Spectrum Care didn't report or investigate disabled resident's sexualised behaviour

The Health and Disability Commissioner has identified shortcomings at a disability care home, where sexual abuse, violence and self-harm occurred.
Deputy Commissioner Rose Wall has found Spectrum Care, a major disability care provider, breached the rights of three residents at one of its homes.
The complaints were lodged in 2021 by family members or guardians of the residents.
One resident, referred to as Mr D, who was in his 20s at the time, had an intellectual disability and fetal alcohol spectrum disorder (FASD).
The report said he had a history of repeated acts of violence, intimidatory and sexualised behaviour aimed at other residents, and a history of self-harm and suicide attempts.
Mr D's father, referred to as Mr C in the report, said he was concerned someone was going to get badly hurt if Spectrum did not step in to safeguard all involved.
He said despite complaints to Spectrum the situation was not addressed adequately, and Spectrum had not communicated adequately about incidents involving his son.
For example, Mr C said that he was not told when Mr D attempted to commit suicide three times.
Mr C does not hold a welfare guardian order for Mr D.
The report said Mr D was quite independent and able to communicate his needs clearly, unless highly anxious, and had said he wanted to advocate for himself.
A complaint was also made by the family of a man known in the report at Mr A.
Mr A was in his 60s at the time, and non-verbal. He had contracted measles as a child and had been diagnosed with developmental delay and an intellectual disability.
Mr A's family said the mix of different disabilities and ages in the facility was inappropriate and unsafe.
They said Mr D had been physically and sexually violent toward Mr A and others in the facility.
Mr A's family said they asked Spectrum to control the situation and safeguard Mr A from Mr D's behaviour, but Spectrum failed to do this.
They said staff at the facility had not reported all the incidents, had failed to tell them about incidents, and had not considered any of the incidents urgent, including sexual assault.
A third resident, Mr F was in his 20s at the time, and had an intellectual disability, fetal alcohol spectrum disorder and oppositional defiant disorder.
Mr F's welfare guardian said that he was not getting the 24/7 care he was entitled to, and the guardian had not been told of serious incidents in a timely manner.
This included when Mr F was moved to another Spectrum facility.
Wall said in her report that Spectrum was in breach of the Code of Health and Disability Services Consumers' Rights.
She said Spectrum did not have an "optimal mix of residents" at the facility, and following a serious incident in April 2021 should have considered relocation of residents a priority.
She recommended Spectrum apologise to the complainants, develop a formal whānau communication strategy and a procedure for consumers who were independent, not under any formal orders and didn't want information shared with their family.
Spectrum accepted the Deputy Commissioner's recommendations, and had made a number of changes.
It said it would now classify each incident of sexualised behaviour as a serious incident, and would complete a serious incident investigation for each.
It had also introduced a new feedback system, brought in a new incident management system, and increased training for staff.

Medsafe is considering a crackdown, warning many are sold based on unproven claims. It hopes to have several of them - and similar ones that may crop up - classified as prescription medicines, making it illegal to import them without a prescription. In a written submission to the Medicines Classification Committee, Medsafe said peptides were being bought from websites that made claims they could help with "cognitive enhancement, hair growth, libido enhancers, sexual dysfunction, immune enhancers and cancer treatment", and more. However, there was often little, if any, evidence to back up the claims. Most had not been tested for safety and efficacy on humans. Medsafe could not seize peptides at the border, if they were not classed as prescription medicine. Instead, it released the products to the purchasers with a "high-risk medicine letter". "This is posing a risk to health, as the product's quality, efficacy and interactions with other medicines is unknown," the submission said. Because new peptide substances were created all the time, Medsafe asked the committee to class whole groups of them as prescription medicines, so future versions that fell within the group would still be covered. Many websites that sold peptides claimed to sell them "for research purposes", but customers intended to use them therapeutically, the submission said. Fifty-six parcels were intercepted at the border in the year to May, containing peptides or prescription medications known as selective androgen receptor modulators (SARMS). Customs said it couldn't say how many got through without interception. Medsafe said the classification review would take into consideration the safety and appropriateness of being able to import these products, as well the risks of limiting access. The committee considered the submission at a meeting on Wednesday and its decision has not been made public yet. The final decision on medicine classification changes will be made by the Minister of Health at the committee's recommendation. Photo: Supplied/ABC A University of Auckland senior research fellow is calling for social media platforms to introduce enforced age limits, to help protect young people from harm. A briefing from the Public Health Communication Centre has outlined growing evidence social media use is linked to a range of mental and physical health problems. It highlights policy options for addressing these harms, including restricting access to social media for those under 16. Currently, the age limit to join the majority of platforms like Facebook, Instagram and Snapchat is 13, but it is not enforced. "Introducing an age restriction is the only comprehensive measure that addresses the full range of social media-related harms to young people," said author Dr Samantha Marsh. "It also empowers parents to set boundaries and shift social norms in a positive direction." Marsh said while social media may offer some benefits for some young people, such as helping connect with peers and find support, she warned these must be weighed carefully against mounting evidence of harm. "There's a huge imbalance. The weight of evidence showing that these platforms can negatively affect youth mental health has become too great to ignore," she said. "We now have years of consistent findings: young people who spend more time on social media are more likely to experience depression, anxiety, and disrupted sleep. "These findings come not only from surveys, but also from longitudinal studies, randomised trials, and robust systematic reviews." Marsh said any changes to social media access should be accompanied by a coordinated effort to provide on and offline support for vulnerable youth, as well as empowering communication campaigns. The briefing's release coincides with the government's inquiry into online harms experienced by young people, which is currently open for public consultation, with submissions closing on 30 July . Marsh said the inquiry was a vital opportunity to build healthier digital environments. "Political decision-makers now have a strong enough evidence base to act. Delaying access to social media and supporting youth and whānau through a coordinated public health response is the path forward."

North Shore Hospital in Auckland. Photo: rafaelbenari/123RF A new outpatient hysteroscopy service at Auckland's North Shore Hospital will help gynaecological patients get a faster diagnosis. Health Minister Simeon Brown said it combines their first specialist assessment (FSA) and diagnostic procedure into a single visit. "This is a practical, patient-focused pathway that means women can get the answers they need sooner, without the stress and delays of multiple appointments or hospital admission," Brown said. A hysteroscopy is a procedure used to look inside the womb (uterus) and at the lining of the womb. A sample (biopsy) of the lining is usually taken as part of a diagnostic hysteroscopy, to look for abnormalities. Patients with symptoms such as abnormal vaginal bleeding, irregular periods and infertility might be referred for a hysteroscopy. "Previously, women needing a hysteroscopy would attend an initial specialist appointment and then wait weeks to undergo the procedure in theatre under general anaesthetic." Brown said the new approach removed that delay for women suitable for the treatment. "Now, women needing an uncomplicated hysteroscopy procedure can choose to have both the specialist assessment and the procedure in a single outpatient appointment. "That means fewer hospital visits, less time off work or away from family, and a much more streamlined experience. "For women with a high suspicion of cancer, this pathway can reduce the diagnostic timeline by two to six weeks compared to traditional models. That time could make all the difference." Health Minister Simeon Brown. Photo: RNZ / REECE BAKER North Shore Hospital expects to deliver around 60 outpatient hysteroscopy clinics over the next 12 months, with approximately 240 procedures. "Every outpatient procedure frees up valuable theatre space and clinical teams for patients who require more complex surgery. That's better for patients, and better for the whole system," Brown said. The new service meant a significant proportion of uncomplicated hysteroscopies that would have otherwise been performed in theatre under anaesthesia can now be done safely as outpatient procedures. "This is part of a regional effort to improve the quality, timeliness, and experience of care for women undergoing investigation for gynaecological cancers. "It will also play an important role in meeting our faster cancer treatment target by speeding up diagnosis and helping women start treatment sooner." The new service followed similar successful models already operating in Auckland, Counties Manukau, and Waikato.
