gap, fuel scams, spam: Telco group As per the ministry, Tanla's solution combines artificial intelligence/machine learning (AI/ML), natural language processing (NLP), reputation intelligence, and link expansion to score messages at line-rate, and works jointly with an industry blockchain distributed ledger technology (DLT) stack to curb unsolicited commercial communication. 'The underlying technology has been recognized for 99%+ efficacy against smishing and operates at a national scale, with ecosystem integrations (e.g., major web and messaging platforms) to rapidly neutralise new campaigns,' the ministry said. In February this year, the Telecom Regulatory Authority of India (TRAI) amended the Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018, to curb spam messages and calls. However, while the telecom regulator has been strengthening the TCCCPR rules, the telcos argue that as long as key stakeholders such as telemarketers and over-the-top (OTT) communications applications are kept out of regulatory purview, there won't be a desired reduction in spam.
