
Congestion pricing is ‘thriving' in New York City — but can it survive Trump?
Every week, Stan Avedon drives across lower Manhattan, moving bikes between the two NYC Velo shops he's managed for the last 15 years. What used to be a grinding crawl through some of the world's worst traffic is noticeably less painful lately. 'It's like night and day,' he said.
Avedon's transformed commute is the result of the most ambitious policy to hit New York in recent memory. Starting 5 January, drivers entering lower Manhattan began paying a $9 congestiontoll aimed at deterring drivers and raise desperately needed funds for the city's deteriorating public transit system.
Avedon doesn't mind being charged for his newly gained time. 'As a motorist, it's like the price of gas goes up. The cost to be in the city goes up.'
For decades, New York lawmakers have proposed plans for a congestion zone where drivers would have to pay a fee to enter the busiest parts of Manhattan as a means of funding public transit. The idea was first floated in 1952, but it wasn't until 2007 that then-mayor Michael Bloomberg took a plan to Albany, where it was rejected by state legislators.
At every turn, the attempts to introduce congestion pricing have been met with acrimony both sweeping and strange: accusations that congestion pricing is a 'plumber's tax' on blue-collar workers that wasn't democratically decided, a cynical cash grab by a mismanaged Metropolitan Transportation Authority (MTA), or a scheme that will flood outer-borough streets with displaced traffic. Critics have warned of economic fallout, calling the toll elitist.
Despite these objections, the program finally received federal approval in 2023 under the New York governor, Kathy Hochul. It seemed as though congestion pricing might finally happen. However, just days before the program was set to begin in June 2024, Hochul paused implementation, fearing a political fallout. She quickly reinstated the policy after the November 2024 election, with the toll reduced from $15 to $9.
Six months since the tolls switched on, the early results suggest congestion pricing works. Yet the policy, 75 years in the making, almost never happened and is still being threatened by a Trump administration eager to terminate the program and to exert control over the president's home town.
The aim of congestion pricing is twofold: to reduce the number of cars on the road, easing traffic and pollution, and to raise sorely needed funds for the city's ailing public transit network. Manhattan boasts the densest transit network in the western hemisphere, but its subway signals are nearly a century old and its dedicated bus lanes relatively scarce. Millions rely on public transit daily, yet over 25% of trains and buses are delayed, and the system remains short of legally mandated elevators at dozens of stations.
The congestion toll is expected to raise $500m annually – funds earmarked for long overdue upgrades. So far, revenue is on target. While it will take time for these investments to reach riders, they are expected to make daily commutes faster and more reliable for residents across the city. And in the long term, easing congestion on Manhattan's streets could pave the way for new bike lanes, expanded pedestrian zones, and dedicated bus corridors that could transform how New Yorkers get around.
In the meantime, public transit ridership has reached its highest level since the pandemic. Buses are moving up to 20 percent faster on routes through Manhattan. 'We campaigned for congestion pricing to fix the subway,' said Danny Pearlstein, policy and communications director at the grassroots organization Riders Alliance. 'But what it's doing right now, most notably, is speeding up some of the worst and slowest and least reliable bus commutes in the United States.'
'People taking very long distance commuter buses, getting up at 5 in the morning, spending a couple hours on the bus, some of them are shaving off 10 or 15 minutes in each direction every day,' Pearlstein said. 'That's incredibly precious time back in their lives, and they're paying nothing for it.'
So are more people just paying to drive, or is congestion actually down? Since January, an average of 70,000 fewer vehicles have entered the congestion zone each day, according to the MTA. That translates to roughly 2m fewer cars on the road every month. Traffic is down moderately; vehicles are moving between 5 and 10% faster during peak hours in 2025 compared with the same period last year.
While it's still too early to draw firm conclusions about the policy's environmental impact, early comparisons with London offer a hint of what may be in store. Within the first year of implementing congestion pricing, CO2 emissions fell by 15.7%, according to an estimation by Transport for London.
Even without hard local data yet, Sam Schwartz, a traffic engineer and former city traffic commissioner, argues the logic is clear: 'If you have fewer vehicles moving at a faster speed, idling less, then there's less pollution.'
There have been other immediate effects. Noise complaints along Manhattan's busiest streets have dropped by 70%. 'There's less frenetic energy on the streets than there was before,' noticed Stan Avedon, the manager from NYC Velo.
Perhaps the most dramatic transformation has occurred outside the toll zone. In Queens, traffic crashes in Astoria and Long Island City have fallen by 27%, with injuries down 31.4%. The reason, Schwartz says, is geographical.
'It's no surprise to me that Long Island City and Astoria would be the biggest beneficiaries of congestion pricing,' he said. That part of Queens is served by three crossings into Manhattan within a short distance but previously, only one, the Queensboro Bridge, was toll-free. Now, with tolls applied regardless of the entry point, more drivers are staying on the highway instead of diverting through local streets to avoid charges.
While new to the US, congestion pricing has worked for decades in cities like London, Stockholm and Singapore. The policy faces early opposition everywhere, but quickly blends into the urban fabric and gains support as its benefits become visible.
New York is following a similar path. As implementation neared post-pandemic, suburban politicians began to push back, arguing the new toll would hit working class commuters hardest amid steep inflation and anxiety over the cost of living.
That line of attack was familiar to those who had long followed the debate. '[The opposition's] argument boiled down to: poorer drivers are going to be affected by this,' said Gersh Kuntzman, the editor-in-chief of Streetsblog NYC, a local outlet dedicated to covering mobility in the city. 'That's a classic political misdirect that we at Streetsblog are constantly pushing back on, because it's an inherent lie that opponents of congestion pricing are speaking on behalf of the working man, the working woman of New York City. All of the studies of census data and mobility data show that the vast majority of people who are subject to the toll are significantly wealthier than their transit-using neighbors.'
The numbers bear that out. For every low-income driver forced to pay the toll, 50 low-income New Yorkers will benefit from the toll through improved public transit, according to an analysis by the Community Service Society.
And many of the fears surrounding congestion pricing's unintended consequences have not materialized. Preliminary data shows no increase in truck traffic in the Bronx, where advocates worried about spillover congestion and pollution if drivers sought to skirt the tolled zone.
Concerns that riders would abandon taxis to avoid the added $0.75 congestion fee have also proven unfounded. January was the most prosperous month for taxis since the pandemic began, with trips up 19% within the toll zone. Uber and Lyft trips have held steady.
Fears about wider economic impacts haven't come to pass either. 'Restaurants and Broadway ticket sales are up. Business is up. Commercial leasing is up. All of these things that people were concerned about really haven't come to pass, and all of the benefits that people were hoping would appear have, in fact, come to pass,' said Ben Furnas, executive director of advocacy nonprofit Transportation Alternatives.
Though experts generally agree the program is an early success, plenty of hostility toward the toll remains. A daily driver from New Jersey expressed her discontent as she exited her vehicle on the way to work downtown: 'I hate it. I hate having to pay, and traffic is exactly the same.' A number of other drivers told the Guardian they felt traffic hadn't changed.
For a policy this ambitious, it's not surprising that the response is not unanimous. But what was once enormously contentious has largely been accepted as a fact of life. Public sentiment has greatly improved since it was installed – jumping 10 points in approval ratings in one Sienna College Research Institute poll to 42% in March. Now, some of the strongest support comes from the very drivers most affected, with 66% of those entering the toll multiple times a week backing the toll, according to a poll by Morning Consult.
'What was surprising to people who hadn't been paying attention was how quickly it worked. And that's why everyone I know has a story, or many stories, of people who said 'I didn't think it would make a difference, or I outright opposed it, but now I support it,'' said Pearlstein.
Despite its success, the program has drawn fierce opposition from conservatives. President Trump and his Department of Transportation secretary, Sean Duffy, are leading efforts to revoke the federal approval granted in 2023 under Joe Biden. 'CONGESTION PRICING IS DEAD,' Donald Trump wrote on his social media platform Truth Social back in February. 'Manhattan, and all of New York, is SAVED. LONG LIVE THE KING!'
The federal government's sudden pivot is less about policy than politics. 'Federal bureaucrats have trashed the program because they don't want to see Democratic leaders succeed in adopting a policy that works,' said Pearlstein.
The feeling from Washington to Wall Street is that Trump has already lost the fight. 'Everything we've seen suggests that congestive pricing is here to stay. From the fact that the federal attorneys leaked accidentally an internal memo explaining how weak their case was because it's based on outlandish arguments, and most recently, that the MTA was able to sell half a billion dollars in bonds backed by toll revenue because the bond market is confident that the fee is here to stay.'
If the program is pulled, it would leave a $15bn hole in the MTA's capital budget, potentially forcing alternatives like a new business payroll tax or a broader sales tax.
But the stakes go beyond funding, to a battle over states' rights and the limits of federal power.
'A really big issue is at stake that is so much bigger than congestion pricing: can the federal government, after giving approval to something that was undertaken under one set of rules, suddenly, upon a change of administration, withdraw that approval?' noted Kuntzman. 'If that becomes a precedent, there's a potential for a real logjam of stuff getting done in this country.'
The Trump administration's most recent salvo to gut the program has been blocked by a court's temporary injunction. In the meantime, New York still faces a slew of lawsuits from outside the city and in New Jersey. For now, the MTA is successfully fighting them off.
'Congestion pricing isn't just surviving, it's thriving. We're pleased that Judge Liman has put a stop to threats by Washington intended to deprive New Yorkers of the benefits of the program–less traffic, safer streets, cleaner air, and better transit,' said the MTA's chair and CEO, Janno Lieber, in a statement.
'It's been a success. It's not going to be taken out without a lot of people complaining. There are lives that have been saved and people who didn't get injured, there's property that didn't get damaged, there are lungs that didn't get polluted. All of those things are benefits that we're reaping from this,' said Schwartz.

WhatsApp to introduce adverts to its mobile messaging
WhatsApp is planning to introduce paid advertising features to its mobile messaging service around the world. The business, which is owned by Meta, the American technology giant behind Facebook and Instagram, said the feature would be rolled out globally in the coming months. WhatsApp, which has previously boasted about its lack of advertising, said that adverts would be kept separate from the main conversation area of its app, and would instead appear in the 'status' section, where users can already follow 'channels' run by businesses. The service has about three billion monthly active users, including about 200 million businesses and the move is likely to be lucrative for Meta, but could also prove contentious. Meta, then called Facebook, bought WhatsApp for $19 billion in 2014. It is still the group's largest purchase. Before this, Brian Acton, co-founder of WhatsApp, had said 'no ads' was part of the company's mission statement. WhatsApp had denied reports in 2023 that Meta was considering an advertising model for the messaging service. The new advertising features on WhatsApp bring it closer to Facebook and Instagram. Businesses with 'channels' on the mesaging service will be able to promote adverts on the updates tab of the app, and will also be able to charge a subscription fee for users to access additional content. WhatsApp is expected to take a 10 per cent commission for this. Companies will also be able to advertise via a 'status update' with links to products and services, similar to the stories function on Instagram, and will be able to pay to promote their channel. The service already provides services to businesses such as a customer service messaging. WhatsApp said: 'These new features will appear only on the updates tab, away from your personal chats.' It added that advertisers would not be able to access the content of users' messages. 'Your personal messages, calls, and statuses remain end-to-end encrypted, meaning no one (not even us) can see or hear them.' It said it would allow access to users' information 'like your country or city, language, the channels you're following, and how you interact with the ads you see' for its advertising data. 'We will never sell or share your phone number to advertisers. Your personal messages, calls and groups you are in will not be used to determine the ads you may see,' WhatsApp said in a post about the new services. 'We've been talking about our plans to build a business that does not interrupt your personal chats for years and we believe the updates tab is the right place for these new features to work.' Having faced criticism for installing an unremovable 'ask Meta AI' function recently, WhatsApp appears to be aware of the potential for the move to alienate users. The WhatsApp boss Will Cathcart said it 'won't affect your inbox … if you're only using WhatsApp for messaging, you're not going to see this.' The updates tab is used by 1.5 billion people a day but Cathcart said it was 'not particularly popular' in the UK compared with other parts of the world. Meta has been sued by the Federal Trade Commission, a US regulator, which alleges it illegally acquired Instagram and WhatsApp to stifle competition. Mark Zuckerberg, Meta's founder and chief executive, has pushed back on the claims, stressing that Meta faced intense competition from YouTube and TikTok, the Chinese-owned video-sharing app. This was evidenced by a surge of traffic that Facebook and Instagram experienced when TikTok was briefly taken offline in January, Meta has argued.

EchoStar soars 50% after report Trump urged EchoStar, FCC chair to reach deal on licenses
NEW YORK, June 16 (Reuters) - Shares of EchoStar (SATS.O), opens new tab rose as much as 50% on Monday following a late Friday Bloomberg report that U.S. President Donald Trump urged EchoStar Chairman Charlie Ergen and Federal Communications Commission Chair Brendan Carr to reach a deal over the fate of the company's wireless spectrum licenses. The telecommunications services company's stock also surged after the bell on Friday due to the report, which said Trump met on Thursday with Ergen and he telephoned Carr, who came to the White House to join the meeting. EchoStar did not immediately respond to a request for comment. The FCC told EchoStar in May it was investigating the company's compliance obligations to provide 5G service in the U.S. EchoStar has been trying to protect its wireless spectrum licenses from the threat of revocation by the FCC. EchoStar has disclosed that it missed roughly $500 million in interest payments and cited uncertainty around the FCC review. UBS analysts in a Sunday note said they believe the recent developments "suggest the forfeiting of Echostar's airwaves is less likely and brings spectrum valuation back into focus." They noted they expect interest from wireless carriers in EchoStar's spectrum licenses "given the shortage of near-term spectrum opportunities and the compatibility of Echostar's airwaves with existing network equipment/deployments," such as those with T-Mobile US (TMUS.O), opens new tab and AT&T (T.N), opens new tab. Still, the analysts wrote that with the current situation unresolved, their "neutral" rating on the stock remains. The stock hit an intraday high of $25.29 on Monday after closing on Friday at $16.84. Through Friday's close, EchoStar's stock had shed about 30% of value since the FCC notified, opens new tab the company of its probe.

False Claims Act enforcement expands amid shifting white-collar landscape
June 16, 2025 - Although the current administration has deprioritized white-collar enforcement in some traditionally active areas, False Claims Act ("FCA") activity remains robust — and is poised for expansion. The executive branch has signaled that it will pursue FCA cases in new areas, including diversity, equity and inclusion ("DEI") initiatives, antisemitism on university campuses, transgender issues, and customs and tariffs compliance. These developments signal heightened exposure for a wide range of institutions, from corporations to universities to healthcare providers. Meanwhile, enforcement in traditional FCA strongholds — such as healthcare — continues unabated. Below, we discuss these emerging and continued FCA risks. From Jan. 1 through May 31, 2025, DOJ announced approximately 128 FCA settlements totaling approximately $1.257 billion — a pace consistent with enforcement under the prior administration. DOJ has shown no signs of scaling back pending matters, signaling continued FCA scrutiny across key sectors. Healthcare and Paycheck Protection Program ("PPP") cases remain dominant, representing 90 of the 128 settlements (~70%) and accounting for over $1.04 billion — more than 80% — of the total recoveries to date. The emphasis on healthcare and PPP cases is in line with the prior year, when DOJ collected $1.67 billion from healthcare-related settlements and $250 million from pandemic fraud-related actions. False Claims Act Settlements and Judgments Exceed $2.9B in Fiscal Year 2024, U.S. Dep't of Justice: Office of Public Affairs (Jan. 15, 2025). The importance of whistleblower actions under the FCA's qui tam provisions also remains clear: At least 65% of the settlement value so far in 2025 stems from relator-initiated cases. DOJ has also initiated new healthcare actions. Recently, DOJ filed an FCA suit against three of the country's largest insurers — Aetna, Elevance, and Humana — as well as three major insurance brokers — GoHealth, SelectQuote, and eHealth. Hannah Albarazi, "Aetna And Humana Accused Of Medicare Kickbacks And Bias," Law360 (May 1, 2025). The complaint alleges a years-long scheme by these insurers to provide kickbacks to insurance brokers who in return allegedly funneled seniors into the Medicare plans most profitable for the insurers. Although no Answer has been filed yet, the press has reported that the defendants dispute the allegations and intend to fight the case in court. "Trump's DOJ Accuses Medicare Advantage Insurers of Paying 'Kickbacks' for Primo Customers," KFF Health News (May 19, 2025). This case was initially brought by a relator under the FCA's qui tam provisions, but DOJ intervened and unsealed it on May 1, 2025. This case is a strong signal that the healthcare sector will remain a central focus of the new administration's FCA enforcement priorities. Recent DOJ pronouncements indicate that FCA liability is expanding into areas not previously associated with fraud enforcement, including DEI initiatives, antisemitism, transgender issues, and tariffs. Just one day into the new administration, the President signed an Executive Order which instructed all executive agencies to enforce civil rights laws and eliminate what it characterized as unlawful DEI programs. Exec. Order No. 14173, 90 Fed. Reg. 8633 (Jan. 31, 2025). Building on that Executive Order, the Attorney General issued a February 2025 memorandum reaffirming DOJ's position that many DEI initiatives violate federal civil rights laws. Memorandum re: Ending Illegal DEI and DEIA Discrimination and Preferences, Office of the Attorney General (Feb. 5, 2025). The memorandum directed the DOJ Civil Rights Division to pursue investigations and penalties against private companies and academic institutions that receive federal funds whose DEI practices unlawfully "discriminate, exclude, or divide individuals based on race or sex." Id. at 1. And on May 19, 2025, the U.S. Deputy Attorney General issued a memorandum (the "Memo") announcing a Civil Rights Fraud Initiative (the "Initiative"). Memorandum re: Civil Rights Fraud Initiative, Office of the Deputy Attorney General (Feb. 5, 2025). The Memo instructs DOJ to pursue FCA actions against any federal contractor or federal funds recipient that "knowingly violates federal civil rights laws." The Memo calls for coordination with other federal and state agencies and sets out potential enforcement targets, including: •Federal funding recipients or federal contractors that falsely certify compliance with civil rights laws while maintaining DEI programs that allegedly assign benefits or burdens based on race, ethnicity, or national origin. •Federally funded universities that allegedly permit antisemitism on campuses. Critically, the Memo also "strongly encourages" private plaintiffs to file qui tam suits under the FCA — effectively deputizing employees, students, and other insiders as enforcement partners. Id. at 2. The Memo highlights the potential for private individuals to share in any monetary recovery that results from these cases. Indeed, under the FCA, whistleblowers can receive up to 30% of any monetary recovery, which — under the treble damages provision — could total several times the value of the federal contract or grant at issue. For federal contractors, universities and other federal funds recipients, the enforcement implications are significant. Organizations found in violation of the FCA can face treble damages and per-claim penalties ranging from $14,000 to $28,000, in addition to reputational harm and follow-on litigation. Adjustments for Inflation to Civil Monetary Penalties, 15 C.F.R. § 6.3 (2025). DOJ has already launched investigations under this new Initiative. According to recent reports, it is probing Harvard University's admissions practices for potential FCA violations tied to the Supreme Court's Students for Fair Admissions decision, which struck down race-conscious admissions. On Jan. 28, 2025, President Trump issued an Executive Order directing federal and state agencies to take steps to restrict medical treatments related to gender transition for minors. Exec. Order No. 14173, 90 Fed. Reg. 8771 (Feb. 3, 2025). The Executive Order targets the use of puberty blockers, hormone therapies, and transgender surgeries for individuals under the age of 19. On April 22, 2025, the Attorney General signaled that DOJ would use the FCA to enforce the principles of the Executive Order in a memorandum titled "Preventing the Mutilation of American Children." Memorandum re: Preventing the Mutilation of American Children, Office of the Attorney General (Apr. 22, 2025). This memorandum "direct[s] the Civil Division's Fraud Section to pursue investigations under the False Claims Act of false claims submitted to federal health care programs for any noncovered services related to radical gender experimentation." Id. at 4. According to the memorandum, "[f]alsely billing the government for the chemical or surgical mutilation of a child is a violation of the False Claims Act and is subject to treble damages and severe penalties." Id. at 4. Notably, the memorandum encourages whistleblowers to come forward under the FCA's qui tam provisions, again highlighting DOJ's interest in leveraging insider information to identify and pursue potential violations. Id. at 4. Finally, the May 19 Memo also signals DOJ's new focus on transgender issues. The Memo notes that federally funded universities could violate the FCA if they maintain policies that "allow men to intrude into women's bathrooms," or "require women to compete against men in athletic competitions." Memorandum re: Civil Rights Fraud Initiative, Office of the Deputy Attorney General (Feb. 5, 2025). In line with the Trump administration's announcement of a sweeping new tariff regime in April 2025, DOJ officials have emphasized that FCA enforcement will play a key role in customs and trade compliance. In a February speech, Michael Granston, Deputy Assistant Attorney General in DOJ's Commercial Litigation Branch, called the FCA a "powerful tool" to address tariff evasion and foreign trade violations. As tariffs rise and enforcement intensifies, the risk of FCA exposure in customs-related matters is expected to grow significantly. With these developments, federal fund recipients should expect an uptick in both DOJ scrutiny and qui tam activity related to civil rights compliance, transgender issues, and tariff enforcement. Given these new and increasing risks, federal contractors and recipients of federal funds should consider reviewing and, as needed, revising and enhancing their policies and procedures, including with respect to internal whistleblower channels for reporting violations, to ensure continued compliance with the FCA and federal civil rights laws. With respect to transgender care, healthcare providers and organizations that offer transgender care to minors should assess their billing practices and coverage determinations for compliance with DOJ's new FCA enforcement posture. Particular attention should be paid to documentation, coding, and any federal program reimbursements tied to treatments for individuals under the age of 19. Finally, businesses involved in importing goods should proactively assess their compliance programs, including tariff classification and documentation procedures, to mitigate the risk of FCA scrutiny. With DOJ increasingly linking trade enforcement to FCA liability, importers should also prepare for heightened oversight and the possibility of whistleblower-driven investigations.
