Chhattisgarh HC acquits 2 in electrocution case citing lack of evidence and victim negligence

RAIPUR: The
high court acquitted two men convicted in an electrocution case, citing lack of evidence and the deceased's own negligence.
The court overturned the lower court's verdict, which sentenced the men to six months' rigorous imprisonment in the two-decade-old case.

"The death of the deceased was wholly of his own negligent act.
The deceased was not trained in electrical work but skilled in mechanical tasks. Despite this, he climbed the electric pole to connect a wire, indicating his own negligence. Being an adult and sensible person, he was expected to understand the risks involved in handling electricity. If he chose to proceed despite the dangers, he alone is responsible for the consequences," Justice Radhakishan Agrawal remarked in his order.
The case stemmed from an incident on May 4, 2004, where
died after being electrocuted while connecting a thresher machine to an electric pole at Sitapur in Surguja district. The prosecution alleged that the accused,
and
, asked Shahjahan to connect the wire, assuring him the power was disconnected.
The trial court and the appellate court convicted the men under Section 304-A of the Indian Penal Code (IPC), which deals with causing death by negligence.
However, Justice Agrawal, in his order, noted that the prosecution failed to establish a direct link between the accused's actions and the deceased's death.
The court observed that key witnesses, including Mansoor Khan, the deceased's brother, admitted in their statements that they did not witness the incident. Mansoor also acknowledged that his brother was not an electrician but a mechanical worker. The court further noted that the deceased was an adult and aware of the dangers of working with electricity.

"The prosecution has utterly failed to prove its case beyond reasonable doubt that the deceased died because of the act of the accused persons/applicants," the court said.
The court also pointed out inconsistencies in the witnesses' statements, including the omission of Shamim Khan's name in the initial police report. The judge cited Supreme Court rulings, emphasising the need for a direct nexus between the accused's negligence and the victim's death.
The high court allowed the criminal revision and acquitted Shabbir Khan and Shamim Khan. Their bail bonds will remain in effect for six months, as per legal procedure.

Last Updated: The court confirmed that such conduct destroyed the sanctity of the marital relationship, making cohabitation untenable The Orissa High Court has upheld a divorce granted to a physically disabled man after it was proven that his wife had mocked his disability, terming such conduct as mental cruelty under the Hindu Marriage Act. The bench of Justices BP Routray and Chittaranjan Dash, while dismissing the wife's appeal, observed that her repeated insults toward the husband's physical infirmity, including calling him names like 'Kempa" (cripple) and 'Nikhatu" (useless), clearly amounted to mental cruelty, warranting dissolution of the marriage under Section 13(1)(i-a) of the Act. The marriage between the parties was solemnised on June 1, 2016. According to the husband's testimony, the wife left the matrimonial home merely three months later on September 15, 2016, returned briefly in January 2017, but ultimately left for good on March 25, 2018. She later filed a criminal case under Section 498-A IPC and other provisions, accusing the husband and his family of cruelty. The husband filed a divorce petition on April 3, 2019, on the ground of mental cruelty. He examined two witnesses to support his claims. Despite cross-examining them, the wife neither examined any witnesses nor produced any evidence to counter the allegations. The family court in Puri, in its judgment dated July 10, 2023, ruled in favour of the husband, granting a decree of divorce without awarding permanent alimony. The wife challenged this order before the high court. Dismissing the appeal, the high court said that the evidence on record clearly showed the wife's demeaning behaviour toward her husband's disability. 'Such behaviour by the wife…definitely in our opinion amounts to mental cruelty," the court observed. It emphasised that in a marital relationship, mutual respect is essential, and ridiculing a spouse's physical shortcomings can gravely impact their dignity and emotional well-being. The court cited key precedents, including V Bhagat v. D Bhagat and Samar Ghosh v. Jaya Ghosh, to explain the evolving contours of 'mental cruelty" in matrimonial law. It reiterated that conduct which causes deep mental pain, making it unreasonable to expect the spouses to live together, can be sufficient ground for divorce. 'A person is expected to give respect to another person in general and where it comes to relationship of husband and wife, it is expected that the wife should support the husband despite his physical infirmity, if any," court said. On the issue of permanent alimony and return of Streedhan, the court noted that no material was presented on the income or assets of either party, and thus left the matter open for the wife to pursue separately under Sections 25 and 27 of the Hindu Marriage Act before the family court. In a major set back to the police and the State government, the High Court of Karnataka on June 12 ordered the release of four representatives of Royal Challengers Sports Private Limited (RCSPL) and DNA Networks Pvt. Ltd., who were arrested on the wee hours of June 6 in connection with the June 4 stampede outside M. Chinnaswamy stadium in Bengaluru during the celebration of RCB's victory in IPL-2025 tournment. Justice S.R. Krishna Kumar passed the order while allowing the petitions filed by Nikhil Sosale, Head (Marketing and Revenue), RCSPL; Sunil Mathew, Director, and Kiran Kumar, Event Manager of DNA; and Shamant N.P. Mavinakere, a freelancer service provider for DNA. RCSPL is the owner of RCB cricket team and DNA is the event management firm for RCSPL. The Court has ordered their release on bail by imposing conditions. Copy of the order is yet to be released. 'Arrested on CM's orders' It was argued on behalf of the petitioners that they were arrested based solely on 'the orders of the Chief Minister [Siddaramaiah] to arrest the officials of RCB and others' and without conducting any investigation and collecting any material to point out that the petitioners were responsible for the stampede, which resulted in the death of 11 persons. They had also contended that they were arrested by the police, who had no jurisdiction either to investigate the cases registered in connection with the stampede or to arrest them. Meanwhile, the State government had defended their arrest claiming that the police adhered to all the procedures laid down in law and by the apex court while arresting the accused persons in a criminal case. However, the Government, either in its written statement or arguments, did not say anything on the court's query whether Chief Minister had stated at a media conference that he had ordered the arrest of officials of the RCB and others. The government, in its written statement, had merely stated that the contention of the petitioners, that their arrest was made solely on the Chief Minister's order, was not relevant for deciding the legality of their arrest.

Three minor girls who were invited to celebrate a birthday were allegedly sexually assaulted in North Goa's Bambolim, leading to the arrest of two men. The accused, identified as Altaf Mahboob Mujawar (19) and Om Vinay Naik (21), were taken into custody by the Agashi families of the victims filed a missing complaint on the night of June 8, saying that two girls, aged 13 and 15, had been missing since June 7. Around the same time, another complaint was lodged regarding the disappearance of a 11-year-old girl. Investigations revealed that all three girls had gone North Goa Superintendent of Police Rahul Gupta allegedly tried to keep the matter under wraps. However, once the news began surfacing in the media, he formed a special police team to trace the missing girls. Following the formation of the special team, the victims were traced to a hotel in the Calangute area. Police rescued the girls and detained two men present with them. During the investigation, the girls informed the police that they had gone to Calangute to celebrate a birthday. It was then discovered that the 15-year-old and the 11-year-old were sexually registered two separate cases under IPC Sections 137(2), 64(1), 74, 75(1), Section 8(2) of the Goa Children's Act, and Sections 4, 8, and 12 of the POCSO Act. The two men detained earlier were formally Wednesday night, the police also arrested the owner of the hotel where the incident occurred. Rajat Chavan, owner of Krishna Mahadev Hotel in Baga, was arrested by Calangute police for allowing the girls to enter the hotel without parental strict action, Rahul Gupta, Superintendent of Police, said, 'The police are applying for the sealing of the hotel and the cancellation of its license.' He added, 'If any man is given a room without the presence of their family members or relatives, hotel management and owners will not be spared. It is a violation of the Goa Children's Act.'
