Banks aim to reverse crunch appeal court victory for car buyers

British lenders are heading to the supreme court this week as they try to overturn a ruling that has propelled the car finance scandal to new heights, triggering government intervention and prompting fears of a £44bn compensation bill.
Two specialist lenders, Close Brothers and FirstRand, are challenging three consumers who collectively won a court of appeal case in October. That ruling said that failing to disclose plainly to consumers the amount of commission paid to dealers, and get their informed consent, was unlawful.
The decision sent shockwaves through an industry already spooked by the potential fallout of a much smaller car loans investigation launched by the Financial Conduct Authority (FCA) last January.
The high-profile case is due to run for three days from Tuesday in front of judges including the supreme court president, Lord Reed, in London. Depending on the final ruling, it could have significant implications for both the financial services industry and inbound UK investment.
Roughly 90% of new cars, and a growing number of used vehicles, are bought with the help of motor loans, many doled out through car dealers.
While the ruling was in reference to car loans, there are fears that it could encompass a range of financial products that are sold on commission, including insurance, resulting in a massive compensation bill that analysts have been loath to estimate.
The car loans scandal alone is projected to cost lenders, including Santander UK, Close Brothers, Barclays and Lloyds, a collective £44bn, according to some analysts. That would nearly rival the payment protection insurance (PPI) saga, which cost banks £50bn.
The Financing & Leasing Association, which represents car lenders, has been warning the government that a massive bill could end up disrupting the market, forcing some lenders to shut up shop, offer fewer loans or raise interest rates.
Concerns over the potential bill prompted a controversial intervention by the chancellor, Rachel Reeves. The Treasury wrote to judges in January, urging them to avoid handing 'windfall' compensation to borrowers, and warning that the case could 'cause considerable economic harm'.
Reeves later denied caving in to lobbying by the financial sector or working against consumer interests.
While her intervention was ultimately rejected, executives from the wider financial sector – including JP Morgan's Chase UK and the retirement fund provider Phoenix – have said that the scandal has dampened foreign appetite for British shares.
Executives argued that the situation could scare off investors wary of putting money into UK businesses that could face billions in costs on the basis of a ruling by a regulator or court in future. That could compound existing panic about the future of the London stock market, they claim.
The Treasury seems to have already heard the message, warning in its letter that the case might 'generate a perception that regulation in the UK is uncertain'.
That has put further pressure on the FCA to provide extra guidance to lenders. It plans to confirm within six weeks of the supreme court's decision if it will be proposing a customer compensation scheme and, if so, how it will take this forward.
If the scheme floated by the FCA goes ahead, lenders are likely to have to proactively contact all borrowers who meet the mis-selling criteria and offer compensation – dealing a blow to claims management firms.
As it stands, lenders are already steeling themselves for the fallout.
Close Brothers, which is the most exposed to motor finance among its peers, with about 20% of its portfolio dedicated to car loans, has put aside £165m, cancelled dividends and plans to sell off its asset management business to strengthen its finances.
Lloyds, the largest provider of motor loans through its Black Horse division, had already put aside a total of £1.2bn for potential compensation, with its latest provision contributing to a 20% drop in annual profits.
Santander UK has allocated £295m, prompting frustration at the top of the Spanish-owned bank, which is said to be considering a potential sale of its retail business.
With memories of PPI – Britain's costliest ever consumer scandal – still fresh for many banking executives, events at the supreme court will be closely watched.

More than half of the brand's Sussex headquarters have been knocked down by contractors. Earlier this year, plans were submitted to the local council to demolish and replace the building. This came after The Body Shop announced in October 2024 that it was relocating its headquarters. The headquarters for the high street brand is now located in the Plus X Innovation Hub near the University of Brighton. This news came just weeks after The Body Shop was saved from administration in September 2024. According to The Argus, two of sculptures were stolen from the site during the demolition. The outlet reported on the alleged theft after resident Body Shop sculptor Giles Penny spoke out about his artwork going missing. He shared his hope that the remaining art at the site can be revitalised and reused for a tribute to The Body Shop founder Anita Roddick. The Body Shop has deep roots in Brighton and Sussex before expanding globally since its first store opened in Kensington Gardens in 1976. RETAILERS have been feeling the squeeze since the pandemic, while shoppers are cutting back on spending due to the soaring cost of living crisis. High energy costs and a move to shopping online after the pandemic are also taking a toll, and many high street shops have struggled to keep going. However, additional costs have added further pain to an already struggling sector. The British Retail Consortium has predicted that the Treasury's hike to employer NICs from April will cost the retail sector £2.3billion. At the same time, the minimum wage will rise to £12.21 an hour from April, and the minimum wage for people aged 18-20 will rise to £10 an hour, an increase of £1.40. The Centre for Retail Research (CRR) has also warned that around 17,350 retail sites are expected to shut down this year. It comes on the back of a tough 2024 when 13,000 shops closed their doors for good, already a 28% increase on the previous year. Professor Joshua Bamfield, director of the CRR said: "The results for 2024 show that although the outcomes for store closures overall were not as poor as in either 2020 or 2022, they are still disconcerting, with worse set to come in 2025." It comes after almost 170,000 retail workers lost their jobs in 2024. End-of-year figures compiled by the Centre for Retail Research showed the number of job losses spiked amid the collapse of major chains such as Homebase and Ted Baker. It said its latest analysis showed that a total of 169,395 retail jobs were lost in the 2024 calendar year to date. This was up 49,990 – an increase of 41.9% – compared with 2023. It is the highest annual reading since more than 200,000 jobs were lost in 2020 in the aftermath of the COVID-19 pandemic, which forced retailers to shut their stores during lockdowns. The centre said 38 major retailers went into administration in 2024, including household names such as Lloyds Pharmacy, Homebase, The Body Shop, Carpetright and Ted Baker. Around a third of all retail job losses in 2024, 33% or 55,914 in total, resulted from administrations. Experts have said small high street shops could face a particularly challenging 2025 because of Budget tax and wage changes. Professor Bamfield has warned of a bleak outlook for 2025, predicting that as many as 202,000 jobs could be lost in the sector. "By increasing both the costs of running stores and the costs on each consumer's household it is highly likely that we will see retail job losses eclipse the height of the pandemic in 2020." The Tories have demanded the Office for Budget Responsibility steps in to scrutinise Labour's spending plans amid claims the 'fantasy sums' don't add up. Conservative MP Gareth Davies, the shadow financial secretary to the Treasury, called for the watchdog to assess Chancellor Rachel Reeves ' proposals. Ms Reeves used her Spending Review on Wednesday to set out plans to 'invest' a staggering £4trillion to fund 'the renewal of Britain' over the coming years. The Chancellor outlined day-to-day spending across Government for the next three years, as well as plans for capital investment over the next four years. She repeatedly said the cost of her Spending Review was covered by the tax rises she brought in last year, telling Whitehall departments to now 'live within their means'. But Ms Reeves also failed to rule out hammering households with further tax hikes at her autumn budget amid deepening economic gloom. Experts have warned a weakening economy and extra spending pledges - such Labour's U-turn on winter fuel payments - mean taxes are likely to go up again. The Institute for Fiscal Studies delivered a withering assessment of the Chancellor's spending plans and warned that tax rises look 'almost inevitable'. Despite Labour's splurge, he also cautioned that schools spending looked extremely 'tight' as special needs provision demand grows. The IFS's post-mortem also ridiculed the Government's claim to have identified billions of pounds in 'efficiencies' during a 'zero-based' overhaul of costs. Mr Johnson pointed out that all departments had been pencilled in for exactly the same percentages of back-office cuts, suggesting it was not a 'serious' exercise. In his call for the OBR to carry out an assessment of Ms Reeves' plans, Mr Davies noted how the Chancellor had previously vowed never to sideline the watchdog. In July last year, Ms Reeves announced new laws giving the OBR the power to make an independent assessment of any single major tax and spending announcement. The Tory shadow minister said: 'This is the first time in the OBR's history that it has not provided a report alongside a Spending Review. 'This means Labour's Spending Review is founded on billions of pounds worth of speculative savings which have not been subject to independent OBR scrutiny. 'The supposed savings dwarf the Chancellor's headroom, so taxpayers are on the hook if they fail to materialise - as they always do with Labour. 'Given that Rachel Reeves promised to never make a significant fiscal announcement without an OBR report, this is yet another U-turn from a Government which has lost its grip. 'Labour has lost control of the economy, and families are tightening their belts as a result. 'Rachel Reeves' fantasy sums will be paid for in billions more borrowing and even more tax rises. She announced the investment in her first spending review statement to Parliament after the long-delayed scheme. Speaking in the House of Commons Reeves said: 'I have heard representations from my honourable friends from Milton Keynes North, Milton Keynes Central and Buckingham and Bletchley. "And I can tell the House today to connect Oxford and Cambridge and to back Milton Keynes' leading tech sector I am providing a further £2.5 billion for the continued delivery of East West Rail.' The funding is part of a broad vision to develop the Oxford-Cambridge Growth Corridor. A government policy paper released alongside the Chancellor's speech described a 'renewed focus' on driving growth in the area. It also confirmed that EWR remains central to that ambition, supporting not only economic development but also enabling large-scale housing growth reports East Anglia ByLines. What is the East West Rail First conceived more than 20 years ago, the EWR project aims to establish a direct rail link between Oxford and Cambridge. The full scheme is expected to cost at least £5 billion and includes both upgrades to existing infrastructure and construction of new lines. The project is divided into four key segments: Upgrading the rail between Oxford and Bicester (completed in 2016). Restoring a disused line between Bicester and Bletchley (opening later this year). Refurbishing the existing route from Bletchley to Bedford (to be completed by 2030). Building a brand new stretch of railway from Bedford to Cambridge (still in planning stage). The line, once completed, will make it possible to travel from Oxford or Cambridge to most of the north of England without having to go through London. 'This includes delivery of a fully decarbonised passenger and freight railway at the next stage of development, with supporting investment in electrification infrastructure and high-quality new trains, including for use between Oxford and Milton Keynes.' Calum Miller, MP for Bicester and Woodstock, also supported the plans and said: 'I welcome the Government's confirmation in the Spending Review of the £2.5 billion for the next phase of the East West Rail project. 'It's crucial that East West Rail deliver the funding to keep London Road open and I will continue pressing the company and Rail Ministers to commit to an underpass for all modes of light transport.' Other announcements made in the spending review included a further £3.5 billion towards improving the TransPennine rail route that links York, Leeds and Manchester.
