Court dismisses businessman's defamation suit against ‘The Star'
The suit concerned a report titled 'Nasi Kandar Shakedown: Penang restaurant claims they are being harassed for protection money', which appeared in the newspaper on Oct 16, 2020.
Justice Rozana Ali Yusoff ruled yesterday that the defendants – the journalist and the publication – had not defamed the plaintiff and were protected by qualified privilege.
The judge said the article involved matters of public interest, specifically public health and safety, and that the defendants' defence of qualified privilege had been successfully proven.

The court ordered Sabaruddin to pay RM30,000 in costs to the defendants, Bernama reported.
Lawyers Nicholas Navaron and Soraya Sulaiman Ong represented Imran Hilmy and The Star, while Sabaruddin was represented by S. Raveentharan and R. Asmeeta.
In April 2021, Sabaruddin filed the suit, seeking damages, the removal of the article, and a public apology.
The original article reported that the owner of a well-known nasi kandar restaurant in Penang had lodged a police report, alleging that he and his staff were being harassed for protection money.
The reporter interviewed the restaurant owner and his son, who claimed that a man referred to as a 'Datuk' had threatened that the restaurant would be vandalised and its staff harmed if the payments were not made.

Father, son charged over 'road show' robberies targeting foreigners
BATU PAHAT: A father and son, who allegedly committed a series of "road show" robberies targeting foreigners over the past two years, were charged in the Sessions Court today. The accused, lorry driver Dhana Rao Surinarayanan, 40, and his son, Jayaram, 20, pleaded not guilty before judge Osman Affendi Mohd Shalleh. Dhana Rao faces four charges, while Jayaram faces one. According to the first, third, and fourth charges, Dhana Rao is accused of robbing three foreign men of their mobile phones and cash. The alleged robberies took place at three different locations, an industrial area, Jalan Mutiara Sri Gading, and Pekan Ayer Hitam,between 5.30pm and 8.10pm on June 6, June 26, and July 6. He was charged under Section 392 of the Penal Code, which carries a penalty of up to 14 years' imprisonment and a fine or whipping upon conviction. For the second charge, Dhana Rao and Jayaram were jointly accused of robbing another foreigner in front of a clinic in Ayer Hitam at 6pm on July 16, 2023. This offence was charged under Section 395 of the Penal Code. Deputy public prosecutor Sharifah Natasha Syed Ahmad led the prosecution, and the father and son were not represented by a lawyer. The court set Sept 9 for case mention. Bail was set at RM10,000 for each charge, with additional conditions that both men must report to the nearest police station once a month, not interfere with prosecution witnesses, and surrender their passports to the court until the case is concluded. The two will also be charged with similar offences in the Johor Baru and Kluang Sessions Courts soon.

Cop denies dangerous driving charge over teen's death
GURUN: A policeman has claimed trial to a charge of causing death by dangerous driving after a crash in Guar Chempedak. Azhar Mat Saini, 52, a corporal, pleaded not guilty before Magistrate Anis Suraya Ahmad at the Magistrate's Court here. According to the charge sheet, Azhar was alleged to have driven in a manner dangerous to the public at about 9pm on July 28 at a traffic light intersection in Guar Chempedak town. The crash caused the death of 16-year-old motorcyclist Muhammad Nur Iman Danial Mohd Roshidi. The offence is framed under Section 41(1) of the Road Transport Act, which provides for an imprisonment term of between five and 10 years and a fine of between RM20,000 and RM50,000 upon conviction. Deputy public prosecutor Nik Nurhazirah Tuan Yahya appeared for the prosecution, while Azhar was represented by lawyer S. Parameswaran. Nik Nurhazirah requested bail to be set at RM13,000, but Parameswaran appealed for a lower amount. He said the accused is supporting a wife who is a school teacher and four children aged between 11 and 18, including one with a disability. The court allowed bail at RM6,000 with one surety and fixed Sept 29 for mention. Azhar's driving licenses were also suspended. The victim's parents, Mohd Roshidi Alias and Norliza Salleh, both 44, were at the courthouse with other family members. Roshidi said the family hopes for a just and fair trial.

Muhyiddin seeks to drop graft charges in Jana Wibawa case
rahmat@ KUALA LUMPUR: Former prime minister Tan Sri Muhyiddin Yassin has submitted a letter of representation for the prosecution to drop seven corruption charges linked to the Jana Wibawa scandal. Lead prosecutor Datuk Wan Shaharuddin Wan Ladin told the High Court today that the Attorney-General's Chambers received the letter last week and is now considering the matter. He was speaking before High Court judge K. Muniandy during the hearing. The court has fixed Oct 7 for the next hearing. Muhyiddin was represented by lawyers Datuk Amer Hamzah Arshad and Rosli Dahlan. The Parti Pribumi Bersatu president was charged with four counts of abuse of power for allegedly soliciting RM232.5 million in bribes for the political party from Bukhary Equity Sdn Bhd, Nepturis Sdn Bhd, Mamfor Sdn Bhd, and Datuk Azman Yusoff in connection with the Jana Wibawa project. He was accused of committing the offence at the Prime Minister's Office in Putrajaya between March 1, 2020, and Aug 20, 2021. The Pagoh member of parliament also faces three charges of receiving RM200 million in illegal proceeds from Bukhary Equity Sdn Bhd, which were deposited into Bersatu's Ambank and CIMB Bank accounts. The offence was allegedly committed at AmBank, Amcorp Mall branch, Petaling Jaya on Jan 7, 2022, and CIMB Bank, Menara KL Branch, Jalan Stesen Sentral, between Feb 25 and July 16, 2021, and Feb 8 and July 8, 2022.
