BNP slams Palike for tax notices to flat owners

BENGALURU: Bengaluru NavaNirmana Party (BNP) has slammed BBMP for issuing notices to thousands of flat owners, who recently obtained e-khatas, to pay tax for stilt and parking areas.
It termed BBMP's action 'erroneous and arbitrary' and has been taken without understanding the ownership pattern in apartment complexes and gated communities. The party alleged that the palike's action contradicts Supreme Court's judgments and statutory provisions under the Real Estate (Regulation and Development) Act, 2016 (RERA).
The Supreme Court has ruled that open and stilt parking spaces are part of the building's common areas and cannot be sold or treated as separate units. Further, Section 2(n) of the RERA Act defines stilt and open parking spaces as part of common areas. Hence, these spaces can't be taxed separately, the party said. In most apartment complexes, sale deeds mention that only flat owners have the 'exclusive right to use' their respective designated spaces. Parking spaces are included in common areas, which in turn, are included in the super built up area for which flat owners are already paying tax, said Srikanth Narasimhan, founder of BNP.
By sending notices to pay tax for stilt and open parking spaces separately though it is calculated in the super built up area, BBMP has violated the Supreme Court judgments as well as the RERA Act, said Vishnu Reddy, zonal leader of BNP, Mahadevapura. 'We demand that the palike immediately withdraw such notices and align its policies with constitutional and legal mandates,' he added.

"The government should not withhold information when an RTI is filed," he said, citing how RTI had revealed ₹840 crore spent by the Prime Minister on official overseas tours. He noted that an RTI seeking details on China's reported occupation of 10,000 sq km of Indian territory was rejected on "sensitive information" grounds, despite the data being visible on GPS. Key resolutions included proactive disclosure under Section 4(1)(B) of the RTI Act, faster transfer of applications between departments, protecting applicants' personal details, and penalising public information officers who unlawfully deny requests. They also called for appointing politically unbiased commissioners with integrity and legal expertise. Other demands included requiring first appellate authorities to conduct direct hearings to resolve most cases locally, handling complaints strictly under Section 18(1) instead of converting them into second appeals and giving priority hearings to senior citizens. As part of the event, activists filed 5,000 RTI applications across various state departments. Organiser Abdul said the resolutions aimed to make governance more transparent, curb misuse of "sensitive" exemptions, and uphold citizens' right to know in letter and spirit. With urgency in the air for this change, the govt finds itself deliberating the possibility of issuing an ordinance as an immediate solution. Yet, this path is fraught with uncertainty, as the time available is limited. In the backdrop of this legislative complexity, it is worth noting that the state is home to nearly 2,000 licenced wine shops. Their current licences are set to expire on November 30, which places urgency on the govt to act swiftly. The state govt must issue a new bid notification by September to ensure that these wine shops can continue to operate without interruption. 'Bid to hike application fee' According to reliable sources, the State Excise Act of 1968 includes a specific provision in Section 17(3) that allows for the extension of licence periods up to a maximum of two years. Therefore, should there be a need to extend the licence period to three years, an amendment to this Act will be required. Additionally, there is a proposal to increase the application fee for bidding licences from 2 lakh to 3 lakh. This change is expected to be straightforward, as it does not present any legal complications. In the recent bidding event for licences held in 2023, the govt accrued an impressive income of 2,645 crore from the application fee alone. Mumbai: Chief minister Devendra Fadnavis has directed Dharavi Redevelopment Project (DRP) to increase the size of rental tenements to 350 sqft for those ineligible for free housing and rehabilitation within Dharavi notified area, and from 405 sq ft to 500 sq ft for residents of planned buildings, details of a May 28 meeting obtained through an RTI application revealed. He also directed DRP to ensure that the land in Dharavi be equally divided between the rehabilitation section and the for-sale component. The CM further said that the survey of all slums across Mumbai follow the twin digital model adopted in Dharavi. On May 28, Fadnavis, along with deputy CM Eknath Shinde who handles the housing portfolio, were given a presentation on the Dharavi redevelopment master plan. Fadnavis suggested several changes to it, as per information obtained under the Right to Information (RTI) Act by Shiv Sena (UBT) worker Sagar Devre, who has been leading the opposition to the relocation of Dharavi residents in Mulund East. Besides, 215 acres of the Deonar dumping ground and 140 acres of revenue land at Aksai, Madh in Malad West, will also be provided for rental housing. Residents of planned buildings had recently met Shinde and demanded 500 sq ft homes instead of 405 sq ft. "It was former Shiv Sena MP Rahul Shewale who arranged this meeting for us three months ago.
