Two shootings less than a month apart at McCabe's Bar near downtown DeLand has put the establishment in violation of its lease and it will have to change hours of operation, said police Chief Jason Umberger.
Umberger made the statement Tuesday morning during a press conference while giving an update on the latest shooting that occurred outside the bar early Saturday. There were no injuries. The Saturday shooting follows a fatal one that occurred on May 3, when a customer was shot dead inside the bar.
"The individuals that own McCabe's Bar have already been served with a notice of violation of lease," Umberger said. "And they are going to be required to change their hours of operation."
The Facebook page for McCabe's Bar shows the bar opens Mondays to Saturdays from 1 p.m. to 2 a.m. and Sundays from 1 p.m. to 12 a.m.
The bar was open on Tuesday, and an employee who answered the phone said she would relay a reporter's request for comment.
It was not immediately known Tuesday what the new hours of business were.
Umberger said he also suggested to the bar operators to hire security and screen patrons coming into the bar for firearms in the foreseeable future.
"Our primary concern is public safety," Umberger said. "People are concerned about the two incidents at McCabe's Bar. We are, too. We take it very seriously."
On Saturday at 2:05 a.m., DeLand police said they responded to a shooting call at McCabe's. Investigators learned that regular patron, Calvin Gilbert, 55, had been drinking with a man in the bar. He bought the man he just met at the bar a beer, police said.
At closing time, Gilbert got into an argument with the man and demanded reimbursement. During the confrontation, Gilbert went to his car, retrieved a satchel from which he pulled out a gun and fired it three feet away from the victim's head, Umberger said.
In surveillance video released Tuesday, Gilbert can be seen first approaching the victim outside McCabe's Bar, exchanging words and tossing a drink in the victim's face. Gilbert is later seen returning with a gun in his right hand and pointing to the victim with a raised left arm.
He walks past two other persons, approaches the victim, raises the gun, and fires. The victim can be seen ducking sideways to avoid getting shot in the head. Gilbert was arrested Sunday in a traffic stop and charged with attempted murder and the use of a firearm while under the influence of alcohol.
Three weeks before Saturday's shooting, on May 3, police said Keshod Harris, 32, of DeLand, was struck multiple times in the chest when Avantae Williams, 24, a graduate of DeLand High School and a former college football player with the Miami Hurricanes and Maryland Terrapins, allegedly shot Harris who was jealous over a woman.
Umberger said the owners of McCabe's Bar have been cooperative and believed they will comply with the new requirements to stay in business.
Umberger said they have also asked the Florida Department of Business and Professional Regulation to review McCabe's Bar's liquor license.
Umberger concluded that people who engage in gun violence will be held accountable.
"Individuals who choose to unlawfully carry and use these firearms are ultimately responsible for their actions. We will arrest them and bring them to justice," the chief said.

Illegal street takeovers typically involve souped-up cars performing dangerous stunts in traffic, but one Florida city says it busted a 'lawless' street takeover by bikers. Not motorcyclists, mind you. Police say these were people on e-bikes, which are bicycles fitted with electric motors to make pedaling easier. The Port St. Lucie Police Department says social media posts revealed a 'planned e-bike street takeover' was set for the second weekend of August on SW Village Parkway. 'Officers with our Traffic Unit were prepared. They located the group of about 50 participants as they began to show up at the meet location, some from as far as Palm Beach and Tampa, including juveniles and adults,' police said in an Aug. 12 news release. 'Multiple participants were turned away and warned as they arrived with their e-dirt bikes on trailers. Our message is clear, lawless street takeovers will not be tolerated in Port St. Lucie!' Three people were arrested on charges including fleeing and eluding police, having no driver's license and operating an unregistered motorcycle, police said. Six criminal traffic citations were issued for operating unregistered motor vehicles on roadways and 15 citations were written up 'for various traffic violations.' Eight e-dirt bikes were seized and towed away on the back of a truck, police said. Maps show the intended location for the takeover at SW Village Parkway and SW Crosstown Parkway is an expansive intersection of four-lane roads with grass medians. The department's Aug. 12 Facebook post about the case had 2,700 reactions and comments within a day, some critical of police and others making fun of the suspects' sense of adventure. 'Lol, e-bike take over! This Harley Riding Girl has had her laugh for the whole year!' VL Lynn posted on the department's Facebook page. 'All get our golf carts and try it,' Bonnie Shaw Croteau wrote. 'Oh yes, people on electric bikes are such dangerous criminals,' Filius Mortis Shotts said. Port St. Lucie is about a 115-mile drive north from Miami.

Meta Platforms (META) Facebook-parent Meta (META) rose more than 3% on Tuesday to close at a fresh high of $790 per share as the company doubles down on artificial intelligence (AI) efforts. Meta shares jumped following the release of its second quarter results at the end of July, as the company beat expectations. In the results, the company said it now expected capital expenditures for 2025 to be between $66bn (£48.7bn) to $72bn, raising the lowered end of its previously guided range of $64bn to $72bn. Meta said it expected another year of similarly significant capex dollar growth in 2026, as it continues "aggressively pursuing opportunities to bring additional capacity online to meet the needs of our artificial intelligence efforts and business operations." In addition, head of Instagram Adam Mosseri said on Tuesday that its Threads platform had recently reached more than 400 million monthly active users. CoreWeave (CRWV) Shares in AI data centre operator CoreWeave (CRWV) slid more than 10% in pre-market trading on Wednesday, after the Nvidia-backed (NVDA) company posted a bigger-than-expected loss in the second quarter. CoreWeave posted a net loss of $290.5m for the second quarter, which was more than the average estimate $190.6m expected by analysts, according to LSEG-compiled data reported by Reuters. In addition, operating expenses of $1.19bn also jumped from $395.3m a year ago. Second quarter revenue came in at $1.21bn, topping estimates of $1.08bn. Cava Group (CAVA) Shares in Cava (CAVA) dropped nearly 23% in pre-market trading on Wednesday, after the restaurant chain issued its first annual sales growth target cut since listing in New York two years ago. In its second quarter results, released on Tuesday, Cava said it now expected to deliver same restaurant sales growth of 4% to 6% in 2025, compared to a previously guided range of 6% to 8%. However, the company maintained it guidance for adjusted earnings before interest, tax, depreciation and amortisation (EBITDA) of $152m to $159m. TUI ( Holiday group TUI ( reported better-than-expected third quarter results on Wednesday. Group revenue for the third quarter came in at €6.2bn, which was up 7% from a year ago. Underlying EBIT of €321m was up 38% compared to the previous year. On Tuesday, TUI announced that it was raising its 2025 EBIT growth guidance to a range of 9% to 11%, versus previous expectations of 7% to 10%. Shares popped after the company lifted its guidance on Tuesday but hovered just below the flatline on Wednesday morning. Victoria Scholar, head of investment at Interactive Investor, said: "It looks like the summer performance so far has held up much better than anticipated. Last quarter Tui warned about a potential drop in summer bookings amid the macro uncertainty and European heatwaves. However this week, that sense of nervousness has reversed course with a guidance uplift for the full-year and a top and bottom line beat." Persimmon (PSN.L) Housebuilder Persimmon (PSN.L) was the biggest faller on the FTSE 100 (^FTSE) on Wednesday morning, with shares falling 3%, on the back of its half-year results. Profit before tax of £146.7m was little changed from the same period last year, despite group revenue rising to 14% to £1.5bn. Meta stock jumps 12% on Q2 earnings beat, better-than-expected Q3 outlook

Meta's (META) stock jumped 12% at the start of trading on Thursday after its second quarter earnings outperformed expectations and the company offered a better-than-expected outlook for Q3. The Facebook parent said Wednesday it anticipates between $47.5 billion and $50.5 billion in third quarter revenue, well ahead of the $46.2 billion Wall Street was calling for. For Q2, Meta saw earnings per share (EPS) of $7.14 on revenue of $47.5 billion. Analysts were anticipating EPS of $5.89 on revenue of $44.83 billion, according to Bloomberg consensus estimates. The company saw EPS of $5.16 and revenue of $39.07 billion in the same period last year. Advertising revenue came in at $46.5 billion compared to an expected $44.07 billion. The company's Reality Labs segment saw a loss of $4.5 billion versus expectations of $4.8 billion. The earnings announcement comes amid Meta's AI spending and hiring spree. Last week, CEO Mark Zuckerberg announced former OpenAI ( researcher Shengjia Zhao, who helped develop the company's ChatGPT model, had been named founder and chief scientist of Meta's Superintelligence Lab. Prior to Zhao, Meta invested $14.3 billion in Scale AI ( and hired its CEO, Alexandr Wang. The company also hired former GitHub CEO Nat Friedman and Safe Superintelligence CEO Daniel Gross. Zuckerberg also poached Apple's (AAPL) head of AI foundation models, Ruoming Pang, according to Bloomberg. Meta is also spending on AI data centers, with Zuckerberg saying last week that the company is investing hundreds of billions of dollars to build several multi-gigawatt data centers around the country. One such facility, called Hyperion, will eventually scale up to support up to 5 gigawatts, or 5 billion watts, of capacity. Read more: Live coverage of corporate earnings CFO Susan Li addressed the spending in the earnings release, saying that the company expected to increase its expenditures in the year ahead. "The largest single driver of growth will be infrastructure costs, driven by a sharp acceleration in depreciation expense growth and higher operating costs as we continue to scale up our infrastructure fleet," Li wrote. "Aside from infrastructure, we expect the second-largest driver of growth to be employee compensation as we add technical talent in priority areas and recognize a full year of compensation expenses for employees hired throughout 2025. We expect these factors will result in a 2026 year-over-year expense growth rate that is above the 2025 expense growth rate." While Meta is spending truckloads of money on its AI buildout, it's also seeing some early returns on its investments. And Wall Street is liking what it sees. 'Given audience scale, we continue to see Meta as one of the best AI opportunity stocks, with potential revenue upside as AI capabilities are integrated into the ad stack,' BofA Global Research analyst Justin Post wrote in an investor note ahead of Meta's earnings. Meta is also pushing further into the smart glasses space as another avenue to generate AI revenue. The company already offers its Ray-Ban Meta smart glasses, and in June, it unveiled its Oakley Meta glasses. The company is also working on standalone AI glasses that it will release in the future. All of this comes as Meta continues its push into what Zuckerberg calls 'personal superintelligence.' On Wednesday, the CEO released a statement saying that developing superintelligence is in sight now and explaining his company's vision for the technology. "As profound as the abundance produced by AI may one day be, an even more meaningful impact on our lives will likely come from everyone having a personal superintelligence that helps you achieve your goals, create what you want to see in the world, experience any adventure, be a better friend to those you care about, and grow to become the person you aspire to be," Zuckerberg wrote.
