HB265 is now law: Utah colleges begin implementing budget reallocation processes
Later this year, the schools will present their respective final strategic plans to the Utah Board of Higher Education and lawmakers. If their recommended reallocations are approved, they can reclaim the 10% of their annual budget that was cut during the recent legislative session.
Reallocation plans are well underway at Utah's degree-granting institutions. Several schools responded to a Deseret News request for updates on their developing reinvestment plans.
Ultimately, the final allocation plans at each school are sure to be disruptive. Both Utah State University and Weber State University, for instance, have already begun offering voluntary separations to employees.
In a letter earlier this month to faculty and staff, Utah State University Interim President Alan Smith acknowledged that developing and implementing the school's reinvestment plan will demand 'difficult decisions and significant changes'.
'I well understand the concern and anxiety this raises and assure you that we are centering the long-term health of our institution — which is first and foremost comprised of talented and committed people — as we proceed with the planning process.'
The university, Smith's letter noted, must identify 'components of instruction and administration functions' for reduction of elimination in order to account for the approximate $12.5 million being withheld from the school as part of HB265.
'However, we then have an opportunity to use these dollars to reinvest in our institution, with a focus on strategic instructional priorities that meet state needs,' wrote Smith. 'In short, these dollars are not permanently cut but we are required to reallocate them.'
To address the budget impact, Smith announced that USU will implement a university-wide voluntary separation incentive program prior to considering other actions — 'including potential layoffs and other operational reductions'.
USU's voluntary separation option will be open to eligible employees until May 2, 2025 — with separations effective July 1.
'We will work closely with our colleagues at the Utah System of Higher Education to draft a successful plan, get approval from the USU Board of Trustees, and secure approval from the UBHE by July 2025,' wrote Smith. 'The USU plan must then be approved by the Legislature's Higher Education Appropriations Subcommittee in August and the Executive Appropriations Committee in September.'
Smith added that he and his staff remain to employee input on ways USU can address the current budget impact.
Weber State University has assembled a committee of 'key stakeholder groups' including faculty representation from each of the university's colleges to navigate implementation of HB265, according to a university information page dedicated to the reinvestment plan.
Approximately $6.7 million of the Ogden school's budget will be reallocated.
'We're trying to find efficiencies, things to streamline, things to reduce or eliminate, but all with the goal of ensuring Weber State remains strong and can deliver on the promise we've made to our students to give them the best education,' reported university spokesperson Bryan Magaña in an email.
WSU's reinvestment committee will examine criteria and identify potential cost savings in reallocating academic and student success programs to comply with the Legislature. The committee will also offer recommendations on gathering input from stakeholders, utilizing methods such as surveys and town halls.
Key administrative positions at WSU have already been eliminated, after attrition, to date, including:
Vice President of Information Technology.
Assistant Vice President of Regional Partnerships.
Vice Provost for High Impact Educational Experiences and Faculty Excellence.
Training Lead for Student Success.
Dean of the Moyes College of Education.
WSU has also announced plans to realign academic programs in the Moyes College of Education among closely related colleges, according to the university.
New 'academic homes' are being determined for four departments: Child & Family Studies; Teacher Education; Health, Physical Education & Recreation; and Exercise & Nutrition Sciences.
Students on those impacted paths will be able to finish their degrees — and new students will have the same opportunities, only under different organizational structures and leadership, according to Magaña.
The renovated McKay Education Building is still slated to be opened later this year.
'To be clear, Weber State is still committed and laser-focused on training future educators,' said Magaña. 'Preparing Utah's K-12 teachers is a big part of our legacy and it's a big part of our future.'
Like Utah State University, WSU announced its own 'voluntary separation incentive program' for eligible employees in academic affairs.
'Ultimately, difficult decisions will need to be made that impact people and programs, and our goal is to avoid as many involuntary layoffs as possible,' according to a university site explaining the separation program.
'Offering a voluntary separation package early provides an option for those interested and helps inform our HB 265 planning process,' the site noted.
'We're charged with making tough decisions in the coming weeks, but we're also trying to see this as an opportunity to shape our future for the better as a university,' wrote Magaña.
Officials at Salt Lake Community College and Utah Tech University also reported on their developing reinvestment processes.
SLCC and Utah Tech are required to reallocate $5.2 million and $2.5 million, respectively.
'Based on the recent legislation regarding HB265, Salt Lake Community College has put in motion a thorough and transparent process to evaluate instructional programs involving input from a variety of stakeholders — including deans, faculty members, and the college's top leadership,' according to a SLCC statement.
'The college is taking a methodical and data-driven approach to determine the most appropriate programs to fund with plans to have final decisions made by the end of May.'
In a statement from Utah Tech University, campus leaders at the St. George institution said they have been engaging in 'planning exercises and conversations' to prepare for the funding reallocation outlined in HB 265.
'Now that the legislative session has concluded, we plan to convene a committee that will help ensure all members of our campus community are able to provide perspective as we work through the process outlined in the bill.
The committee will assist in gathering feedback, identifying potential savings, communicating with campus and providing support resources to those affected. "
Utah Tech expects to submit its strategic reinvestment plan to the Utah Board of Higher Education early this summer.

Gov. Cox defends Utah Senate president
Utah Gov. Spencer Cox stood by state Senate President Stuart Adams on Thursday, defending the top lawmaker's decision not to disclose his personal connection to a law inspired by the criminal case of his granddaughter. During a tense exchange with reporters, Cox said there is no need for an investigation into Adams' behavior because he and Senate Majority Leader Kirk Cullimore, R-Draper, have openly stated the extent of their involvement in the law's passage. 'There's nothing to investigate,' Cox said. 'The facts of this are very, very clear.' What is the new law? The provision, which passed in 2024 as part of SB213, allows 18-year-old high school students to be charged as 17-year-olds if they engage in noncoercive sexual activity with teenagers who are 13. In a stated effort to keep the process fair, Adams did not tell legislators, except for Cullimore — the bill's primary sponsor — that his granddaughter was currently the defendant in a Davis County criminal case falling into that category. Cullimore has said that after Adams told him about his granddaughter's situation in 2023 he contacted her defense attorney, Cara Tangaro, to identify statutory changes to prevent high school students from being charged with child rape when no force was involved. The change was discussed in committee hearings and floor debates before passing as part of the 49-page criminal justice omnibus bill. The law did not apply retroactively to Adams' granddaughter, but it was referenced at her sentencing. Court observers disagree on the extent to which the law may have shaped the eventual plea bargain that let the granddaughter avoid a prison sentence and sex offender designation. 'I don't think there are any facts in dispute,' Cox said. 'He talked to the Senate majority leader. The Senate majority leader took that information and he proposed a piece of legislation.' Calls for Adam to resign State Sen. Nate Blouin, D-Salt Lake City, Utah Democratic Party Chair Brian King, and activist groups across the political spectrum have called on Adams to resign, alleging that he abused his power. But Cox said these criticisms are unfounded. This is the process taken by many pieces of legislation, the governor said, and by not disclosing his personal situation, including to Cox, Adams allowed lawmakers to focus on the policy's merits. 'Every single legislator has experiences in their life where they see something that they feel may be unjust, and that influences the way they bring legislation to the table,' Cox said. Cox pushed back against some legislators who have said the provision was snuck into the bill late in the process. It was part of the initial draft and was debated by stakeholders, Cox said, adding that those who say they didn't know about the provision are 'lying to you, or they're a terrible legislator.' Review will happen Cox repeatedly said he was 'grateful' that Adams had not told him 'this was impacting someone in his family' because it may have changed how he 'reacted to the bill.' But Cox said he and others now have a chance to revisit the legislation if needed. On Friday, Utah House Speaker Mike Schultz announced the creation of a working group of policy experts to 'review' SB213 and analyze state laws related to unlawful sexual activity among high school students. In an interview with Deseret News and last week, Adams said he had no participation in the drafting of the provision, or its placement in SB213, and said the way the bill became law 'was done ethically and morally perfect.' Cox said on Thursday that Adams made the right call by staying out of the legislative process as much as he could as it related to the provision — even if it was initiated by his concerns tied to a family connection. 'I think it was appropriate for the top person in the Senate not to weigh in on this bill, which is exactly what happened,' Cox told reporters. Pulse nightclub memorial crosswalk painted over in ‘cruel political act'
A rainbow crosswalk outside the Pulse nightclub in Orlando was painted over by state officials in the early hours of Thursday, in a move criticized by Mayor Buddy Dyer as a 'cruel political act.' In a statement shared on social media, the Democratic mayor said he was 'devastated to learn that overnight the state painted over the Pulse Memorial crosswalk on Orange Avenue.' The crosswalk was installed in 2017 as part of a memorial honoring the victims of the June 2016 mass shooting, when a gunman opened fire during the LGBTQ club's popular Latin-themed night, killing 49 people and injuring more than 50. 'This callous action of hastily removing part of a memorial to what was at the time our nation's largest mass shooting, without any supporting safety or discussion, is a cruel political act,' Dyer said. According to the mayor, the crosswalk enhanced safety and visibility for visitors and also 'served as a visual reminder of Orlando's commitment to honor the 49 lives taken.' Fellow Democrat Carlos Guillermo Smith, an Orlando state senator, accused the Florida Department of Transportation of 'illegally' vandalizing city property 'in the middle of the night' without notifying the city or obtaining approval. 'I cannot believe that the DeSantis administration has engaged in this hostile act against the City of Orlando,' Smith said in a video shared on social media, calling the move 'a disgusting act of betrayal.' Smith, who's gay, said he hoped the City of Orlando would sue the state for vandalizing its property. Gov. Cox worries about what will be lost in national redistricting battle
Utah Gov. Spencer Cox said on Thursday the redistricting battle taking place in states across the country ahead of the 2026 midterm elections could backfire in the long term. Referencing the principle of 'Chesterton's Fence,' Cox said it is unwise to eliminate a system without fully understanding why it was established in the first place. 'Sometimes, I think we make changes to long-standing norms and policies, not realizing the consequences of those changes to those norms and policies,' Cox said. 'I fear that this may be one of those.' Speaking at his monthly PBS news conference, Cox returned to a regular theme of his, emphasizing the deep divides in U.S. politics, and worrying that a redistricting race to the bottom will only make it worse. On Wednesday, the Texas House approved new district maps at the behest of President Donald Trump that will increase the number of congressional seats Republicans are likely to win in the state. The California Legislature is poised to approve its own map changes this week that could secure them an extra five seats next year — the same number Republicans are expected to flip in the Lone Star State — as long as voters approve the maps in November. 'We just see the escalation that continues to happen,' Cox said. 'It just continues to ratchet up the toxicity — and the stakes, quite frankly — and so I would be very cautious about doing that.' A gerrymandering arms race Since Trump called on Texas Republicans last month to break with redistricting tradition, Democrats have accused the GOP of gerrymandering tactics that border on election interference, and have threatened to retaliate in kind. Meanwhile, Republicans have cited Democrats' history of gerrymandering in blue states, and recent Supreme Court rulings that allow for politically motivated redistricting in what is fundamentally a political process. The finger-pointing by both sides could accelerate a worrying trend toward norm breaking and partisan tribalism, according to Cox, who gained recognition for his Disagree Better campaign as National Governors Association chair. 'We are so polarized as a country with the trust in institutions falling,' Cox said. 'I can't see a scenario where every two or four years we're redistricting, I can't see a scenario where that makes life better for anybody.' Utah's congressional boundaries are currently being litigated in federal court over allegations that state lawmakers violated the Utah Constitution by ignoring recommendations from an independent redistricting commission created by voter initiative. The maps approved in 2021 redrew the Beehive State's congressional districts in a way that split up Democratic voters between the state's four House districts and made it more difficult for a Democrat to represent the state in Congress. Shifting the census consensus Republicans have partially justified their redistricting revolution by alleging the 2020 census may have undercounted in Republican-led states and overcounted Democratic-held states by including noncitizens. The U.S. Constitution mandates a national census every decade to count all residents. Earlier this month, Trump announced his administration will work on a new census that excludes 'People who are in our Country illegally.' On Thursday, Cox said there are questions about whether noncitizens should be factored into the distribution of Electoral College votes. But he said the census should still count every resident to provide the best data. In an interview with the Deseret News earlier this month, Utah Rep. Mike Kennedy, of the state's 3rd Congressional District, said he agrees with the president that 'citizens should be counted, not undocumented individuals.' 'Citizens are what the Founders intended,' Kennedy said. 'I don't believe the founders ever foresaw the possibility that our country would have tens of millions of people in this country that are living illegally in this country.' Modern technology has made it possible to conduct a census at least every five years, according to Kennedy, which he said would help elected officials govern better amid a rapidly changing population. Not all mail-in voting created equal On Monday, Trump also took on the form of voting used by a majority of Utahns, announcing he would lead an effort to 'get rid of mail-in ballots' by signing an executive order to 'help bring HONESTY to the 2026 Midterm Elections.' Utah Sen. Mike Lee responded in favor of Trump's initiative while Utah Lt. Gov. Deidre Henderson reiterated that the 'constitutional right' of states to decide how to 'conduct secure elections is a fundamental strength of our system.' 'The Constitution is very clear that it's in the purview of the states and not the federal government,' Cox agreed, during Thursday's press conference. 'And I think states should defend that.' However, Cox said Trump is right to be 'extremely cautious when it comes to mail-in voting' because, unlike Utah, most states implemented a vote-by-mail system 'virtually overnight' in response to the COVID-19 pandemic. Utah started rolling out vote by mail in 2012 before implementing it statewide in 2019. The Legislature continues to enhance safeguards for the process, voting in 2025 to implement ballot deadlines and a new identification measure. For this reason, many of the criticisms levied toward mail-in ballots do not apply to Utah, according to Cox. When skeptics get a chance to view the process, Cox said they come away with increased confidence in election security. 'We can do both things,' Cox said. 'We can defend the role of the states and be very serious about voter integrity. And I think more states need to be more serious about voting integrity.'
