Ticketmaster ordered to refund Coldplay fan over ‘restricted view' at ‘disaster' Croke Park gig

A JUDGE HAS ordered Ticketmaster to fully refund a furious Coldplay fan who ended up crouching in 'restricted view' seats, unable to see the band during their sell-out Croke Park concert last year.
When the chart-toppers with hits Fix You and Yellow announced they were bringing their Music of the Spheres world tour to Dublin, James McGetrick thought he 'hit the jackpot' but it became a 'disaster'.
Dublin District Court heard he scooped pre-sale tickets to go to the gig with his wife on 29 August, but that on the night they were forced to 'crouch down' on their seats near the back of the lower Hogan Stand to see Chris Martin's performance.
McGetrick took a small claims case against the Ticketline Unlimited Company, trading as Ticketmaster.
He told Judge Peter White they bought tickets released through the artist pre-sale well ahead of the general public.
He shelled out €332 for two seats on the lower Hogan Stand.
On the day of the concert, they were directed to the fourth row from the back of the stand. He explained that the Coldplay stage was 'quite elevated' for the people standing on the pitch.
He described how he and his wife could not see the band from their seats.
All the people in front stood, and they in turn had to stand to see over their heads.
McGetrick explained that the overhang from the upper Hogan Stand also hindered their view.
As the concert went on, people in the seats behind them, who had an even worse view, began to fill the aisle.

After seven or eight songs, he and three girls from the row in front of him approached a steward.
He alleged they were more interested in the concert, had not looked back, and were not policing anything.
McGetrick, of Corrib Road, Terenure, Dublin 6, said the stewards then went back up the stand with them and told everyone in the aisles to return to their seats.
That turned bad, he said, because 'all those people who were sent back to the seats started to blame myself, now they could not see anything as well.'
The atmosphere turned unpleasant, and 'popcorn and litter was being thrown at us, it was just terrible'.
The next day, he complained to Ticketmaster, and the company told him to contact the promoter, MCD.
Originally filing his small claim action against MCD, the District Court ruled he should have brought it against Ticketmaster instead.
So, he started the process again with the ticket site, which he said was 'just pawning me off' and he lodged a fresh action in the court against them.
The firm eventually offered just €190, but McGetrick persisted with his case, seeking the full amount he paid for the tickets.
He stressed that when he bought them, it was never stated that there was a restricted view and he thought the seats would be better because he got the tickets via the artist pre-sale option.
'The whole thing was a disaster,' he told the court.
Noting that Ticketmaster did not attend the hearing to contest the action, and given the account of the experience and evidence of the purchase, Judge White granted a decree in favour of McGetrick.

It inspired Coldplay's Chris Martin and US star John Mayer to become musicians and now a worldwide search has been launched for the electric guitar played by Michael J Fox in eighties movie classic Back to The Future after it went missing forty years ago. Gibson guitars has launched a hunt for the Cherry Red Gibson Es-345, on which Fox's character Marty McFly plays Chuck Berry's Johnny B. Goode on stage during the Enchantment Under the Sea scene in the beloved 1985 film, which also starred Lea Thompson and Christopher Lloyd. According to Nashville-based Gibson, during the making of the 1989 sequel to the film, the production team went to look for the guitar, and it was nowhere to be found. The search was launched as production begins on Lost To The Future, a new documentary film celebrating the movie's fortieth anniversary. Directed by Robert Zemeckis and released in July 1985, Back to the Future won an Academy Award and three additional nominations and launched a franchise that would go on to earn almost $1 billion globally. Gibson say that the discovery of what happened to the film's Gibson ES-345 would add "a critical chapter to the film's cinematic history". "Guitar has always been a big part of my life," says Michael J. Fox. "When we talked about the Enchantment Under The Sea scene in Back to the Future, I sat down with the cinematographer and choreographer and said I want to riff through all of my favourite guitarists, like doing Jimi Hendrix behind the head, Pete Townshend doing a windmill, and the Eddie (Van Halen) hammer thing, it was so cool that they were open to that, and we laid it all out there. "I'm really happy with the scene because it was an expression of my love for guitar and all the great players. I didn't realise the influence the scene had on people. "John Mayer said, 'I play guitar because of you,' and Chris Martin said the same thing, and I am glad they took it further than I did; they went to the trouble of being really good players. I just love the guitar, and I love the movie." Bob Gale, co-creator, screenwriter and producer of Back To The Future, added, "Years ago, I was astonished to learn this beloved cinematic artefact had apparently disappeared into the space-time continuum. "Since we don't have a functioning time machine, this effort is probably our best chance to solve a decades-long mystery." Lost To The Future will feature new interviews with cast members Fox, Lea Thompson, Christopher Lloyd, and Harry Waters Jr., musician Huey Lewis, who sang the film's theme song, The Power of Love, as well as musicians who have been inspired by the film over the decades. here.

Irish Beyonce fans are missing out on seeing the superstar on home soil - but if you're willing to hop across the water, now might be your best chance to secure cheap tickets. The global superstar is bringing her Cowboy Carter tour to Europe this month, with a string of massive shows kicking off in London on Thursday, June 5. And while there are no Irish dates on the tour - much to the disappointment of her large Irish fanbase - resale tickets for the the London concerts have now dropped well below their original price, with fans snapping up some serious bargains. After a blockbuster run across major US cities including LA, New York and Atlanta, Beyonce will play six nights at the Tottenham Hotspur Stadium in London on June 5, 7, 10, 12, 14 and 16. She's also performing for three nights in Paris, taking to the stage in the Stade de France on June 19, 21 and 22. As of June 3, tickets for all these shows are still available on Ticketmaster - and fans have spotted even cheaper options also appearing on resale sites like Viagogo. Full-price tickets are still available on Ticketmaster from £121.70 (€144), but fans who can no longer attend are also reselling theirs. Ticketmaster's official resale option is now active for all of Beyonce's European shows, with tickets currently listed from just £92 (€109). These lower-priced seats are likely to go fast, but fans can keep checking Ticketmaster HERE for official resale listings and they could get lucky. Another option for fans is resale sites like Viagogo, where ticket prices have dropped well below face value. At the time of writing, we spotted tickets for as little as €68. Sites such as Viagogo and Vivid Seats allow fans to buy resale tickets from other fans. However, it is important to note that many event promoters say tickets should not be resold after initial purchase and will not be valid for admittance to gigs. Fans attending live events with tickets acquired through resale websites are advised to double check the ticket terms and conditions at the point of sale - such as Ticketmaster or Live Nation - to ensure a smooth live event experience. Tickets could be voided if they were found to be bought second-hand. As a result, fans are buying at their own risk. With that said, Viagogo also commented: "Viagogo is a regulated marketplace where fans have the guarantee." If you're up for travelling to London or Paris, there are plenty of seats still up for grabs - including a pair together for just €68 each at Beyonce's June 5 London show. Considering original prices ranged from £71 (€84) to £901 (€1,067), that's reasonable value. Paris is also proving affordable, with tickets for the Stade de France starting from €112.
