In a setback to the Uttar Pradesh government , the Supreme Court on Monday said it would keep in abeyance its May 15 nod to the ambitious scheme to develop the Shri Banke Bihari Temple Corridor at Vrindavan in Mathura for the benefit of devotees as main stakeholders were not heard.A bench of Justices Surya Kant and Joymalya Bagchi deprecated the approach of the state government in moving the court in "clandestine manner" and questioned the hurry for enacting an ordinance Uttar Pradesh Shri Bankey Bihari Ji Temple Trust Ordinance, 2025 to take over the management of the ancient temple.The top court said it would appoint a committee headed by a retired high court or district judge to manage the affairs of the temple in the interest of lakhs of devotees besides including the main stakeholders in the managing committee.The bench told Additional Solicitor General K M Nataraj, appearing for the Uttar Pradesh government, "Less said the better. How do you justify the directions passed by the court? The state in the most unfortunate way came to the court in the most clandestine manner without informing the court receiver or stakeholders (members of the family who claimed to be the owner of the temple). Get the directions behind their back and set aside the order of the high court. This is the least thing we expect from the state."The top court at present is not adjudicating the constitutionality of the ordinance and the high court will look into it.The bench asked Nataraj to seek instructions while deciding to pass an order on August 5 to keep the May 15 order in abeyance and appoint someone as the managing trustee of the temple to look after the daily affairs."This is the land of lord Krishna. Let's find a way out to resolve the dispute pending for years and develop the area in the interest of lakhs of devotees who visit these iconic religious places. Basic amenities need to be created as nowadays religious tourism is one of the biggest sources of revenue," the bench said.It assured all the stakeholders, including several warring factions, who claim to be owners of the temple that some responsible person would be given charge to manage the affairs of the temple aside from a mandate to develop the adjoining areas and small temples in nearby localities.When Nataraj pointed that one person claiming to be from the Goswami community moved the top court for intervention but was not heard by the community, the bench asked if the court-receiver was in-charge of the temple management , why was the person not heard and a response from other warring factions not sought.The top court further questioned the government of wanting to acquire five-acre land for developing a holding area from the temple funds and not use its money."What stopped you from acquiring the entire land and properties from your corpus in public interest? What was the tearing hurry in enacting the ordinance, when the matter was sub-judice? Providing basic amenities and developing the area is the duty of the state. There are numerous instances where the state's participation has helped in developing the religious places like in Golden Temple in Amritsar," the bench said.Senior advocate Shyam Divan, appearing for members of the managing committee, said the order was passed without hearing them and as it was a private temple, they were required to be heard.The bench said the term "private temple" was a misnomer and the state was trying to acquire the land for the benefit of lakhs of devotees who visit the temple every year.The top court posted the matter for August 5 while asking Nataraj to seek instructions and clarifying that the constitutionality of the ordinance would be decided by the high court for which it would modify the May 15 order.The managing committee members and other petitioners who sought the recall or modification of the May 15 order were asked to give certain suggestions with respect to the management of the affairs of the historic temple The plea, filed through advocate Tanvi Dubey, of the management committee of the Thakur Shree Banke Bihari Ji Maharaj Temple in Mathura, challenges the ordinance, which vested the control of the shrine's administration with the state.On May 15, the top court allowed an impleadment application filed by the state and paved the way for a Uttar Pradesh government scheme to develop the corridor.

SC prohibits construction and commercial use near historic Gumti structure in Defence Colony
New Delhi, Aug 4 (UNI) The Supreme Court has directed that the park adjacent to the historic Gumti structure located in Defence Colony, New Delhi, must not be used for any purpose other than public recreation and preservation. The Court made it clear that no construction of facilities like badminton or basketball courts, nor any form of commercial activity, will be permitted due to the sensitive nature and spatial constraints of the area. A Bench comprising Justice Sudhanshu Dhulia and Justice Ahsanuddin Amanullah was hearing a writ petition filed in 2019 seeking protection of the Gumti under the Ancient Monuments and Archaeological Sites and Remains Act, 1958. "The only direction which needs to be given here is that the park should not be used for any other purpose. No activities such as construction of a badminton or basketball court shall be undertaken, considering the limitations of the area itself," the Bench observed. It added, 'Needless to say, there shall be no commercial activity or kiosks/shops allowed in the vicinity.' The petition was filed after the Defence Colony Welfare Association (DCWA) allegedly carried out unauthorized alterations near the monument, despite its historical significance. Representing the petitioner was Senior Advocate Shikhil Shiv Suri. Senior Advocates Garima Prasad and Gopal Sankaranarayanan, along with Advocate Shubhranshu Padhi, represented the respondents, with Sankaranarayanan also serving as the Court Commissioner. The case has a long history. In 2004, the Central Government issued a gazette notification intending to declare the Gumti as a monument of national importance. However, this was met with objections from the DCWA, causing delays within the Archaeological Survey of India (ASI). After the Delhi High Court dismissed the petitioner's plea for protection under the 1958 Act, the matter was brought before the Supreme Court. In a significant development on July 16, 2025, the apex court criticized the Municipal Corporation of Delhi (MCD) for its actions, noting that they appeared to obstruct justice. The Court had then considered issuing contempt notice and directed the CBI to conduct a preliminary inquiry into the unauthorized occupation and modifications around the monument. The Court also instructed the MCD to demolish all unauthorised structures, clean the area, and hand it over to the Department of Archaeology. The Bench took note of ongoing efforts and pending tasks including, finalising and completing the Gumti's restoration plan. Publishing the official notification declaring it a protected monument. Clearing remaining debris and leveling the park area and finalizing the landscape plan with permissible public activities like cycling and walking. The Bench emphasized that the park, which consists of four quadrants, should be maintained and beautified for the benefit of the general public while preserving its natural character. SC sets ball rolling for B'luru civic polls; orders delimitation by Nov 1
New Delhi/Bengaluru: (SC) on Monday issued the go-ahead for polls to the five newly-created municipal corporations in Bengaluru — in place of Bruhat Bengaluru Mahanagara Palike (BBMP) — to ensure better civic amenities in the metropolis. A bench of Justices Surya Kant and Joymalya Bagchi ruled that when the population has been estimated by the state to have increased from 84 lakh in 2011 to 144 lakh in 2025, there is a need for carrying out delimitation exercise, based on which, the State Election Commission (SEC) can finalise the electoral rolls. Appearing for the state, senior advocate A M Singhvi and state advocate general Shashi Kiran Shetty said the delimitation process would be carried out between Sept 3 and Nov 1, when the final notification on ward delimitation will be published. They said final notification on ward reservation will be published on Nov 30. The SEC, through senior advocate K N Phanindra, had told the court that EC could not hold elections to the five new municipal corporations in Bengaluru unless the state notified the 'Conduct of Election Rules'. Responding to it, Shetty told the court that the state would notify the relevant rules within a week. The SC told SEC to proceed with finalisation of the voters' list for the civic bodies immediately after finalisation of the delimitation process and to complete the process in 60-90 days. The court has posted further hearing on Nov 3. SEC said in its affidavit it would require "60 to 90 days after issuance of final notification of delimitation by the state govt for preparation and finalising electoral rolls/voters' list for the five newly-constituted city corporations". Parl stalled, Rijiju says may press for bills' passage without debate
NEW DELHI: The governmentt would be compelled to press for the passage of bills in "national interest" without discussion if Parliament proceedings are disrupted, parliamentary affairs minister Kiren Rijiju warned on Monday, as the opposition continued its protest over the revision of Bihar's electoral rolls, with Lok Sabha failing to take up two key proposed legislations related to sports. Rajya Sabha was adjourned for the day as a mark of respect following the death of sitting MP and JMM founder Shibu Soren. On Parliament complex, Rijiju told reporters that the opposition had agreed to a two-day discussion over the National Sports Governance Bill, 2025 and National Anti-Doping (Amendment) Bill, 2025. These were important keeping in view India's bid for the 2036 summer Olympic games but opposition members disrupted proceedings, he said. The Govt would be "compelled to press for the passage of the bills from Tuesday in 'national interest' as the proposed legislations are important for governance", the minister said. The two sports-related bills were listed for discussion and passing on Monday.
