Ex-CEO remanded over false claims involving RM360mil

The suspect, a man in his 40s, was arrested at about 11pm yesterday after he had gone to the MACC headquarters in Putrajaya to give his statement.
KUALA LUMPUR : A former CEO of a company has been remanded for three days until Monday for allegedly submitting claims containing false particulars amounting to RM360 million.
The remand order was issued following an application by the Malaysian Anti-Corruption Commission at the Putrajaya magistrates' court today.
According to a source, the suspect, in his 40s, was arrested at about 11pm yesterday when he went to give his statement at the MACC headquarters in Putrajaya.
'An initial investigation found that the suspect is believed to be involved in submitting documents containing false particulars to make claims amounting to about RM360 million using sukuk funds in a highway construction project worth RM1.3 billion,' said the source.
MACC senior director of the investigation division Zainul Darus confirmed the arrest and said the case is being investigated under Section 18 of the MACC Act 2009 related to the offence of intending to deceive by providing false claims.
Zainul said four individuals – three men and one woman including one with the 'Datuk Seri' title, who were remanded last Wednesday in connection with the same case, had been released on MACC bail.

A separate raid was also conducted at his residence in Melaka, although no items were seized. The investigation centres on the suspected misappropriation of sukuk bonds issued to finance the construction of the highway. On June 3, MACC seized a luxury condominium, a plot of land valued at RM24.5mil, and nine vehicles worth RM7.65mil. Authorities also froze 14 personal bank accounts with RM4.5mil and eight company accounts holding RM33mil. In addition, anti-graft officers seized luxu­ry watches worth approximately RM25mil, handbags valued at RM3mil, jewel­lery and diamonds worth RM6mil, four horses estimated at RM400,000, and premium alcoholic beverages valued at RM3mil. Azam previously disclosed that between 2016 and 2020, investigations revealed misconduct involving RM1.35bil in approved sukuk funds. This included false claims totalling RM360mil, RM416mil, and RM50mil through other bank facilities. 'The RM1.67bil highway project also failed to meet its completion schedule. Investigations are now focused on RM12bil in alleged bribes paid to certain parties as an inducement to facilitate the movement of funds out – and back – to the suspect,' Azam said in a June 3 statement, adding that the funds are also believed to have been used for money laundering activities. — Bernama

KUALA LUMPUR: The Malaysian Anti-Corruption Commission's (MACC) questioning of a Tan Sri regarding alleged misuse of sukuk funds in a highway project continued on Thursday (June 12). A white Toyota Vios carrying MACC officers was seen entering the individual's residence at 8.45am. One of the property entrances was sealed by auxiliary police from a private company, with cones and barriers placed at the gate. Media personnel were prevented from approaching the area. On Tuesday (June 11), the Tan Sri's statement was recorded over six hours, from 9am to 3.07pm. MACC chief commissioner Tan Sri Azam Baki previously said the highway concessionaire is a key witness in the investigation. Earlier reports stated that 45 individuals who had given statements were recalled to provide further information. On June 3, the MACC disclosed it had seized assets worth around RM143mil in the probe, which centres on the alleged misappropriation of sukuk funds for a Klang Valley highway project. Investigators are also tracing luxury vehicles and properties linked to the Tan Sri, including assets in London and Switzerland.

Kota Kinabalu: A former Rela officer from Tenom who told the court that he submitted the false claims for the assignment allowances during the implementation of the Movement Control Order (MCO) as he wanted to help the Tenom Rela personnel whose income was affected at that time, was jailed 14 days and fined a total of RM147,160 for seven counts of submitting false claims. Venantius Masingga, 63, said this in mitigation after he pleaded guilty to the charges against him before Sessions Court Judge Jason Juga, on Wednesday. Advertisement He told the court that the money which he obtained using the fake claims were not for his personal use but to buy food baskets for the Tenom Rela personnel affected by the implementation of MCO at that time. According to Venantius, he did not mean to commit the offence but forced to do so to help the Rela personnel. Originally, Venantius have 18 charges against him but he only pleaded guilty to the second, third, fourth, fifth, sixth, seventh and eighth charges while the rest were taken into consideration by court in accordance with Section 171A of the Criminal Procedure Code. The sentences imposed on Venantius as follows: Second count – two days' jail and fined RM16,160 in default three months' jail. Third count – two days' jail and fined RM27,680 in default three months' jail. Fourth count - two days' jail and fined RM24,400 in default three months' jail. Fifth count - two days' jail and fined RM21,240 in default three months' jail. Sixth count - two days' jail and fined RM19,200 in default three months' jail. Seventh count - two days' jail and fined RM18,640 in default three months' jail. Eight count - two days' jail and fined RM19,840 in default three months' jail. The court ordered Venantius to serve the jail sentences concurrently. Venantius did not pay the fines. The charges stated that Venantius had submitted the MCO assignment allowance claims under the names of his wife and children who actually never performed their duties during the MCO with the intention of deceiving the Director of Rela Sabah. He committed the offence between March 2020 and August 2021 at the Rela Sabah Headquarters. The offence under Section 18 of the Malaysian Anti-Corruption Commission (MACC) Act 2009, which is punishable under Section 24(2) of the same Act provides for a jail term of up to 20 years, or a fine of not less than five times the amount or value of the bribe, or RM10,000, whichever is higher, upon conviction. In mitigation, Venantius who was not represented, asked for leniency saying that it was his first offence and very remorseful as well and promised not to repeat the offence in future. He added that he was suffering from hypertension and that he has two small and schoolchildren to look after. Venantius also told the court that he had served 20 years as army, 20 years as Rela personnel and six years being a coach for National Service Training Programme (PLKN). 'I will get ready to do community service if the court orders so,' said Venantius. However, MACC Prosecuting Officer Rekhraj Singh urged the court to hand down an appropriate sentence taking into consideration the rampancy of the case as well as seriousness of the offence.
