‘False accusations can cause damage to reputation': Delhi AAP MLA Anil Jha acquitted of charges under SC/ST Act

A Delhi court on Saturday acquitted Aam Aadmi Party's (AAP) Kirari MLA Anil Jha in a case where he was charged under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (SC/ST Act).
Complainant, Sanjay Kumar, a BJP member, had alleged that on February 28, 2016, during an annual function at Awadh Public School in the capital, Jha, along with other accused people, had hurled casteist slurs directed towards him. He had also alleged that Jha had manhandled him.
Special Judge Jitendra Singh of Rouse Avenue Court, in his order dated May 31, said that the complainant has attempted to attribute a criminal colour to what was, 'in essence, a verbal altercation' between him and the accused due to their respective political affiliations and activities.
'It is not unusual in such circumstances for the incident to be exaggerated, with the apparent intention of falsely implicating the accused in a more serious offence, thereby attempting to invoke stringent provisions such as the SC/ST Act,' Judge Singh said.
'The IO (Investigating Officer) is expected to keep in mind that false accusations have far-reaching consequences, as they may result in the prosecution and conviction of innocent persons. The falsely accused person may suffer considerable societal stigma, damage to reputation and psychological harm, even when a determination ultimately occurs that the accuser accidentally or deliberately made a false accusation,' said the judge.
He also stated that the Investigating Officer failed to produce a copy of CD containing the video clip of the alleged incident despite multiple opportunities. '…the most clinching evidence at the hand of the investigating agency was the video clip of the alleged incident…The CD containing the video clip was filed along with the charge sheet. However, the said CD could not be played in the Court… This Court never had the opportunity to go through the video clip,' Judge Singh noted.
To prove its case, the prosecution, which was represented in the court by Additional Public Prosecutor Manish Rawat, had primarily examined three witnesses. The court, however, rejected their testimonies and held that the testimonies did 'not lend credence to the case of the prosecution'.

A senior ministry official said that e-Aadhaar authentication will be the new step, while a provision to authenticate an IRCTC account with Aadhaar to book 24 tickets a month already exists. 'Account holders who link their accounts with Aadhaar will get priority booking during the first 10 minutes of Tatkal ticket sales. Even authorized IRCTC agents are not allowed to book within the first 10 minutes,' the official said. The official said the proposal for e-Aadhaar authentication is part of the campaign against the use of automated tools to book tickets online. New Delhi: In a push toward future-ready education, Delhi cabinet under chief minister Rekha Gupta has approved the New Era of Entrepreneurial Ecosystem & Vision (NEEEV) programme for nurturing entrepreneurial thinking and self-reliance among school students. This initiative is designed to equip students with financial literacy, digital skills and a startup mindset. Senior officials said that govt is likely to launch NEEEV, replacing the AAP's flagship Business Blasters and Happiness Curriculum. Under NEEEV, a fund of Rs 20,000 each will be provided to student groups to support entrepreneurial projects. "This scheme is designed for students from classes 8-12 and aims to promote entrepreneurship alongside financial and digital literacy, with a focus on experiential learning," he said. Alongside NEEEV, the cabinet has passed a series of educational initiatives, including 75 CM Shri Schools. The digitisation of 125 school libraries will provide students with seamless access to knowledge and digital resources. CM Gupta has also given the go-ahead to 100 APJ Abdul Kalam Language Labs, which have been sanctioned to boost communication skills and language proficiency across govt schools. DEFENCE MINISTER Rajnath Singh Wednesday held a bilateral meeting with his Australian counterpart Richard Marles, in which both sides agreed to work together to combat terrorism in all forms and agreed to intensify and diversify defence industry collaboration under the Australia-India Joint Research Project. Marles is on a two-day official visit to India. The visit marks his first to India after his re-appointment as Australia's Deputy Prime Minister and Minister of Defence. In a statement, the Defence Ministry said that both Ministers strongly condemned the terror attack in Pahalgam and expressed deepest condolences to the families of the victims. It said Singh highlighted India's right to respond in self-defence against cross-border terrorism and described New Delhi's actions against Pakistan as measured, non-escalatory, proportionate and responsible. The Indian Express also learnt that Singh alerted Marles against any possible engagement with the Pakistan military in the backdrop of its growing defence ties with China and the latter accessing key technologies. Sources said the Khalistan issue was also raised in the bilateral meeting in the context of incidents of violence in Australia perpetrated by extremists. The defence ministry statement noted that they had deliberated on furthering defence science and technology collaboration projects when they meet in Australia later this year for the third India-Australia 2+2 ministerial meeting. 'They also reviewed the progress made since the last 2+2 Ministerial Dialogue held in November 2023, it stated. The meeting offered an opportunity to both sides to review the status of bilateral engagements in the context of emerging regional and global scenarios. 'The discussions covered a wide range of issues such as defence strategic cooperation and security, including industry collaboration, cyber and new emerging technologies, counter-terrorism, hydrography and maritime security,' it said, while adding that the two sides also exchanged views on regional and global security issues of mutual interest. Both sides expressed satisfaction and recognised that defence has emerged as an important pillar of the collaboration on the fifth anniversary of the signing of the India-Australia Comprehensive Strategic Partnership. 'Both countries expressed satisfaction at the growing strategic convergence between the two countries and agreed to work together towards a free and open Indian Ocean and Pacific Island region,' the statement said. India and Australia also called for the continued strengthening of bilateral defence cooperation and their commitment for achieving their shared objective of peace, prosperity, stability and progress in the Indo-Pacific region. Earlier, Marles laid a wreath at the National War Memorial and paid homage to the fallen heroes.
