
Vijay Diwas: Plan rolled out to give free legal help to soldiers, families
The scheme was officially launched on Saturday at Shri Kashmir Convocation Centre on the banks of Dal Lake in Srinagar.
Supreme Court judge and NALSA executive chairman Justice Surya Kant, who presided over the conference, stressed on the importance of ex-servicemen serving as nyay mitras (legal volunteers) and supporting fellow soldiers and their families. The scheme will operate through legal clinics. Ex-servicemen will address the legal challenges faced by defence families across the country.
The conference was attended by Union law minister Arjun Ram Meghwal, J&K lieutenant governor Manoj Sinha and CM Omar Abdullah.
Sinha said the impact of 'legislative reforms' initiated after the abrogation of Article 370 has transformed the region. 'Before 2019, various central laws including two important central legislations — Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, and Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 — were not applicable to J&K,' he said, adding these are now applicable and tribal community has been empowered.
The CM praised the contributions and sacrifices of defence personnel, many of whom hail from J&K, he said. Omar, who also holds law portfolio, stressed the urgent need for compassionate and timely legal redress to those serving in remote and challenging terrains.

SC prohibits construction and commercial use near historic Gumti structure in Defence Colony
New Delhi, Aug 4 (UNI) The Supreme Court has directed that the park adjacent to the historic Gumti structure located in Defence Colony, New Delhi, must not be used for any purpose other than public recreation and preservation. The Court made it clear that no construction of facilities like badminton or basketball courts, nor any form of commercial activity, will be permitted due to the sensitive nature and spatial constraints of the area. A Bench comprising Justice Sudhanshu Dhulia and Justice Ahsanuddin Amanullah was hearing a writ petition filed in 2019 seeking protection of the Gumti under the Ancient Monuments and Archaeological Sites and Remains Act, 1958. "The only direction which needs to be given here is that the park should not be used for any other purpose. No activities such as construction of a badminton or basketball court shall be undertaken, considering the limitations of the area itself," the Bench observed. It added, 'Needless to say, there shall be no commercial activity or kiosks/shops allowed in the vicinity.' The petition was filed after the Defence Colony Welfare Association (DCWA) allegedly carried out unauthorized alterations near the monument, despite its historical significance. Representing the petitioner was Senior Advocate Shikhil Shiv Suri. Senior Advocates Garima Prasad and Gopal Sankaranarayanan, along with Advocate Shubhranshu Padhi, represented the respondents, with Sankaranarayanan also serving as the Court Commissioner. The case has a long history. In 2004, the Central Government issued a gazette notification intending to declare the Gumti as a monument of national importance. However, this was met with objections from the DCWA, causing delays within the Archaeological Survey of India (ASI). After the Delhi High Court dismissed the petitioner's plea for protection under the 1958 Act, the matter was brought before the Supreme Court. In a significant development on July 16, 2025, the apex court criticized the Municipal Corporation of Delhi (MCD) for its actions, noting that they appeared to obstruct justice. The Court had then considered issuing contempt notice and directed the CBI to conduct a preliminary inquiry into the unauthorized occupation and modifications around the monument. The Court also instructed the MCD to demolish all unauthorised structures, clean the area, and hand it over to the Department of Archaeology. The Bench took note of ongoing efforts and pending tasks including, finalising and completing the Gumti's restoration plan. Publishing the official notification declaring it a protected monument. Clearing remaining debris and leveling the park area and finalizing the landscape plan with permissible public activities like cycling and walking. The Bench emphasized that the park, which consists of four quadrants, should be maintained and beautified for the benefit of the general public while preserving its natural character. SC sets ball rolling for B'luru civic polls; orders delimitation by Nov 1
New Delhi/Bengaluru: (SC) on Monday issued the go-ahead for polls to the five newly-created municipal corporations in Bengaluru — in place of Bruhat Bengaluru Mahanagara Palike (BBMP) — to ensure better civic amenities in the metropolis. BBMP has been divided into five smaller corporations -- Bengaluru North, West, South, East and Central. A bench of Justices Surya Kant and Joymalya Bagchi ruled that when the population has been estimated by the state to have increased from 84 lakh in 2011 to 144 lakh in 2025, there is a need for carrying out delimitation exercise, based on which, the State Election Commission (SEC) can finalise the electoral rolls. Appearing for the state, senior advocate A M Singhvi and state advocate general Shashi Kiran Shetty said the delimitation process would be carried out between Sept 3 and Nov 1, when the final notification on ward delimitation will be published. They said final notification on ward reservation will be published on Nov 30. The SEC, through senior advocate K N Phanindra, had told the court that EC could not hold elections to the five new municipal corporations in Bengaluru unless the state notified the 'Conduct of Election Rules'. Responding to it, Shetty told the court that the state would notify the relevant rules within a week. The SC told SEC to proceed with finalisation of the voters' list for the civic bodies immediately after finalisation of the delimitation process and to complete the process in 60-90 days. The court has posted further hearing on Nov 3. SEC said in its affidavit it would require "60 to 90 days after issuance of final notification of delimitation by the state govt for preparation and finalising electoral rolls/voters' list for the five newly-constituted city corporations". Gujarat HC grants relief to news anchor accused in defamation, atrocities case after complaint by senior Congress leader
The Gujarat High Court on Monday granted relief to an Ahmedabad-based news anchor in a case of defamation and atrocity, filed by Congress leader Dr Tushar Chaudhary, based on the assurance of the Additional Public Prosecutor that the journalist will be served a notice of 15 days in case the investigating officer deems it appropriate to arrest her. Justice Nirzar Desai was hearing the petition by Gopi Maniar-Ghanghar, anchor of Ahmedabad-based Nirbhay News Channel, for quashing and setting aside the FIR lodged at Tapi District, based on Chaudhary's complaint under Section 356 (Defamation) of the Bharatiya Nyaya Sanhita (BNS) and various sections of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Chaudhary is the newly appointed Congress Legislature Party (CLP) leader in Gujarat Assembly. The court order stated, 'Public Prosecutor Hardik Dave has made a statement before this Court upon instructions received by the Nikita Shiroya (SC/ST Cell Tapi Vyara) that… the investigation is at very initial stage and therefore, it would serve the end of justice if this Court records the statement of learned Public Prosecutor that in case, during the course of investigation, if the investigating officer deems it appropriate to arrest the present applicant, she will be given a clear notice of fifteen days and upon receipt of the notice…' The court further said, 'The applicant would be at liberty to avail appropriate remedy so as to take remedial measure to seek relief against her proposed arrest. Such a period would start from the date of receipt of the notice by the present applicant.' Chaudhary's complaint is also against Jagdish Mehta, group editor of Rajkot-based Headlines News channel. Chaudhary has alleged that the journalists had defamed him and his deceased father, former Gujarat Chief Minister Amarsinh Chaudhary. In the FIR, the Congress MLA from Khedbrahma has alleged that in a show aired on July 22 on Nirbhay News, Ghanghar made an objectionable statement against him. He said Mehta consented to the statements, which were 'defamatory for him and the entire tribal community'. Ghanghar's advocate Utkarsh Dave said, '…Ghanghar… was the interviewer, who does not have control over what the other person is going to say… We will proceed with legal remedy in case the notice for arrest is issued.'
