Gerakan's No 2 granted ad-interim stay of execution in LGE defamation suit
PETALING JAYA : Gerakan's Oh Tong Keong has been granted an ad-interim stay of execution of a High Court decision ordering him to pay damages to Lim Guan Eng for falsely accusing the former finance minister of helping a concert organiser obtain tax exemptions.
On Sunday, FMT reported that Oh, who is the party's deputy president, had filed an application for a stay of execution on May 22 pending the outcome of his appeal against the High Court's verdict which awarded Lim RM550,000 in damages.
Penang Gerakan today said that it had successfully raised RM200,000 to help Oh pay the damages.
'In addition, several generous individuals have stepped forward to temporarily advance another RM300,000, allowing us to fully gather a total of RM500,000,' it said in a Facebook post.
The party's state chapter said that it would continue to raise funds to repay the advanced funds.
Oh's Lawyer, Chai Ko Thing, last week said the appeal was filed on May 21.
On May 7, the High Court awarded Lim RM550,000 in damages after ruling that Oh had falsely accused him of helping a concert organiser obtain tax exemptions while the former was the finance minister.
Justice Kenneth St James ruled that Oh had defamed Lim at a press conference on Sept 25, 2019, and through a press release sent out via Penang Gerakan's official email address. The remarks were later published by China Press, which was also found liable.
Oh had questioned why Lim had granted tax exemptions to WGW Entertainment Sdn Bhd and its owner, Hendrik Huang, for a Mandopop concert at Spice Arena.
The judge found that Oh had no basis for his claims and gave no evidence that Lim knew Huang or had granted any tax privileges.
He said although Oh's statements were framed as questions, they were found to be defamatory in nature and did not qualify as fair comment.
Oh was also ordered to publish an unconditional apology to Lim in China Press, online and in print. He was also barred from repeating the claims.
China Press was ordered to pay RM150,000 in damages, RM80,000 in costs, and interest at 5% per annum.

Honour court's dignity and rule of law, Sabah Law Society says amid Zara Qairina's bullying trial involving minors
KUALA LUMPUR, Aug 19 — The Sabah Law Society (SLS) has yesterday reminded the public and media to observe legal safeguards in the Children's Court proceedings involving juveniles charged in connection with the Zara Qairina Mahathir case today. The umbrella body for lawyers in the state acknowledged the strong emotions surrounding the case, saying Malaysians have spoken out and refused to stay silent. 'Sabahans and all fellow Malaysians have risen, spoken out, and refused to stay silent. That fire, that conscience, that unwillingness to look away, is something that commands respect. 'Now let that same strength show itself in discipline, by honouring the dignity of the Court and the rule of law,' its president Datuk Mohamed Nazim Maduarin said in a statement here. SLS said Section 15 of the Child Act 2001 prohibits the publication or sharing of any information that may lead to the identification of a child involved in such proceedings. This includes names, photographs, addresses, schools, or any other particulars that could reveal their identity, SLS said. 'We gently remind the public that even well-intentioned actions can inadvertently breach the law,' it added. It said Section 15 of the Child Act 2001 requires proceedings involving children to be conducted in camera to ensure justice is carried out according to the law. SLS stressed that respecting court processes is necessary to ensure proceedings are not jeopardised and justice is delivered properly, fairly, and beyond challenge. Five teenage girls are scheduled to be charged in the Children's Court in Kota Kinabalu this morning in connection with the bullying case of student Zara Qairina.

MyJalan app proves successful as 11,860 road damage complaints resolved, says works minister
KUALA LUMPUR, Aug 20 — The Works Ministry (KKR) has resolved 11,860, or 95.19 per cent, of the 12,459 road damage complaints received through the MyJalan app, said Minister Datuk Seri Alexander Nanta Linggi. The remaining 599 complaints (4.81 per cent) are still under investigation or pending action, he told the Dewan Rakyat during the winding-up session for his ministry on the 13th Malaysia Plan (13MP) today. Since the app's launch in August 2023, 54,330 users have registered and submitted 40,938 complaints. Of these, 28,479 cases (69.57 per cent) were redirected under the No Wrong Door policy to relevant agencies, as they involved roads outside KKR's jurisdiction. These include municipal, village, agricultural, state and private roads managed by local councils, the Housing and Local Government Ministry (KPKT), the Rural and Regional Development Ministry (KKDW) and state governments. On highway infrastructure, Nanta said traffic on the East–West Highway remains manageable based on 2024 census data. However, a RM100 million rehabilitation project is underway to upgrade road surfaces, lighting and structural components, with completion expected by 2026. The scope includes preliminary studies, land surveys, streetlight and traffic signal maintenance, and routine upkeep of both pavement and non-pavement infrastructure. He also noted that the Malaysian Highway Authority (LLM) has implemented Building Information Modelling (BIM) across all stages of highway projects. This includes the planning, construction, operations and upgrades, in line with the government's digital transformation and sustainability agenda outlined in the 13MP and National Construction Policy 2030. Since Jan 1, 2023, the BIM policy has been piloted on key projects including the Kuala Lumpur–Karak Highway widening, Kajang SILK Highway expansion, East Coast Expressway Phase 1 flood mitigation, Sungai Perak Bridge and selected rest areas along the North–South Expressway. LLM has initiated training for BIM roles such as managers, coordinators and modellers, and is developing BIM Infra Guidelines in collaboration with the Construction Industry Development Board (CIDB) and academic institutions.
