Bengal riots: Guv files report to MHA, says radicalisation posing challenge

West Bengal Governor C V Ananda Bose has submitted a report on the recent riots in Murshidabad district to the Union Ministry of Home Affairs, mentioning that the "twin spectre of radicalisation and militancy" poses a serious challenge to the state.
In his report, he suggested a slew of measures, including setting up an inquiry commission and outposts of central forces in districts bordering Bangladesh, besides writing, "needless to add, the provisions under Article 356 of the Constitution also remain".
Asked about the mention of "the provisions under Article 356 of the Constitution" in the report, an official told PTI, "The governor has not proposed for implementation of Article 356. He meant to say that the provisions of Article 356 of the Constitution are open to the Centre if the situation in the state further deteriorates." The imposition of Article 356 of the Constitution refers to the President's rule in a state.
The governor also expressed apprehension about a "spillover" of the Murshidabad violence to other districts of the state and recommended that the central government should consider "constitutional options to put a check on the current situation besides generating confidence of people in the rule of law".
"The twin spectre of radicalisation and militancy poses a serious challenge for West Bengal, especially in two of the several districts sharing an international border with Bangladesh, viz., Murshidabad and Malda. In both these districts, there is an adverse demographic composition with Hindus being minorities. Another district, viz., Uttar Dinajpur, has a plurality," Bose mentioned in his report, a copy of which is with PTI.
The governor suggested several measures in the aftermath of violence that claimed the lives of at least three people, including a man and his son, and left several injured. The riot occurred amid anti-Waqf (Amendment) Act protests.
"Formulating an overarching legislation to empower the Union Government to maintain law and order when the state machinery fails to act effectively. Appointing a commission of Inquiry under the Commissions of Inquiry Act, 1952, to look into the reported acts of omission and commission as indicated above and to suggest measures to prevent such incidents in future and needless to add, the provisions under Article 356 of the Constitution also remain," the report mentioned.
Of late, there are "indications of radicalisation and polarisation", it said.
"The divisions are so deep that even in the face of escalation of violence, the chief minister's repeated undertaking' that she would protect minority interests, and that the Act would not be implemented in the state, have done little to assuage the Muslim community or stem the tide. It is imperative that the rule of law must be firmly established, and the police must prevent violence," Bose wrote in the report.
The governor also said, "To go by the history of political violence that the state is prone to and from the spillover effect that the Murshidabad violence had over other districts in the state, may I suggest that the Government of India considers the Constitutional options not only to put a check on the current situation but also to generate confidence of people in the rule of law." In the report, the Bengal governor also claimed that the riots appeared premeditated and the state government was aware of the imminent build-up of a threat to law and order in Murshidabad.
"As the Notification of the Waqf (Amendment) Act, 2025 was issued on 08.04.2025, conflagration unfolded in Murshidabad district that spiralled out of control and continued for several days. On 08.04.2025, the state government promulgated temporary suspension order of internet...Thus, the state government was aware of the imminent build-up of threat to law and order in Murshidabad," Bose alleged in his report.
It was expected that the state government also put in place a "viable security mechanism on the ground that could prevent any occurrence and escalation of violence", he said.
"Clearly, the sequence of events that unfolded shows the woeful lack of coordination among administration and law enforcement agencies that were either too feeble to rise up to the challenge or were reluctant to do so," Bose alleged.
The ruling TMC functionaries and the state government officials could not be reached for their comments on the governor's report.

The Anti-Corruption Bureau (ACB) has issued a notice to K. T. Rama Rao (KTR), the Working President of the Bharat Rashtra Samithi (BRS) and former Minister, requiring him to attend questioning on Monday, the 16th of this month at 10 am, in relation to the Formula E Race case. Previously, the ACB had summoned KTR on May 26, asking him to appear for questioning on May 28. However, he was unable to attend due to a tour in America. KTR informed the ACB of his foreign commitments and indicated his willingness to cooperate once he returned. The ACB subsequently agreed to reschedule and has now issued another notice for his appearance. It is important to note that KTR has previously attended questioning sessions with both the ACB and the Enforcement Directorate (ED) concerning the same case. On January 6, he arrived at the ACB for an inquiry with his legal team but departed when officials did not permit him to enter. He returned to the ACB for questioning on January 8, where he was interrogated for approximately seven hours. Although he was called again on January 9, KTR requested additional time to respond to the inquiry. In addition, the ACB has questioned Arvind Kumar, Secretary of the Municipal Department, and BLN Reddy, the former Chief Engineer of HMDA, as part of its investigation. The inquiry stems from allegations of the misuse of ₹55 crores related to the Formula E race, which was held in Hyderabad during the BRS administration.

New Delhi, The Supreme Court on Friday sought the Karnataka government's response on a plea seeking protection against alleged threats over the screening of Kamal Haasan's film "Thug Life" in Karnataka theatres. A bench of justices Prashant Kumar Mishra and Manmohan issued notice on M Mahesh Reddy's plea challenging the ban on the screening of the Tamil feature film, starring Haasan and directed by Mani Ratnam, in Karnataka. It listed the matter for hearing next Tuesday. Reddy in his plea filed through advocate A Velan contended that despite the movie being granted certification by the Central Board of Film Certification , the Karnataka government has allegedly prevented its theatrical release through oral instructions and police interference, without issuing any official prohibitory order or any registration of an FIR qua the same. Velan argued that such actions by the state amount to an unconstitutional restriction on free speech and expression under Article 19 of the Constitution. The bench recorded his argument that the so-called ban under threat of violence stems not from any lawful process but from a deliberate campaign of terror, including explicit threat of arson against cinema halls, incitement of large-scale violence targeting linguistic minorities. The plea said, "This reign of intimidation is a direct, flagrant violation of the Fundamental Rights to Freedom of Speech and Expression ) and to Practice any Profession ). More seriously, it is a calculated attack on the secular fabric and public order of the State." It added that the Karnataka government through its authorities concerned has become a silent party to this undermining of the Constitution and its failure to use the full force of the law against those openly issuing threats of death, arson, and communal warfare is not just negligence; it is a surrender that effectively hands control to violent non-state actors. "This constitutes a profound and flagrant failure of the law and order machinery in the state, signifying a dangerous weakening of the constitutional machinery's ability to function and protect its citizens," it said. The plea sought direction declaring that the de facto ban on the screening of "Thug Life" in Karnataka, is illegal, unconstitutional, and void ab initio, being violative of Articles 14, 19, 19 and 21 of the Constitution. It also sought directions to the authorities including police to ensure the safe, secure, and unimpeded exhibition of the film in all cinema theatres and multiplexes across Karnataka , that are willing to screen it, and to take all necessary steps to prevent any recurrence of such intimidation for this or any other lawfully certified film. The plea further sought direction to initiate and pursue with utmost diligence, accountability, and transparency, appropriate legal proceedings, including criminal prosecution, against all individuals and office bearers of organizations who have issued threats of violence, arson, or incited communal hatred/violence in connection with the release of the film. On June 9, the top court refused to grant an urgent hearing on a plea filed by a theatre association seeking protection against alleged threats over the screening of the film in Karnataka theatres. It had asked the theatre association from Karnataka to approach the Karnataka High Court instead. "Thug Life" released in cinema halls across the country on June 5. The Tamil movie, which reunites Haasan with filmmaker Mani Ratnam after 1987's "Nayakan", could not be released in Karnataka after the 70-year-old's comments about Kannada language sparked a major controversy. It was also released in Telugu, Hindi and Malayalam.

Underlining the need to protect journalistic freedom, the Supreme Court on Friday granted bail to senior journalist K Srinivas Rao, also known as KSR, who was arrested over allegedly offensive remarks made by a panellist on a show anchored by him on a Telugu news channel, and wondered how an anchor could be arrested for comments made by a panellist. Justice Manmohan, who was part of a two-judge bench, asked the state government, 'Someone else is making the statement. How can this be?' The bench, presided by Justice P K Mishra, directed that he be released on bail, subject to conditions as may be imposed by the trial court. 'Considering that the petitioner himself has not made any such statement and his journalistic participation in a live TV show deserves to be protected so that the freedom of speech is also protected in the process, we direct that the petitioner shall be released in relation to the FIR, subject to the conditions to be imposed by the trial court,' it ordered. The court, however, 'made (it) clear that the petitioner shall not involve himself in any defamatory statement either by himself or by allowing others to make such statements in his presence in the show which the petitioner is anchoring or hosting.' On June 9, the Andhra Pradesh Police arrested Rao from Hyderabad over the alleged comments made on June 6 by a panellist who had appeared on a show on Sakshi TV and referred to the state capital Amaravati as the 'capital of sex workers'. The remarks, made apparently on the basis of a study by the National AIDS Control Organisation (NACO), which said that Andhra Pradesh has the second highest concentration of female sex workers in the country, led to a political row between the ruling Telugu Desam Party (TDP)-led alliance and the Opposition YSR Congress Party (YSRCP). YSRCP chief Y S Jagan Mohan Reddy's wife Y S Bharathi Reddy heads the Sakshi Media Group. Following complaints, a First Information Report (FIR) was registered under various provisions including the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. On Friday, Senior Advocate Siddharth Dave, appearing for Rao, pointed out that the alleged objectionable remarks which formed the basis of the FIR were not made by him but by a panellist. To the court's query as to how the anchor could be arrested for comments by a panellist, Senior Advocate Mukul Rohatgi, appearing for the state, said Rao 'was goading and abetting the man who was making that statement. He was laughing.' Justice Manmohan, however, said, 'When someone makes an outrageous statement, we laugh it off. They can't be termed co-conspirators.' Justice Mishra stated, 'Everyday this is happening!' Defending the arrest, Rohatgi said, 'This is not a case of somebody being a standby. He is not a bystander. He is a part of the same channel.' The court did not seem to agree. 'But he is not saying this,' said Justice Mishra. 'He is goading the fellow. You can't go around saying things like it is a capital of sex workers,' said Rohatgi. Senior Advocate Siddharth Luthra, who also appeared for the state, submitted that the statement was more than defamatory. The bench, however, went on to grant relief to Rao.
