Coimbatore man gets double life term, 16 years of RI for raping elderly Dalit woman in 2022
The Special Court for the trial of cases registered under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act in Coimbatore on Tuesday awarded 16 years of rigorous imprisonment (RI) and double life imprisonment to a 42-year-old man from Kinathukadavu in the district for raping an elderly Dalit woman in 2022. Judge K. Vivekananthan awarded the punishment to M. Velusamy, a daily wage labourer from a village near Kinathukadavu. Velusamy, who belongs to a dominant caste, was arrested for raping a 65-year-old Dalit woman from the village on June 26, 2022. He committed the crime when the woman went out in search of fodder for goats. As per the First Information Report (FIR), Velusamy also assaulted the woman when she resisted the rape attempt. While Velusamy escaped after the crime, the woman managed to walk to the nearest bus stop, where she fainted. After identifying the woman in unconscious state, a villager informed her grandson, who rushed her to the Primary Health Centre (PHC) at Kinathukadavu. Sensing the gravity of the crime and the health condition of the woman, the PHC authorities referred her to the District Headquarters Hospital in Pollachi. S. Amutha, the then inspector of the All Women Police Station (AWPS), Perur, reached the hospital after being alerted about the crime and recorded the woman's statement. The court found Velusamy guilty and awarded him seven years of rigorous imprisonment for offence under Section 325 (punishment for voluntarily causing grievous hurt) of the Indian Penal Code. He was awarded another seven years of RI for offences under Section 325 IPC read with 3 (2) (Va) of SC/ST) of SC/ST Act. He was sentenced to undergo two years of RI for 506 (i) (criminal intimidation). The court awarded life imprisonment to the accused for offence under Section 376 (1) of IPC and another life term for offence under Section 376 (1) read with 3(2) (v) of SC/ST Act. The convict was ordered to undergo the two life terms concurrently, after undergoing the 16 years of rigorous imprisonment for other offences consecutively. He was slapped with a total fine of ₹32,000.

‘False accusations can cause damage to reputation': Delhi AAP MLA Anil Jha acquitted of charges under SC/ST Act
A Delhi court on Saturday acquitted Aam Aadmi Party's (AAP) Kirari MLA Anil Jha in a case where he was charged under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (SC/ST Act). Complainant, Sanjay Kumar, a BJP member, had alleged that on February 28, 2016, during an annual function at Awadh Public School in the capital, Jha, along with other accused people, had hurled casteist slurs directed towards him. He had also alleged that Jha had manhandled him. Special Judge Jitendra Singh of Rouse Avenue Court, in his order dated May 31, said that the complainant has attempted to attribute a criminal colour to what was, 'in essence, a verbal altercation' between him and the accused due to their respective political affiliations and activities. 'It is not unusual in such circumstances for the incident to be exaggerated, with the apparent intention of falsely implicating the accused in a more serious offence, thereby attempting to invoke stringent provisions such as the SC/ST Act,' Judge Singh said. 'The IO (Investigating Officer) is expected to keep in mind that false accusations have far-reaching consequences, as they may result in the prosecution and conviction of innocent persons. The falsely accused person may suffer considerable societal stigma, damage to reputation and psychological harm, even when a determination ultimately occurs that the accuser accidentally or deliberately made a false accusation,' said the judge. He also stated that the Investigating Officer failed to produce a copy of CD containing the video clip of the alleged incident despite multiple opportunities. '…the most clinching evidence at the hand of the investigating agency was the video clip of the alleged incident…The CD containing the video clip was filed along with the charge sheet. However, the said CD could not be played in the Court… This Court never had the opportunity to go through the video clip,' Judge Singh noted. To prove its case, the prosecution, which was represented in the court by Additional Public Prosecutor Manish Rawat, had primarily examined three witnesses. The court, however, rejected their testimonies and held that the testimonies did 'not lend credence to the case of the prosecution'.

BJP MLC appears before police in Kalaburagi
BJP MLC N. Ravikumar appeared before the Assistant Commissioner of Police in Kalaburagi on Monday in connection with an FIR registered against him for his recent offensive remarks against Deputy Commissioner B. Fauzia Tarrannum. During the Kalaburagi Chalo rally in the city on May 24, Mr. Ravikumar made derogatory remarks against the IAS officer stating that 'she might have come from Pakistan' and his remarks created an outrage. Following his comments, an FIR was lodged at the Station Bazaar Police Station under various sections of the Bharatiya Nyaya Sanhita along with charges under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act based on a complaint filed by Kalaburagi Samudaya president Dattatraya Ikkalaki. On May 29, the High Court of Karnataka took suo motu cognisance and directed Mr. Ravikumar to tender an apology to Ms. Tarannum and also ordered him to appear before the Kalaburagi Police on Monday in connection with the case. However, Mr. Ravikumar who made himself available for investigation clarified that the remarks were unintentional and a slip of tongue. BJP leaders, including MLC Shashil G. Namoshi, the former district BJP president (rural unit) Shivaraj Patil Raddewadagi, and party workers accompanied Mr. Ravikumar to the Assistant Commissioner of Police's office. However, the police, who had set up barricades, stopped them from entering the police station.

Dalit family attacked during wedding ceremony in Ballia
Two individuals were injured when around a dozen people allegedly attacked a Dalit family and used caste-based slurs during a wedding ceremony at a marriage hall in Rasra town of Ballia, police said on Sunday. The incident occurred on Friday. The attackers objected to the wedding being held at the marriage hall, according to the complaint filed by Raghvendra Gautam, a resident of Mission Road in Rasra. Rasra police station in-charge Vipin Singh said an investigation is underway. The complainant alleged that over a dozen people barged into the marriage hall when his sister's wedding was taking place and attacked them with sticks, hurling caste-based words against them, according to the police. His cousin Ajay Kumar, 26, and another person suffered injuries in the attack, the complainant alleged. Based on the complaint, an FIR has been registered under relevant sections of the Bharatiya Nyaya Sanhita along with provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

‘Wedding in a hall?': Group attacks dalit family with sticks and rods for in UP
Representative photo NEW DELHI: A Dalit family was allegedly attacked by a group of around 20 men with sticks and rods during a wedding ceremony at Swayamvar Marriage Hall in Rasra, Uttar Pradesh on Friday night, leaving two people seriously injured, police said on Sunday. The attackers, led by Aman Sahni, Deepak Sahni, Rahul, and Akhilesh, stormed the wedding venue around 10:30 pm, according to the FIR filed by Raghvendra Gautam, the victim's brother. "Being from a Dalit community, how can you hold a wedding in a hall?" the attackers allegedly said before launching their assault. The group, which included 15-20 unidentified individuals from the Mallah Toli locality, hurled caste-based slurs and objected to the wedding being held at a marriage hall. Ajay Kumar and Manan Kant, relatives of the complainant Gautam, suffered serious injuries during the attack. Based on the complaint, police have registered a case under relevant sections of the BNS and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Rasra Police Station in-charge Vipin Singh said an investigation is underway. No arrests have been made so far in connection with the incident.
