Gerakan No 2 files appeal in Guan Eng defamation case

KUALA LUMPUR : Gerakan deputy president Oh Tong Keong has filed an appeal against a High Court decision ordering him to pay Lim Guan Eng damages of RM550,000 for falsely accusing the former finance minister of helping a concert organiser obtain tax exemptions.
Oh's lawyer, Chai Ko Thing, said the appeal was filed on May 21 to challenge the judgment delivered by the High Court in George Town on May 7.
'The application for a stay of execution was filed on May 22 pending the outcome of the appeal to the Court of Appeal,' Chai told FMT.
He said the court has fixed tomorrow for case management of the stay application.
On May 7, the High Court awarded Lim RM550,000 in damages after ruling that Oh had falsely accused him of helping a concert organiser obtain tax exemptions while the former was the finance minister.
Justice Kenneth St James ruled that Oh had defamed Lim at a press conference on Sept 25, 2019, and through a press release sent out by Penang Gerakan's official email address. The remarks were later published by China Press, which was also found liable.
Oh had questioned why Lim had granted tax exemptions to WGW Entertainment Sdn Bhd and its owner, Hendrik Huang, for a Mandopop concert at Spice Arena.
The judge found that Oh had no basis for his claims and gave no evidence that Lim knew Huang or had granted any tax privileges.
He said although Oh's statements were framed as questions, they were found to be defamatory in nature and did not qualify as fair comment.
Oh was also ordered to publish an unconditional apology to Lim in China Press, online and in print. He was also barred from repeating the claims.
China Press was ordered to pay RM150,000 in damages, RM80,000 in costs, and interest at 5% per annum.

PETALING JAYA : A two-year-old girl died from her injuries after the car she was in was rammed from behind by a Toyota Alphard on the North-South Expressway near Muar, Johor, on Monday. A breathalyser test cleared the driver of the Alphard from being under the influence of alcohol or any banned substance. He appealed for witnesses to come forward and assist in investigations.

Drama around Tengku Zafrul's exit seems orchestrated, says Kedah Umno

Kedah Umno information chief Shaiful Hazizy Zainol Abidin said the statements released by PKR vice-president Amirudin Shari and PKR Youth chief Kamil Munim make the entire matter seem 'planned and celebrated'. 'The series of statements from PKR figures seem to send a direct message to Umno that etiquette does not matter in our cooperation and that political moves can be arranged without regard for the sensitivities of the main partners in the unity government,' he said in a statement today. Shaiful called for a stop to the 'drama' surrounding Tengku Zafrul for the sake of stable, honest and sincere political cooperation. 'We cannot continue to sacrifice our principles for the sake of power. Umno is ready to cooperate, not to be a plaything in the political narratives of others.' Shaiful also branded Tengku Zafrul, who is the investment, trade and industry minister, a 'first-class political tourist'. Yesterday, Amirudin said Tengku Zafrul's entry into PKR could bolster the party's credibility and expressed confidence that they could work well together. Kamil said Tengku Zafrul, being a corporate figure, could bring 'added value' to the party given the latter's experience. However, PKR secretary-general Fuziah Salleh said any such application to join the party would have to go through the usual processes, taking into account the views and perspectives of the party's partners in the unity government. Tengku Zafrul's decision confirms rumours that spread in February that he would be leaving Umno and joining PKR before his term as a senator expires at the year end.

Nurul Izzah Anwar had made the offer three days before PKR delegates cast their votes in the central leadership elections, said Rafizi Ramli. AMPANG JAYA : Rafizi Ramli who was defeated at the PKR elections last month, says Nurul Izzah Anwar had previously suggested the creation of an appointed post of PKR deputy president for Rafizi to fill. Rafizi said the offer, which he rejected, was made by Nurul Izzah at a meeting three days before PKR delegates cast their ballots in the party's central leadership elections. 'When she met me, she tried to propose having an appointed deputy president – me. But even if it were to be an appointed party president, I'm not interested, all the more other party posts,' he said today. 'Because this isn't a question of posts but the message we want to convey,' he said when met at an event organised by his Pandan parliamentary office here today. Rafizi failed to secure re-election as deputy president last month, losing to Nurul Izzah who received 9,803 votes to his 3,866 votes. He subsequently offered his resignation from his Cabinet post as economy minister. He said today that he will resume his duties as a normal MP and the head of the party's Pandan division. He is on leave from his official duties while his resignation is effective June 17. Rafizi had previously revealed that he had rejected a last-ditch appeal from Nurul Izzah to help her after the party polls ended. Rafizi said he believed that her plea stemmed from concerns over the new leadership lineup, which she feared would bring trouble for Anwar Ibrahim and PKR.
