Former Geneva American Legion Post commander accused of stealing $100K
GENEVA, NY — The former commander of the Geneva American Legion Winnek Post 396 who was arrested nearly a year ago has now been indicted on a felony grand larceny charge.
Dale Henry Mosher is charged with one count of second-degree grand larceny, a class C felony, Ontario County District Attorney James Ritts and Assistant District Attorney Kelly Wolford announced Tuesday.
Mosher is scheduled to be arraigned April 17 in Ontario County Court. If convicted, he could face up to 15 years in prison.
Mosher is accused of stealing more than $100,000 from the organization from Jan. 1, 2017, through May 30, 2023.
'Stealing from a service group such as this, our veterans, is something that will not be tolerated and will not go unpunished,' Ritts said. 'There will be accountability."
The arrest last April came after an internal financial audit of the veterans organization and 10-month investigation involving the Ontario County Sheriff's Office.
Wolford said she could not get into specifics on what Mosher spent the money on or how it was taken, but said this was not one theft but lots of little thefts over time.
'It was very clear that it was being used for personal use,' Wolford said.
AJ Fratto, the post's current commander, said funding is 'incredibly crucial' to the organization.
'We live and die by every fish fry, to be honest with you,' said Fratto, referring to one of the organization's fundraisers. 'We're really hoping that people realize and understand how important it is to have something like an American Legion that represents veterans, families, the community and children ... We want to maintain the traditions and it's really difficult to do that when you have people stealing from you, especially your own kind.'

Man accused of fatally beating dog in Ontario County
An Ontario County man has been accused of fatally beating his dog, according to the Ontario County Sheriff's Office. James R. Kinney, 66, of Farmington was charged with aggravated animal cruelty, a felony, in connection with the April 17 death of his 2-1/2-month-old puppy Goose, a female Collie mix, deputies said. Kinney called 911 that day to report that a neighbor had poisoned his dog and that his puppy was dead on his kitchen floor. Deputies and the Ontario County Humane Society responded to his home. The puppy was taken for a necropsy at Animal Health Diagnostic Lab at Cornell University in Ithaca, where results showed that Goose died from blunt force trauma to her rib cage, which lacerated her liver, deputies said. There were no signs of poisoning. Witnesses also told authorities that they saw Kinney dragging his puppy by her leash, causing her to scream, deputies said. Two cats were seized from Kinney's home as well. Both cats are being evaluated at the animal shelter, deputies said. Kinney is scheduled to answer the charge in Farmington Town Court at a later date. Deputies: Farmington man charged after fatally treating dog
ROCHESTER, N.Y. (WROC) — A Farmington man has been charged with animal cruelty after his dog died from blunt force trauma, according to the Ontario County Sheriff's Office. Deputies started working alongside the Ontario County Humane after James Kinney called 911 to report a neighbor had poisoned his dog, and the dog was found dead on his kitchen floor. Both agencies found the two-and-a-half month old female Collie mix puppy, Goose. The next day, Goose was taken for an exam at Cornell University. The results showed Goose died from blunt force trauma to her rib cage, which lacerated her liver — with no signs of poisoning happening, according to deputies. Witnesses contacted police to report they had seen Kinney drag Goose by her leash, causing her to scream. Based on the evidence, deputies said Kinney was arrested and charged with aggravated cruelty to animals. Kinney will appear in Farmington Town Court, and two shorthair cats were taken from the house and are being evaluated at the shelter. Copyright 2025 Nexstar Media, Inc. All rights reserved.
