Karnataka high court rejects insurer's appeal, directs it to pay 70% of revised compensation amount

Bengaluru: In a striking verdict that underscores the significance of solid evidence in legal matters, Karnataka high court has directed an insurance company to pay 70 per cent of the revised compensation in a fatal accident case, involving a parked lorry and a young motorcyclist.
"Merely making allegations without substantiating the same with cogent evidence would not serve the purpose," observed the division bench, comprising Justices KS Mudagal and MGS Kamal.
The tragic case revolves around 23-year-old Bipin from Bengaluru, who lost his life on March 6, 2016. At 1.45am, he was riding his motorbike near a railway bridge on Bengaluru-Ballari main road when he collided with a lorry parked along the road.
A second, unidentified vehicle then struck him, resulting in fatal injuries.
Bipin's parents, N Nagesh and Vedavati Bai, sought Rs 2 crore in compensation. In 2018, the tribunal awarded them Rs 9,74,000 with 6% interest, placing the blame squarely on the negligent parking of the lorry.
Insurance company HDFC Ergo, however, challenged the order. The insurer argued the policy commenced only on March 7, 2016 — a day after the accident — and labelled the policy document produced by the claimants as "fraudulent."

The bereaved parents also appealed, contesting the tribunal's decision to consider Bipin's monthly income as only Rs 9,000.
The high court, however, found no documentary evidence to support the parents' income claim and relied instead on Karnataka State Legal Services Authority's chart that pegged the notional income at Rs 9,500 for 2016.
Crucially, the insurer also failed to back up its serious claim about a fraudulent policy.
"Since the respondent-insurance company has taken a specific and serious stand of the lorry owner obtaining a fake policy, it ought to have discharged the burden in the manner known to law," the judges stressed.
Maintaining the tribunal's finding that the lorry driver was 70 per cent at fault, while the remaining 30 per cent was of the unidentified vehicle, the high court revised the compensation amount to Rs 15,79,400. The insurance company has been ordered to pay Rs 11,05,580, enhancing the compensation by Rs 1,31,580.

The accused set up a fake office in Noida Sector 70 under the guise of the International Police & Crime Investigation Bureau, using police-like insignia and fabricated ministry documents to mislead the public,' said DCP Central Noida, Shakti Mohan Awasthi. 'During the raid, we arrested six suspects and seized extensive evidence, including forged IDs, ministry certificates, cheque books, ATM cards, visiting cards, signboards, mobile phones, and Rs 42,300 in cash,' Awasthi said. A former Trinamool block president from Birbhum's Nalhati, Adhikari was reportedly under investigation by the CBI and Enforcement Directorate in connection with the recruitment scam. A political row has broken out over Adhikari's association with the Trinamool Congress, with the BJP alleging that all fraudulent activities are linked to the party.

Around 4am on Monday morning, the Ahmedabad Rural Police raided a home in Bareja village of Daskroi taluka. Police had received a tip-off that the residential tenement was being used to stockpile illegal liquor. As the Local Crime Branch (LCB) raided the residential tenement, they found and seized Indian Made Foreign Liquor (IMFL) worth Rs 2.76 lakh. But what was worth noting is the spots where the liquor was allegedly seized from: a crawlspace concealed by an Indian-style toilet, behind electrical sockets, and in spaces behind the tiled walls. Inspector RN Karmatiya of the LCB told The Indian Express that 792 bottles of whiskey and vodka and cans of beer have been seized during the raid. Police said while several bottles of whiskey and cans of beer were unearthed from under a false crawlspace concealed under a toilet, bottles of vodka were recovered from behind electrical sockets, in spaces behind tiled walls, and other hidden spots inside the walls of the house. Though two women present at the house were detained earlier in the day, no arrests were made at the time of going to press. When asked how the personnel decided to search in unusual places such as under the toilet, PI Karmatiya said, 'We had received information about this place several times from local residents, saying that bootlegging was being carried out from this premises. However, no such liquor had been recovered in the past despite the house being searched 2-3 times.' The Inspector further said, 'We raided the premises at 4 am this morning (Monday) and decided to conduct a deep check, including in the structure of the house, leading us to the IMFL hidden in the toilet and the walls.' When asked about any similar cases in the past, the officer said, 'Previously, we had seen one such case in Mandal (a taluka in Ahmedabad) where IMFL was hidden in the wall behind the cupboards and in the floor under box beds.'
