The tribunal found sufficient evidence and confirmed that the insurance policy was valid on the date of the incident. While a disability of 33% was initially assessed, the tribunal considered a functional disability of 10% in determining compensation. The award covers medical expenses, pain and suffering, loss of income, cost of assistance during recovery, and other costs. The tribunal directed the transport manager, MBMT and the Directorate of Insurance Maharashtra State, to jointly and severally pay Rs 4,17,890 with 9% interest per annum to the claimant. The order states that a portion of the compensation be invested in a fixed deposit for two years and the balance be paid directly to the claimant.
