against him. Lalu moved the SC seeking directions to the trial court to adjourn proceedings till the
Delhi High Court
concludes hearing his petition to quash the case.
Refusing to put brakes on the proceedings in the lower court, a division bench comprising Justices MM Sundresh and N Kotiswar Singh clarified that the trial court's framing of charges in the case would not render Lalu's quashing petition in the HC infructuous. "We are not passing any order. Taking note of the apprehension, we say framing of charges will not make the pending petition before the HC infructuous," the bench said.

Earlier this month, the apex court had refused to entertain a plea filed by Lalu to stay trial court proceedings in the land-for-jobs case in which he, his kin and other accused stand chargesheeted by the Central Bureau of Investigation (CBI) over corruption and conspiracy.
Lalu had moved the SC challenging a May 29 order of the Delhi High Court refusing to stay the trial court proceedings. Refusing to put brakes on the trial, a division bench comprising Justices MM Sundresh and N Kotiswar Singh on July 18 had said it would ask the Delhi HC to decide Lalu's plea that seeks quashing of the CBI case. The apex court then asked the high court to decide Lalu's plea expeditiously.

ET had reported earlier this month that Lalu had moved an application in the trial court seeking to summon old records of the land-for-jobs case investigated by the CBI. The CBI has already concluded its arguments on framing of charges against Lalu, his kin and other co-accused.

SC cancels bail granted to DHFL promoter in loan scam case, directs him to surrender in two weeks
NEW DELHI: The Supreme Court on Tuesday cancelled bail granted to former DHFL promoter Dheeraj Wadhawan in the multi-crore bank loan scam case. A bench of Justices Sanjay Kumar and Satish Chandra Sharma passed the order after perusing the report filed by a medical board and directed Wadhawan to surrender within two weeks. The Delhi High Court on September 9, 2024 granted him bail on medical grounds saying Wadhawan fell within the parameters of a "sick person". The order came on an appeal filed by the CBI appeal against the high court order. Additional Solicitor General S V Raju, representing the agency, had earlier said said Wadhawan suffered from no serious medical ailments and huge amounts of money were siphoned off in the case. The Wadhawan brothers -- Kapil and Dheeraj-- were arrested in this case in July 2022. The agency filed a chargesheet in October 2022 following which a court took its cognisance. The FIR was registered on a complaint made by the Union Bank of India , which alleged DHFL, the housing finance company's then chairman-cum-managing director Kapil Wadhawan , then director Dheeraj Wadhawan and other accused entered into a criminal conspiracy to cheat the consortium of 17 banks led by the Union Bank of India, and in pursuance of the criminal conspiracy, the accused and others induced the consortium to sanction huge loans aggregating Rs 42,871.42 crore. Much of the amount was allegedly siphoned off and misappropriated by alleged falsification of the books of the DHFL and dishonest default in repayment of legitimate dues of the consortium banks, the CBI claimed.

Print, digital news will vanish, only ChatGPT will remain: DNPA to HC
DNPA told the Delhi High Court that if OpenAI continues to use news content without compensation, physical and digital media may vanish, leaving only ChatGPT functioning New Delhi The Digital News Publishers Association (DNPA) on Tuesday told the Delhi High Court that physical newspapers and online news portals would soon disappear and only OpenAI's chatbot ChatGPT would remain operational if large language model (LLM) makers continue to scrape and use content created by newsrooms without any revenue accruing to them. "Physical newspaper circulation has come down drastically. Physical newspapers are disappearing, digital news will disappear, and only ChatGPT will remain. It reduces my incentive to publish," Senior Advocate Rajshekhar Rao, appearing for DNPA, told Justice Amit Bansal of the Delhi High Court. The DNPA's submissions were made in the ongoing hearing of the copyright and illegal content usage case filed by Asian News International (ANI) against OpenAI. DNPA, which represents several print and digital media organisations in the country, argued that the moment ChatGPT picks up information from the public domain to train its LLM—without the consent of the news organisation—it amounts to copyright infringement. "Storage of an infringing copy itself is infringing. Even if you store it for a transient moment, you are infringing. You cannot use my copyright without my licence," Rao said. He added that even for research purposes, OpenAI must acquire a lawful copy first. "...You have to buy SCC Online to be able to crack it in the privacy of your home for research purposes," he told the court. In the last hearing, intervenors had argued that ANI and ChatGPT were each other's competitors. 'If I ask who the CM of Jammu and Kashmir is, I will get an answer from ChatGPT as well as ANI. They are direct competitors.' ANI Media has filed a case against ChatGPT-maker OpenAI, alleging that its content was illegally used to train large language models (LLMs) and other artificial intelligence (AI) systems.
