Cops, smugglers clash, 1 dead in Raj encounter

Acting on a tip-off, the police intercepted them near Ghatmika village. Upon seeing the police, the smugglers opened fire. The police retaliated, leading to a gunfight that lasted over half-hour-long. The other smugglers fled the scene with the vehicle during the exchange.
Hasam, a resident of Kanwadi village, and his son Aashiq kept firing at the police along with their accomplices. Aashiq died on the spot due to bullet injuries, while Hasam was injured and later referred to RBM Hospital in Bharatpur.

Ghaziabad: The consumer forum granted partial relief to a transporter whose mini truck was stolen just four days before his vehicle insurance was due to expire. In a ruling issued on July 31, the District Consumer Disputes Redressal Commission (DCDRC) directed New India Assurance Company to pay 75% of the insured declared value (IDV) and Rs 5,000 in litigation costs and as compensation for the mental agony caused during the prolonged dispute. The petitioner, Lalman Singh, said his Tata 407 pickup truck was insured under a policy valid from July 1, 2013, to June 30, 2014. On June 26, 2014, just four days before the policy lapsed, the truck was stolen from near his residence in Indirapuram. Singh said that he lodged a police complaint the same day, and an FIR was registered on June 30. Despite submitting a report declaring the vehicle "untraceable", Singh's claim for the full insurance amount of Rs 7.3 lakh was rejected. I nstead, the insurance company released only Rs 5.3 lakh and promised to release the remaining amount later. When the pending amount wasn't paid, Singh approached the consumer forum. New India Assurance argued that the settlement had been completed in line with the policy terms, following an assessment by a certified surveyor. The company's counsel told the commission that Singh had signed a full and final agreement and therefore was not entitled to any further claim. The commission cited a Supreme Court ruling in the 2008 case of National Insurance Company vs Nitin Khandelwal and noted that in cases involving theft, insurance companies were required to pay 75% of the IDV on a non-standard basis, even when procedural lapses exist. The commission, led by president Praveen Kumar Jain and members Shailja Sachan and RP Singh, ruled that Singh was entitled to the shortfall in payment. It also took note of the delay and distress caused to the consumer, and ordered the insurance company to pay another Rs 5,000 in compensation. The insurance firm has been given 45 days from the date of the order to comply, failing which interest at 6% per annum would be levied on the unpaid amount.

Didn't see it, says witness, truck driver acquitted of double murder
Noida: A GB Nagar court has acquitted, Bulandshahr resident, Rajesh Kumar Sharma, the driver of a pickup truck, accused of killing two passengers in 2010 after the complainant admitted to not witnessing the incident and filing the case based on police information. A co-passenger testified that the accident occurred due to an unpreventable tire court ordered the cancellation of his bail bonds and released the sureties of their liabilities. Judge Mayank Tripathy (II) said that the prosecution failed to establish the culpability and involvement of the accused in the road accident that occurred in 2010, beyond doubt. "Only documentary evidence is not enough to prove the culpability of the accused unless it is substantiated by the witnesses' accounts and circumstantial evidence leading to the incident," the court observed, acquitting the accused of all the charges. The incident dates back to March 9, 2010, when a Tata 407 pickup truck lost balance and overturned. Two people, Kunwarpal Sharma and Kripal Singh, sitting in the driver's cabin, died on the spot. Prosecution witness 1 (PW1), Suresh, reiterated his statement that he lost his younger brother due to the negligence of the driver. However, when cross-examined by the defence, he admitted that he was not present at the accident spot. He also denied having entered into any out-of-court settlement with the accused, saying that he had already received compensation for his brother's death. PW2 Shaukin, told the court that they had asked the driver not to rush, but while reaching Pari Chowk, the tyre of the vehicle burst, and it lost balance. The prosecution declared him hostile, and during cross-examination, he said that the investigating officer never recorded his statement. Having heard both parties, the court concluded that not a single witness testified to the culpability of the driver in causing the accident deliberately or by negligence and accordingly decided to release him from all the charges.

Man, wife arrested for hacking father to death with axe
Ludhiana: A man and his wife allegedly hacked his father to death with an axe because he did not transfer ownership of his house to her. A case has been filed against the accused, Jugraj Singh of Jatana village and his wife, Renu Rani. Relatives of the accused handed them over to the police. The complainant, Bhinder Singh of Jatana village, said that his brother Balvir Singh lived with his wife Manjit Kaur, his son Jugraj Singh Raju, and daughter-in-law Renu Rani in the village. He added that in 2023, Renu Rani went to her parents' place in Majri village in a huff and demanded that her father-in-law, Balvir Singh, transfer ownership of the house to her. According to him, Jugraj Singh was an unemployed alcoholic while his brother worked as a shuttering contractor. He alleged that Jugraj sold Balvir's Tata 407 vehicle without informing him. He also allegedly sold shuttering equipment in his absence.
