Chan pleaded guilty to a charge under Section 323 of the Penal Code, read together with Section 326A of the same Code. Section 323 provides for a maximum one year in prison, or a fine of up to RM2,000, or both, while Section 326A allows for a sentence of up to twice the maximum term upon conviction for an offence under Section 323 if the victim is a spouse.
