
Teen abandoned by parents, ‘raped' by cousin, moves Delhi HC to terminate 28-week pregnancy
In its order issued Monday, the court noted that the child has been abandoned by both parents, and the only guardian she wants to stay with is the mother of the accused. It sought a report from the Child Welfare Committee (CWC) in response to the petition, observing that the child will be 'in need of care and protection' as defined under the Juvenile Justice (Care and Protection of Children) Act, 2015.
A medical examination conducted at AIIMS, New Delhi, had revealed that the pregnancy had progressed to over 29 weeks and involved a viable foetus in breech position, indicating a possible need for a pre-term caesarean section. Citing the high-risk nature of the pregnancy, AIIMS informed Justice Swarana Kanta Sharma that both the survivor and her guardian had consented on Monday to continue with the pregnancy.
Given the peculiar circumstances — where the minor's parents are absent and her only guardian is the rape accused's mother — the court had inquired from AIIMS New Delhi if she could be housed in the hospital until her delivery and even few weeks after. The hospital, had instead, recommended that she be kept at a women's shelter home.
Dr. Vidushi Kulshreshtha, a professor in the Department of Obstetrics and a member of the Medical Board that advised against the termination, appeared virtually before the court and informed that the minor had previously expressed discomfort with staying at the hospital. She further noted that with only 33 beds available in the department, admitting the minor long-term would deprive other patients of necessary care. Dr Kulshreshtha recommended that the minor could instead be housed at a facility run by the CWC.
In its order on Monday, the court recorded: 'In these circumstances… (of) the child, being abandoned by both parents and the mother of the accused being the only guardian with whom the victim wants to reside… this court, by way of abundant caution, deems it appropriate to hold that the child will be in need of care and protection under the Juvenile Justice Act, 2015. The CWC is directed to independently interact with the child, obtain her opinion, and inform this court… before passing a final order.'
The court further directed that once the minor is discharged from AIIMS and shifted to the CWC-administered shelter home, 'instead of being produced before the CWC, the members of the Committee shall meet her at Nirmal Chhaya and prepare a report regarding her willingness to continue with the pregnancy.'
The court has now posted the matter next for August 20, when the CWC is expected to submit its report.

On Dec 11, 2024, Kalia reportedly split the unit into audio unit-1 and unit-2, assigning pending cases from 2021–23 to Kaur (unit-2) and new 2024 cases to himself (unit-1). She said the controversial case involving three audio parcels was received for examination and was finalised on Aug 8, 2024. Later, Kalia allegedly began demanding the case file while claiming it fell under his jurisdiction. He repeatedly directed junior staff to break open the sealed parcels and re-examine them, despite being told the report had already been submitted. Kaur alleged that Kalia's actions were aimed at altering the findings in a politically sensitive case involving the former minister. Fresh certificates In a what is seen as a landmark judgment on transgender rights across the country, the Manipur High Court has directed the state educational department to immediately issue fresh academic certificates reflecting the new name and gender identity of transwoman doctor Beoncy Laishram. The 32-year-old doctor had filed a petition at the court to change her name and gender from transgender to female in her education certificates. She had undergone a gender reassignment surgery in 2019. Ms Beoncy hails from Kwakwa in Imphal West and had become the first transgender from Manipur in 2018 to have become a doctor. She is also the first ever transgender doctor in entire northeast region. In the court's order, the authorities have been asked to issue fresh certificates with gender "female" under the name "Beoncy Laishram," replacing the original entries of "male" and "Boboi Laishram." In her petition, the doctor has claimed that there was a refusal of the education boards and the state medical council to update her details in terms of name and gender and this refusal has prevented her from doing her post graduation in medicine, due to which she could not appear for the NEET-PG. The doctor was issued with a transgender certificate by the Imphal West district magistrate under the Transgender Persons (Protection of Rights) Act, 2019 that recognised her new name and her identity as a female. With the help of that certificate, she had been reissued an Aadhaar, Voter ID and PAN cards. But the Board of Secondary Education Manipur (BOSEM), Council of Higher Secondary Education Manipur (COHSEM), Manipur University, and Manipur Medical Council rejected the certificate and didn't issue her fresh certificates. That has caused inconsistency in her documents and therefore she was unable to apply for any official work or even apply for higher studies.
