2008 Malegaon blast case: Court says no reliable proof to warrant conviction; here's why all 7 accused were let off

Time of India20 hours ago
NEW DELHI: A special NIA court on Thursday acquitted former BJP MP Sadhvi Pragya Singh Thakur, lieutenant colonel Prasad Purohit, and five others in the 2008
Malegaon bomb blast
case.
The court cited lack of evidence and procedural lapses in invoking the UAPA, the Arms Act, and other charges in the 17-year-old blast case, which had claimed six lives.
'I have been saying this since the beginning. I was summoned, and I went to the ATS because I respect the law. I was detained illegally for 13 days and tortured. I was living my life as a sanyaasi and was labelled a terrorist. My life was destroyed by the allegations. The case has been going on for 17 years, and I have struggled. Ye bhagwa ki Vijay hui hai. Hindutva ki Vijay hui hai. (This is the victory of saffron. This is the victory of Hindutva)' .
Pragya Singh Thakur said after the verdict
Why were the accused acquitted?
The court stated that it cannot convict anyone merely on perception and moral evidence; there must be cogent evidence.
"Mere suspicion cannot take the place of real proof. No religion teaches violence…Terrorrism has no religion, but the court cannot convict on mere perception and moral, there has to be cogent evidence," the court said.
The court ruled that the Unlawful Activities (Prevention) Act (UAPA) could not be applied as the sanction for prosecution was not obtained as per legal requirements. 'The UAPA will not be invoked in this case as the sanction was not taken as per rules. Both the sanction orders under the UAPA are defective,' the court observed.
The court said the investigating agency failed to prove that the motorcycle used in the blast belonged to Pragya Thakur.
It also observed that Thakur had renounced material possessions and become a sanyaasi two years before the blast.
While delivering the verdict, the court noted that although the prosecution established that a blast occurred in Malegaon, it could not prove that the bomb was planted in the motorcycle recovered from the scene.
The crime scene was not properly barricaded, leading to contamination, the court added.
It also noted discrepancies in the number of victims, and said that 'the injured were not 101 but 95, and there was manipulation in some medical certificates.'
On the alleged role of Abhinav Bharat, the court said there was no material evidence to support the prosecution's claims. 'Abhinav Bharat was used as a common reference by the prosecution. There is no evidence that its funds were used for terror activities,' the court said.
The court ordered the government to compensate each of the families of the six people killed with Rs 2 lakh, and Rs 50,000 each to the injured.
What we know about the 17-year-old case
On September 29, 2008, six people were killed and several others injured when a bomb allegedly strapped to a motorcycle detonated near a mosque in Malegaon city, Nashik, during Ramzan and on the eve of Navratri.
The ATS alleged that the motorcycle belonged to Thakur, and that Purohit brought RDX from Jammu and Kashmir and stored it in his home.
The investigation, led initially by the Maharashtra ATS under the late Hemant Karkare, led to the arrest of Thakur and Purohit in late 2008.
The ATS, for the first time, alleged the involvement of "saffron extremists" and linked the accused to a larger conspiracy, also naming them in connection with other blast cases.
Investigations into the Abhinav Bharat organisation suggested a network of meetings and alleged plans to avenge perceived atrocities against Hindus and create a "Central Hindu Government" (Aryavart).
The case was transferred to the NIA in 2011. In 2015, special public prosecutor Rohini Salian claimed she was instructed by the NIA to 'go soft' on the accused, resulting in a change in the prosecution team.
In May 2016, the NIA filed a supplementary chargesheet alleging that the ATS had planted RDX traces to frame Purohit. The agency also gave a clean chit to Thakur and others, citing lack of evidence.
Despite the NIA's findings, the special court proceeded with charges against seven accused under UAPA, though it dropped charges under MCOCA.

In BJP's Punjab push, Haryana CM Saini steals a march over CM Mann on Udham Singh martyrdom day

In a move that created ripples in political circles, Haryana Chief Minister and BJP leader Nayab Singh Saini visited Punjab's Sunam to pay tributes to Shaheed Udham Singh on his 86th martyrdom day on Thursday, hours before Punjab CM Bhagwant Mann and the AAP's national convener Arvind Kejriwal reached the legendary freedom fighter's native town in Sangrur district. The Haryana CM's surprise visit to the martyr's memorial not only took place before the Punjab government's function but was also marked with political symbolism. Sporting a saffron turban, Saini paid homage at the Shaheed Udham Singh Memorial, built over nearly 2 acre land in Sunam, and met the martyr's descendants. 'I pay tributes to this son of the soil who couldn't bear the Jallianwala Bagh massacre as a child and avenged it by killing Michael O'Dwyer (Punjab lieutenant governor during the 1919 Jallianwala Bagh massacre) in England. I salute him and his family's sacrifice,' the CM told media persons. In December 2023, the BJP-led Haryana government under then CM Manohar Lal Khattar had declared a state gazetted holiday on Udham Singh's martyrdom anniversary. As Saini replaced Khattar in March next year, July 31, 2024 marked the first time during the former's first term as the CM, when the day was observed as a state holiday. In contrast, for the past several years, Punjab observed only a restricted holiday on July 31. However, the Kamboj community, listed in the Other Backward Classes (OBC) category, and some government employee associations took up the matter this year with the AAP-led Punjab government, demanding the declaration of a state gazetted holiday on July 31. Udham Singh was from the Kamboj community. Sources said the Mann government was also under pressure to do it after Haryana's move. During his Sunam visit, Saini kept the focus on paying homage to Udham Singh. When reporters asked him about the Rs 113 crore bill sent by the Punjab government to Haryana for the upkeep and maintenance of Bhakra canal, he side-stepped the row, just saying, 'Talks are on with the neighbouring state. Both states will sit together to find a solution.' Saini, who belongs to the OBC, was accompanied by Punjab BJP working president Ashwani Sharma. After leading the BJP to a resounding win in the October 2024 Haryana Assembly polls, Saini, 55, has been going all out to boost his credentials as an OBC leader. Besides engaging with prominent OBC organisations and leaders from across the country, he has also been making frequent visits to Punjab. These moves, BJP sources said, are part of Saini's strategy to emerge as an OBC leader at the national level and expand his party's footprint in Punjab slated for the Assembly polls in early 2027. After the Udham Singh Memorial event, Saini also addressed local residents at a BJP-organised meeting. BJP state secretary Daaman Thind Bajwa said,'Our programme was scheduled early to avoid overlap with the Punjab government's function. CM Saini arrived around 10 am via chopper and left at around 11.30 am for Sirsa by road as weather conditions in Sirsa didn't allow flying,' she said. The Punjab government's event was held later in the day in Sunam's grain market area, which was addressed by CM Mann and Kejriwal after they paid floral tributes at the memorial. Sources said that due to waterlogging caused by heavy rainfall in Sunam, the duo had to ride a chopper to reach the grain market, barely a kilometre away from the memorial, which reflected poor drainage in the town. In April this year, Saini had addressed a gathering in Derabassi in Mohali, where Gurdarsan Singh Saini, son of former Akali stalwart Gurnam Singh Derabassi, joined the BJP. Saini also participated in the Saini community events in other Punjab towns like Ropar and Kharar in March-April and had campaigned in Ludhiana in June for the BJP's Ludhiana West bypoll candidate Jiwan Gupta. During his visits to Punjab, Saini has sought to showcase the 'Haryana model' of governance, highlighting how his government has been providing minimum support price (MSP) on 24 crops. He has made this pitch in his Punjab events, trying to woo farmers and rural voters. With the Saini community having influence in nearly 15 constituencies across Punjab – especially in Ropar, Kharar, Derabassi, Mukerian, Banga, and Hoshiarpur – the Haryana CM's outreach in the state appears calibrated. 'The Saini community has always existed in Punjab, but ever since Nayab Singh Saini became CM, he has actively started connecting with them. It's good that the CM is introducing Punjab voters to the BJP's Haryana model,' said a state BJP leader, adding that Saini's Thursday visit also sought to send a political message. The BJP has been struggling to improve its standing in Punjab, with its erstwhile ally, Sukhbir Badal-led Shiromani Akali Dal (SAD), with whom it broke up in 2020, also reeling from poll debacles and factional feuds. – With inputs from Varinder Bhatia in Chandigarh

Daily Briefing: Tariffs, Pak factor and the waiting game

Good morning! Just hours before the August 1 deadline when US President Donald Trump's tariffs were to take effect, the White House announced a new set of 'adjusted' tariffs on more than 60 trading partners and the 27-member European Union. These tariffs will kick in on August 7. In his executive order, Trump said that the new tariffs are based on additional information he has received on the 'lack of reciprocity in our bilateral trade relationships', recommendations on foreign relations and national security matters, and the status of trade negotiations with some countries. The tariffs range between 10 and 40 per cent. Certain EU goods will be exempt from duties. Countries not mentioned in the new list will be charged a baseline 10 per cent tariff. For India, the rate stands at 25 per cent, as was announced a couple of days ago. Waiting game: Although the government has stated that it will study the implications of the 25 per cent tariff rate, the view in private is that India simply cannot afford to rush into a lopsided deal, an official told my colleague Anil Sasi. India has been striving to negotiate an agreement which maintains its edge over China. Notably, the July 31 order did not change the agreed-upon 30 per cent tariff on China. As of now, confusion persists on overall tariffs on India, given that Trump is yet to specify the 'penalties' for buying Russian oil. With new announcements every few days and changing US policy, such as a proposed BRICS tariff, there's a giant question mark on the sanctity of any trade deal with the American administration. Given the current status of India's negotiations with the US, any agreement will likely be signed by September or October. Pak factor: New Delhi has also factored in Trump's growing closeness to Pakistan. It's believed that Trump has not taken kindly to India's fact-checking of his claims that he brokered the ceasefire between the duelling nations. Whereas, Pakistan's outreach has included public praise, including a recommendation for a Nobel Peace Prize for Trump, and investments in the President's cryptocurrency business. Now, Trump has announced a new deal with Islamabad to develop Pakistan's oil reserves. 🎧 For more on the tariffs, tune in to today's '3 Things' podcast episode. On that note, let's get to the rest of today's edition. On September 29, 2008, a bomb went off during Ramzan in an area with a sizeable Muslim population in Malegaon, about 100 km northeast of Maharashtra's Nashik. The blast killed six people and injured nearly 100 others. On July 31, Special Judge A K Lahoti acquitted all seven accused in the case, including former BJP MP Pragya Singh Thakur and Lt Col Prasad Purohit. The court observed that while there was 'strong suspicion' about their role in the blast, that cannot be a substitute for 'legal proof'. The investigation: The Maharashtra Anti-Terrorism Squad (ATS), led by IPS officer Hemant Karkare, first probed the case. They had filed a chargesheet in 2009, naming 11 accused, claiming that the perpetrators had held several meetings across cities. The National Investigation Agency (NIA) took over the case in 2011. In its 2016 chargesheet, the NIA criticised the ATS probe, re-recording witness statements and rejecting the accused's confessions to the ATS. The trial: In court, witnesses turned hostile, especially on the point of conspiracy meetings. A crucial piece of evidence — recordings on an accused's laptop — was deemed 'unreliable'. Moreover, the court also raised doubts about the procedure adopted to record voice samples from the accused. Read all about how the case fell. 'Delhi is the national capital. And this is not how a national capital should be. Most people living here are from the labour class because things like electricity and water are free. There is nothing wrong with that. But India is a powerful country, and if its capital looks like a slum city, how are you going to project it?' Lieutenant Governor of Delhi V K Saxena said the above words at the latest edition of Expresso, where we sit down with the who's who for an all-inclusive chat. L-G Saxena was joined by former NITI Aayog CEO Amitabh Kant to talk about the challenges of urbanisation, making Delhi a world-class national capital and inculcating cultural literacy in the country. Pak links: India's security establishment is in the process of examining the devices — three mobile phones and two LoRa (long range) communication sets — recovered from the Pahalgam attackers killed in Operation Mahadev. Information in the devices is key to establishing the Pakistan link of the terrorists. Crucially, investigators have recovered photos of two Pakistani NADRA cards, which are national identity cards issued by the Pakistan government's National Database and Registration Authority. Tata Consultancy Services (TCS)'s mass layoffs have prompted a pertinent question: In the artificial intelligence (AI) age, is the Indian IT sector still a beacon of opportunity? In today's Dis/Agree column, we asked two experts to weigh in. Srinath Sridharan, a corporate advisor and author, asserts that India's IT story is far from over. He writes that the real test is how quickly India can embed AI literacy and advanced skills across its workforce. Shashank Reddy, managing partner at Evam Law & Policy, writes that with the advent of AI, mass hirings in the tech industry may be a thing of the past. 'No longer can one sector take on the burden of upholding India's middle class and economic prospects…' That's all for today, folks! Happy weekend-ing! Sonal Gupta
