Zara Qairina case: Normal to amend charge if circumstances dictate, says Home Minister

KUALA LUMPUR: Charges pressed in court can always be amended according to findings from an inquest, the Dewan Rakyat has been told. Home Minister Datuk Seri Saifuddin Nasution Ismail said an inquest would also stop once perpetrators are identified and affirmative evidence is discovered. "Then, the charges can be amended. This is something normal. "For example, someone is charged under Section 302 of the Penal Code but maybe it can be amended to Section 304. "For now, this is the decision of the Attorney General's Chambers," he said in his winding up speech in the Dewan Rakyat on Wednesday (Aug 20). He was responding to a question by Afnan Hamimi Taib Azamudeen (PN-Alor Setar) who asked about the case where five teenagers were charged with bullying 13-year-old Zara Qairina Mahathir. The Opposition MP had asked if heavier charges could be pressed if there were new findings from the inquest. Earlier on Wednesday, the five teenagers pleaded not guilty after being charged in the Kota Kinabalu Children's Court under Section 507C(1) of the Penal Code, read together with Section 35 of the same Code, for using abusive words against the victim. If convicted, they face up to one year's imprisonment, a fine or both. Separately, Saifuddin Nasution said it was not fair to claim that the police did not do their jobs in Zara Qairina's case. "Do not perceive this as a cover-up. When I look at the chronology of the investigation and how complete the statements were, I feel sad that only because of one aspect, the police is said to have failed," he said. The police drew flak after not conducting a post-mortem on Zara Qairina. The 13-year-old was found unconscious in a drain near her school dormitory in Papar on July 16 and died the following day at Queen Elizabeth Hospital. Her body was later exhumed and a post-mortem examination carried out. Federal Criminal Investigation Department (CID) director Comm Datuk M. Kumar later said that not conducting a post-mortem was against protocol and that an internal investigation would be conducted on the investigation officer and supervisor.

Court Orders Foreign Student To Undergo Psychiatric Examination

KAJANG, Aug 20 (Bernama) -- A university student charged with eight counts of attempted murder and causing injury to seven victims has been ordered to undergo psychiatric evaluation for a month starting today. Sessions Court Judge Normastura Ayub and Magistrate Fatin Dayana Jalil ruled this after allowing the application by Deputy Public Prosecutors Faelly Jeffrey Lanjungan and Siti Nur Alia Safri, who said the accused, Chinese national Liu Ting, 24, appeared confused and did not understand the charges read out. The court did not allow the accused to be granted bail and ordered the woman to be sent to Hospital Bahagia Ulu Kinta, Tanjung Rambutan in Perak for psychiatric examination, in addition to setting the case mention for Sept 19. Previously, Faelly did not offer bail because the charges against the accused were serious and non-bailable, and also requested that the accused be sent to Hospital Bahagia for psychiatric evaluation. 'As the charges were read, the accused appeared confused and as if she did not understand the charges. Therefore, we request that the accused receive psychiatric treatment at Hospital Bahagia," she said. In the Sessions Court, Liu pled not guilty to three charges: with intent to murder two men, aged 19 and 21, and causing injury to a 35-year-old woman, and if the accused had caused death, she would be guilty of murder. The charge is under Section 307 of the Penal Code, which carries a sentence of up to 10 years in prison and a fine. If the act causes injury to any person, the offender will be sentenced to a maximum of 20 years in prison if convicted. For the other two charges, she also pleaded not guilty to causing grievous bodily harm to a 60-year-old woman by slashing her right arm with a knife, a weapon that could cause death if used improperly, and stabbing a 27-year-old man in the stomach with a knife. Both charges were filed under Section 326 of the Penal Code, which provides for a prison sentence of up to 20 years and a fine or whipping, if convicted.

Counter Setting: Two KLIA Immigration Officers Nabbed In RM400,000 Bribery Probe

KUANTAN, Aug 20 (Bernama) -- Two Immigration officers stationed at the Kuala Lumpur International Airport (KLIA) were arrested for allegedly receiving bribes amounting to about RM400,000 to facilitate the entry of foreigners without going through checks at the country's entry points. According to a source, the two male suspects, aged in their 40s and holding KP1 and KP2 grades, were arrested in simultaneous operations in Nilai and Johor Bahru on Monday. 'The arrests followed earlier operations by the Malaysian Anti-Corruption Commission (MACC) to clamp down on a 'counter setting' syndicate at KLIA 1 and 2, which is believed to have collected hundreds of thousands of ringgit in bribes to allow foreigners to enter the country without going through proper checks from 2022 to 2024,' the source said.
