Sens. Mike Lee, John Curtis and Rep. Mike Kennedy introduce a bill to block ‘Wall Street' control of Utah public lands
Utah Sens. Mike Lee and John Curtis were joined by Utah Rep. Mike Kennedy in sponsoring the Natural Asset Company Prohibition Act, Tuesday.
If passed, the act would prohibit any Natural Asset Company or similar organization from 'making agreements affecting land, water or natural resources in Utah.'
NACs, structured as corporate entities, 'assign financial value to ecosystem services like carbon sequestration, water purification, biodiversity preservation, and soil health,' a press release from the lawmakers said.
Bill sponsor Curtis said, 'Wall Street shouldn't be allowed to dictate what happens on Utah lands just to satisfy ESG mandates.'
Public land, he continued, supports ranchers, energy production, conservation, families and more, and the bill 'ensures that investors from New York or foreign capitals don't get to lock up Utah lands and cut off access to the people who depend on them.'
The Intrinsic Exchange Group and the New York Stock Exchange jointly proposed NACs in September, 2021, to act as an investment vehicle by tapping into the Green industry.
Companies could buy the rights to natural assets, including on public lands, and then try to attract private investment that would keep the land as-is.
The Land Trust Alliance, an environmental group, describes these sort of natural assets as 'carbon credits, biodiversity credits, water or soil conservation, forest preservation and associated sustainable economic activities such as eco-tourism.' Excluded from natural assets are 'mining, unsustainable agriculture and timber harvest that erodes important environmental qualities.'
However, after being met by significant opposition, the New York Stock Exchange withdrew its application to the Securities Exchange Commission in January 2024 to establish NACs as a viable trading asset.
NACs can pose a threat to economies that heavily rely on agriculture, energy and timber, since they can restrict the productive uses of the land for the sake of eco-preservation, the sponsors of the bill said.
Lee, as chairman of the Senate Energy and Natural Resources Committee, said NACs 'pose a direct threat' to Utah's energy, agriculture and recreation industries by 'enabling private and foreign investors to seize control of the very land that our communities depend on.'
Similarly, Kennedy said NACs 'threaten Utah's rural economy by allowing private interests to lock away farmland and natural resources.'
Kennedy currently serves on the House Natural Resources Committee. He said the legislation 'will help to protect Utah's land, economy, and rural communities from such overreach.'

(TELUS Digital) in respect of a proposed transaction pursuant to which TELUS would, directly or indirectly through one of its subsidiaries, acquire all of the issued and outstanding subordinate voting shares and multiple voting shares of TELUS Digital not already owned directly or indirectly by TELUS for a price per share of US$ 3.40 to be paid in cash, TELUS common shares or a combination of both. TELUS has asked the TELUS Digital board of directors to begin a process to review the IOI and appoint a special committee of independent directors to evaluate the proposal. "Our proposal to fully acquire TELUS Digital reflects our belief that closer operational proximity between TELUS and TELUS Digital will enable enhanced AI capabilities and SaaS transformation across all lines of our business, including telecommunications, TELUS Health and TELUS Agriculture & Consumer Goods, driving positive outcomes for the customers we serve," said Darren Entwistle, President and CEO of TELUS. Notably, we believe this proposed transaction will yield meaningful benefits for TELUS Digital and importantly, for our customers and investors." Any financing undertaken in the near term will be designed with a view to being neutral to TELUS' balance sheet net debt to EBITDA leverage ratio, as TELUS maintains focus on deleveraging priorities. The IOI is a non-binding indication of interest and is subject to, among other matters, confirmatory due diligence satisfactory to TELUS, agreement on transaction structure, the negotiation and execution of mutually acceptable definitive transaction documents, and the approval of the proposed acquisition by the TELUS Digital board of directors. Further, the consummation of the proposed acquisition, even if definitive transaction documents are entered into, would be subject to customary closing conditions for transactions of this nature, including, among others, the receipt of shareholder approvals required under applicable securities laws, including Multilateral Instrument 61-101 – Protection of Minority Security Holders in Special Transactions, and court approval. Barclays is acting as exclusive financial advisor to TELUS, and Stikeman Elliott LLP and A&O Shearman are acting as legal advisors. TELUS and its advisors stand ready to work with the TELUS Digital board of directors to agree the terms of, and implement, the proposed acquisition. RFK Jr. Picks Former Joe Rogan Guest to Advise on Vaccine Safety
One of the eight new members appointed by Health Secretary Robert F. Kennedy Jr. to sit on a vaccine advisory panel found national fame with a controversial appearance on The Joe Rogan Experience. In an X post on Wednesday, Kennedy announced that he had appointed eight new doctors and researchers to the Advisory Committee on Immunization Practices (ACIP). The expert panel guides the Centers for Disease Control and Prevention (CDC), as well as the Department of Health and Human Services, to make the 'most appropriate selection of vaccines and related agents' to effectively manage vaccine-preventable diseases within the country, per the CDC. Earlier this week, Kennedy fired all 17 previous members of the panel and reinstated eight new ones—a decision he described as a 'major step toward restoring public trust in vaccines.' 'I'm now repopulating ACIP with the eight new members who will attend ACIP's scheduled June 25 meeting,' Kennedy continued. 'The slate includes highly credentialed scientists, leading public health experts, and some of America's most accomplished physicians. All of these individuals are committed to evidence-based medicine, gold-standard science, and common sense. They have each committed to demanding definitive safety and efficacy data before making any new vaccine recommendations.' One of the eight new members, Dr. Robert Malone, was previously the subject of intense scrutiny—and, in some circles, praise—for conspiracies he touted about the COVID-19 virus and vaccine in a 2021 episode of The Joe Rogan Experience. At the time, Dr. Malone argued that parts of the population had been 'hypnotized' by health professionals into believing that their reports and recommendations on COVID-19 were true. He also questioned the severity of the virus and drew comparisons between the COVID-19 vaccine and Nazi medical experiments, per The New York Times. Dr. Malone, who played an early role in mRNA research and claims to be the inventor of the technology, was criticized in an open letter from more than 250 healthcare professionals and researchers following the episode for 'broadcasting misinformation.' 'On Dec. 31, 2021, The Joe Rogan Experience (JRE), a Spotify-exclusive podcast, uploaded a highly controversial episode featuring guest Dr. Robert Malone (#1757),' the January 2022 open letter to Spotify read. 'The episode has been criticized for promoting baseless conspiracy theories and the JRE has a concerning history of broadcasting misinformation, particularly regarding the COVID-19 pandemic.' In a 2022 profile for The New York Times, Dr. Malone dismissed fact-checks of his claims as 'attacks' and maintained that he received pushback because anything that questions guidance from institutions like the CDC is quickly labeled as misinformation. Meanwhile, the seven other members Kennedy appointed include: Dr. Joseph R. Hibbeln, Dr. Martin Kulldorff (who criticized pandemic protocols in 2020), Dr. Retsef Levi, Dr. Cody Meissner, Dr. James Pagano, Dr. Vicky Pebsworth, and Dr. Michael A. Ross.
