Blake Lively drops ‘emotional distress' claim in lawsuit against Justin Baldoni

7NEWS3 days ago

Celebrity lawyer Christopher Melcher has said Blake Lively has 'gutted,' her lawsuit against It Ends With Us co-star Justin Baldoni, after she dropped the 'emotional distress' component of the legal action.
Lively claims she was sexually harassed by Baldoni and producer Jamey Heath on the set of the film before being subjected to a smear campaign. Baldoni has always denied these claims.
Baldoni launched a defamation lawsuit for $US400 million ($619 million) against Lively and husband Ryan Reynolds, claiming she attempted to extort him and defame him.
Lively withdrew her claims against Justin Baldoni after his lawyers requested the actress sign a HIPAA (Health Insurance Portability and Accountability Act) release, forcing her to disclose therapy notes on her mental health.
On Wednesday, Melcher said the claims were central to Lively's overall claim.
'Blake has withdrawn her emotional distress claims because Justin wanted access to her therapy records to see if she was really that distraught, as she claimed in her lawsuit,' Melcher told Natalie Barr and Matt Shirvington on Sunrise.
'So, she clearly placed that at issue, made it fair game, he wanted to see the records. In response, she dropped the claim.'
Melcher was pressed on what it would do to her claim.
'It's really gutting it because that was one of the hallmarks to it,' Melcher replied.
'She was saying that all these things that allegedly happened to her made her extremely distraught, and, sure, she wants to keep that stuff private, but she can't also sue for damages in court while doing so.
'So, she had to make that difficult choice. Now, that it's dropped, there's other parts of her claim, but really the centrepiece of it was the embarrassment and humiliation and distress that she claims she suffered.'
Melcher explained Lively was probably advised this would happen by her lawyers.
'This is something us as lawyers talk to the client about (before the case),' she said.
'Any kind of litigation, (we ask) do you really want to go through this? This is very difficult for anyone to do. You put yourself out there in public court. So, it is surprising that she's just realising this now.'
Despite the controversy, the 2024 domestic violence drama, which became a box-office hit, earned $351 million at the box office worldwide from a budget of $25 million.
According to Variety, Lively is attempting to withdraw without prejudice, which Baldoni's lawyers have argued against.
A withdrawal without prejudice would mean Lively could refile the claims at a later date.
Melcher gave his legal opinion.
'I think that it's very easy to type up a complaint and file it in court, but it is difficult to establish it,' he said.
'She came out as the victim and a lot of people supported her at the beginning, but then the information that we're seeing is that she might have actually been the bully in this story.
'(But) of course, only a jury will tell.'

Mia Goth joins cast of Star Wars: Starfighter

Mia Goth has joined the cast of Star Wars: Starfighter. The 31-year-old actress will reportedly join Ryan Gosling in the upcoming sci-fi movie- which is to be directed by Shawn Levy and is in development at Lucasfilms - and will begin shooting later this year before a May 2027 release, according to Deadline. Little is known about Goth's role in the film - which will act as a standalone movie within the space opera franchise - but it will be set five years after 2019's The Rise of Skywalker, with the director recently revealing it's a whole "new adventure" for fans. As quoted by Deadline, Levy, 56, said: 'There are many rumours, some true, some not. … This is not a prequel, this is not a sequel. It's a new adventure.' Gosling, 44, gushed: 'There is not a more perfect filmmaker for this particular story than Shawn." The script comes from Jonathan Tropper, who has spent the past two years working on it. The official details follow a report that Mikey Madison allegedly turned down a role in the film. The 'Anora' actress - who was named Best Actress at this year's Academy Awards - was offered a role in the flick but passed on the part, according to Variety. Levy has been working on the movie with Lucasfilm since 2022. Character and plot details remain unknown but last year, Levy said he is not planning to connect his work to any other films or TV shows in the long-running series. Speaking on the 'Happy Sad Confused' podcast, he said: "I'll say that the experience of crafting this story has forced me to think about that question. Because there's only so many times that 'Star Wars' movies can revisit the same section of the timeline, and so it's really forced me, because I don't want to do a 'Star Wars' movie that is redundant to others, nor am I interested in doing one that has to serve another movie." The filmmaker - who has teamed up with his The Adam Project co-writer Tropper on the project - added he was making the flick with "tone and characters" at the forefront. He said: "I really wanted to craft something that felt organic to me, both in tone and characters, so I think that there is certainly the Force and a connection to something bigger than our individual selves. "And the way that that can make us powerful, those themes, combined with visual delight and wish fulfilment, that's Star Wars to me."

Blake Lively praises mom for influence and support

Blake Lively has praised her mom for being a huge influence on her life. The Another Simple Favor actress has expressed her gratitude to Willie Elaine McAlpin for always finding the time to "do creative things" with her throughout her life and always believing in her endeavours. Blake shared a photo of herself smiling with a huge bouquet of flowers and wrote on her Instagram Story: 'Grateful to my mama for always doing creative things with me. "Even when she was working nonstop and had zero time. She always told me I 'couldn't mess it up,' when I very much could. 'What a lifelong gift that creative empowerment and trust has been. Most of my passions come from, or thanks to, her.' Blake - who has four children with husband Ryan Reynolds - had carefully arranged the bouquet herself from flowers she'd grown. She also shared a close-up picture of the flowers and wrote: 'My flower babies, from seeds to cutting, to arrangement. @me for your next graduation funeral or wedding.(sic)" This isn't the first time Blake has honoured her mother recently. While attending the TIME 100 Gala event in New York City, at which she was honoured as one of the publication's most influential people, the 37-year-old star took the time to praise her mom. Alluding to her legal battle with It Ends with Us co-star Justin Baldoni, she said it was "surreal and deeply significant" to be honoured during "a time where the most valuable currency seems to be anger, it feels like an act of defiance to commune and celebrate all the good that is alive in the world." She added: "I have so much to say about the last two years of my life, but tonight is not the forum." Instead, she said she wanted to discuss "the feeling of being a woman who has a voice today." She added: "My mom never got justice from her work acquaintance who attempted to take her life when she was the mother of three young kids years before I was born." Blake said her mom credited a woman who she'd heard on the radio speaking about a "similar circumstance" for offering her hope. She continued: "The woman painfully and graphically shared how she escaped. And because of hearing that woman speak about her experience instead of shutting down in fear and unfair shame, my mom is alive today. She was saved by a woman whose name she'll never know." The former Gossip Girl star ended her speech with a thank you to "every man, including my sweet husband, who are kind and good when no one is watching."

Seth Rogen calls directing Martin Scorsese the 'worst thing in the world'

Seth Rogen has admitted directing Martin Scorsese in The Studio was the "worst thing in the world". The actor stars in and directs the Apple TV Plus series in which he plays the head of a movie studio and it's featured cameos from industry titans including Goodfellas director Scorsese, Ron Howard, Anthony Mackie, Zoe Kravitz, Olivia Wilde and Zac Efron - and Rogen has now admitted he was "nervous" working with big name stars on his project. In an interview with Jason Segel for Variety, Rogen explained: " I'd say half of them [the cameos] were people I didn't know at all. We wanted people you haven't seen us with before. "Martin Scorsese, we just sent it to his manager. I'd met Zoe Kravitz once or twice. I met a lot of these people in passing. I'm sure you have at a party." When asked if he was "intimidated" to direct people like Scorsese, Rogen replied: "It was the worst thing in the whole world. We were shooting the show in such a specific way that I was so nervous it would be creatively rejected. " In the show, his character Matt Remick is often desperate for directors and actors to like him and worries about making them angry - and Rogen admits he's a lot like Matt in many ways. He added: "The character is me in many, many ways. And the crux of the character is that he doesn't want to let down his idols. "And that's one of the biggest things that I'm navigating: Whenever I get anyone to come do a thing we're doing, I'm so aware of how upset I'll be if they think it's bad. " Segel went on to add of Scorsese: "I did meet Martin Scorsese once. I met him at the Golden Globes, and we peed next to each other at the urinals. But I had the kids' one and he had the tall one. So everything about it was just way off. That's a great memory." Rogen the added: "He's a little guy." Rogen previously admitted he's had plenty of pushback from industry pals after he used their real life experiences as inspiration for The Studio. He told Vanity Fair magazine: "I think more [often] people have not wanted to accept that we have based things off of them, rather than claiming that we have based things off of them. "If anything, people are like: 'That's not me though.' But I think in general they really see that it comes from a place of love."
