HC orders ban on pressure horns, flag rods & extra lights on vehicles

Ranchi: The Jharkhand high court has ordered the govt to ensure that vehicles fitted with pressure horns, multi-tone horns, flag rods, and extra lights do not ply within the state.
Imposing a complete ban on the use of pressure horns and flag rods, a division bench in its order stated that pressure horns and multi-tone horns fitted in vehicles will not be allowed to run in the state. Similarly, vehicles fitted with extra lights, particularly those which are red and blue in colour and give a semblance of emergency vehicles, should be removed immediately, it added.
The bench also ordered the administration to ensure that unauthorised use of flag rods and flags, irrespective of their affiliation to political parties and religious denominations, be removed forthwith.
The court ordered that provisions of the Flag Code have to be duly followed and the statute of Central Motor Vehicle Rules and Noise Pollution Regulation and Control Rules be followed in letter and spirit. The court also banned the use of loudspeakers without permission from 10 pm till 6 am.
A division bench of Chief Justice Tarlok Singh Chauhan and Justice Sujit Narayan Prasad, while hearing a public interest litigation on July 28, ordered the director general of police Anurag Gupta and Jharkhand state pollution control board member secretary to file individual affidavits to confirm compliance with the direction of the court regarding the implementation of the court's direction.

The court was hearing a PIL filed by one Khushi Lal Mahto on the bad condition of roads at Basantpur village in Ramgarh. The road in the village goes up to a coal washery run by the Central Coalfield Limited. The petitioner said that heavy trucks operate in the area carrying coal to the washery, due to which the roads are damaged.
The trucks carry coal without any cover, which further causes coal dust to fly, causing severe pollution in the area. The court ordered the immediate repair of the road by the authorities and to ensure that the trucks carrying coal be covered with tarpaulin. Further, the court ordered Ramgarh SP Ajay Kumar to ensure that the trucks do not cause any noise pollution by using pressure horns.
