Tax reform advocacy group Tax Justice Aotearoa is calling on the Government and opposition parties to remedy the failures in our taxation system illustrated by a new report from the Centre of International Corporate Tax Accountability and Research, which looks at transparency and corporate tax issues in the heavily public-funded aged care sector.
'Instead of talking about the possibility of reducing our corporate tax rate of 28 per cent, the Government should be finding ways to increase financial transparency, and ensuring that multinational corporates pay their fair share of current corporate tax by reviewing the thin capitalisation rules,' says Glenn Barclay, Chairperson of Tax Justice Aotearoa.
'This is particularly urgent where public funds are paid to multi-national corporations delivering services on behalf of the government.'
The report focuses on the transparency of public funding in the aged residential care sector, and shows how our tax system allows multi-national providers to avoid paying the taxes that the public would expect them to pay, demonstrating this through the example of UK-owned BUPA.
BUPA had an average effective corporate tax rate over the past decade of only 4 per cent, much lower than the headline rate of 28 per cent, driven largely by tax-free capital gains.
In addition, the company appears to have used inter-company interest payments on a substantial loan to an Australian-incorporated BUPA company, which may have reduced taxable income by around $151m over the decade, trimming tax revenue by as much as $27 million over that period.
'This ability of multi-nationals to set up loans between subsidiary companies in different countries and then claim tax deductibility on the interest from those loans is a major issue,' says Glenn Barclay.
'While entirely legal, this 'thin capitalisation' is an approach that most members of the public would find questionable. It also gives multi-national players an advantage over wholly New Zealand-owned companies in competitive markets.'
'New Zealand does have thin capitalisation rules that are supposed to prevent this kind of activity, but this example shows that they are simply not strong enough,' says Glenn Barclay.
'We note that Australia and the UK have introduced a 'fixed ratio' test for interest payments on related party debt which limits allowable interest deductions in any one year to 30 per cent of gross earnings and this is the kind of measure that we should also seriously consider.'
'On a related matter, we note that IRD is looking at relaxing the existing thin capitalisation rules for infrastructure projects as part of its work programme agreement with the Minister of Revenue.
This could well be in the Budget and would be a big step in the wrong direction,' says Glenn Barclay. 'We urge the Government not to go down this route, but instead look at tightening this provision across the economy.'
The report questions the tax exemptions in the sector for capital gains arising from revaluations of assets, which is significant given the amount of real estate that companies in the sector own.
'It seems that aged residential care providers are intentionally using the capital gains they make from selling both rights to occupy properties to new residents, and sometimes the properties themselves, as part of their income streams,' says Glenn Barclay.
'If this is true, then the current law, which says that capital gains on sales made intentionally for that purpose are taxable, should be enforced. If, for some reason, it is not enforceable, then the law should be clarified. A comprehensive tax on capital gains would resolve these issues in a much clearer way.'
The report also raises questions about the level of funding for the aged care sector and the extent to which unaccountable multi-national and other private providers should be involved in service delivery.
'The report indirectly supports the need for more funding for aged care generally as the population ages and this is yet another example of a demand for services that only a more progressive tax system that properly taxes wealth can address,' says Glenn Barclay.

Foreign student income down on pre-Covid earnings
More than half New Zealand's foreign students studied in Auckland last year. Photo: 123RF Foreign students paid $1 billion in fees last year and more than half that money went to universities. The figures were supplied to the Education Ministry by providers, as part of their reporting for the export education levy. They showed 74,990 international students in New Zealand last year, including 18,020 at schools and more than 25,880 at universities. Their fees totalled $1.085b, about $100m less than the pre-pandemic years of 2018 and 2019. However, two sectors achieved their highest fee incomes on record - universities with $580m and government-funded private tertiary institutions with $167m. The fee take at non-government-funded tertiary institutions, schools and polytechnics last year was well below pre-pandemic numbers. The figure for non-government-funded tertiary institutions - a category that covered English language schools - was just $52.8m, down from a 2019 figure of $135m. Schools received $152m, down from $201m in 2019, and polytechnics received $132.8m, down from $178m. More than half the foreign students last year (43,060) studied in Auckland. Most students (61,500) came from Asia, with the next most significant source being Europe with 5345. At universities and polytechnics, management and commerce was the single largest field for foreign enrolments, accounting for 30 percent of polytechnic enrolments and 28 percent of university enrolments. The 74,990 individual students equated to 46,005 full-time equivalents, three-quarters of the 61,530 full-time equivalents in 2019. Butter proving to be a popular fundraiser
While the skyrocketing price of butter may be leaving a bitter taste in the mouths of some, one non-profit saw a golden opportunity. Southland Paws Rescue founder Amy Greig said the organisation made $1 profit on each of the 5560 blocks of butter it sold in its latest fundraiser. Ms Greig said it was the first time it had sold butter and it had been the most successful fundraiser to date. The orders for the 250g Westland Gold blocks started rolling in thick and fast after a post about it was placed on their social media page. "Word of mouth got around and people started ordering." Jingo and cheese rolls had been used to raise revenue in the past, but the butter was less work and easier to sell. One buyer ordered $1000 of butter while ironically, 500 blocks were ordered by staff from a local dairy processing factory. Ms Greig said several orders had been received from people who made cakes for others. Prices were initially marginally lower than supermarkets, but even from the time they first started receiving orders at the start of May, Westgold community fundraising prices had risen from $4 to $5.15. "I'd rather put that dollar that we got back into a local organisation for what we do . . . than letting that supermarket profit that dollar." Orders had to be prepaid and picked up once the delivery had been made because of the logistical challenge of storing pallet loads of butter. Funds raised paid for the care of the multitudes of animals the charity looked after throughout the year. While they had a good relationship with their vet, their bill still needed to be paid. Some animal healthcare expenses ran more than $1000. Leithfield School in Canterbury sold 10,000 blocks of the golden dairy bars in a recent fundraiser, RNZ said. Invercargill's Kaye's Bakery had been importing Australian butter by 10-tonne shipments to make its biscuits. Kaye's Bakery owner Luella Penniall said three years ago the company was paying $11 per kg — now it was up to $15. Stats New Zealand data shows prices have increased more than 65% in the 12 months ending at April 2025. Stats NZ also said dairy prices were the main driver for food price increases — increasing the food price index by 3.7%. The average cost for 500g of butter was $7.42, 12 months ago. Butter hit a record high of $7992 a tonne early in May before falling to $7821 in mid-May. By Toni McDonald

Need seen to build builders' wellbeing
Marti Amos is the New Zealand-based head of The Professional Builder. PHOTO: SUPPLIED It was the stuff of Boy's Own lore. Growing up on Stewart Island, business owner and entrepreneur Marti Amos enjoyed a childhood which was "just one big adventure, one after the other". Fishing, hunting, learning to fire a rifle, bush walks and heading across Foveaux Strait to play schoolboy rugby at Bluff or Waikiwi. One of his earliest memories was sitting in the rear of a sea-plane as it taxied off the beach and was half-submerged under water. He looked out the window and saw fish. Following his parents' separation, he moved with his mother to the hustle of Nelson and says it was "jarring" being taken away from everything he ever knew. From 10, he worked multiple jobs to help his mother out — from a fish factory to a service station, cardboard factory to mowing lawns — and he both inherited and developed a strong work ethic. All those experiences in his early years helped give him an affinity with the working man — "just the best kind of people to be around". Mr Amos (Ngāpuhi) spent a decade at the University of Otago, from 1989 to 1999, which he described as some of the best times of his life. He studied commerce and pursued PhD research on branding. He lectured in marketing and MBA programmes, examined MCom theses and worked as a Māori students tutor and thesis officer in the commerce division. He then moved to Auckland, where he was marketing director for Honda Motorcycles NZ and country manager for Pirelli Tyres NZ, and where he has lived for 25 years. Becoming tired of working for someone else, he bought a business-coaching franchise and noted the number of builders among his clients. He discovered many were great at building but needed help to build a great business, so he decided to concentrate on the construction industry — helping "some of the hardest working, down-to-earth people I know". Since 2004, Mr Amos has focused on helping residential construction companies to systemise and scale their businesses, take control of their finances, increase revenue and buy back days of their personal time each week. He and his team at The Professional Builder — which has grown from three to 65 — have coached more than 3000 building company owners in the United States, United Kingdom, Canada, Australia and New Zealand. The business is projected to reach 100 employees within the next 18 months, while revenue is projected to double to $30 million within the same timeframe. Members have included Deloitte Fast 50 winners, builders featured in television shows The Block and Grand Designs and many Master Builders award winners. Mr Amos said more needed to be done to address high rates of suicide in the construction industry. Recent research showed New Zealand's construction sector was facing a mental health crisis; suicide rates were 25% higher than other sectors and Māori, Pasifika, women, migrant workers, apprentices and labourers were among those at higher risk. He attributed that to various factors including financial instability, low pay and poor mental health, saying those issues were amplified by the industry's boom-and-bust cycle, cost-of-living crisis and a training model that prioritised trade skills over business acumen. "Kiwi tradespeople are trained to excel on site. They are underprepared to manage the multimillion-dollar business aspects of their work, with dire consequences for their mental wellbeing. "Our construction workers account for about 7% of working-age male suicides — with nearly one worker losing his life to suicide each week and the avoidable burden and impact of suicide in the New Zealand construction industry has been estimated at $1.1 billion per annum," he said. A radical overhaul of the country's traditional construction model was needed, with greater emphasis on financial literacy being a priority, he said. "The New Zealand building industry is seeing its lowest levels of annual growth over a decade with a rate of just 0.6% in the second quarter of 2024 — a factor that is likely to exacerbate mental health concerns for many in the trade. "Kiwi builders have been taught how to create outstanding projects. They're brilliant with the tools — but no-one has taught them how to build a great business. Without a proper understanding of financial management, many building company owners were left grappling with severe cash-flow challenges, working long hours and sacrificing their personal lives. In many cases, that led to overwhelming stress and deteriorating mental health. "When you're constantly worrying about how to pay your subcontractors or secure payroll for the next week, it isn't just your business that suffers — it's your whole life," he said. A business like The Professional Builder could help but it also needed to be part of a wider mandate. A government focus on big projects such as KiwiBuild had not had the desired outcome, he said. A focus on the likes of reducing red tape in the industry would help significantly at a macro level but not at a micro level, where business owners were "struggling to understand their numbers". Groups like Mates in Construction NZ and Mike King's Gumboot Friday did some "phenomenal work" and he believed the government could be doing a lot more at grassroots level and also industry body and commercial level. Last month, Mr Amos launched a book The Profitable Builder's Playbook to help business owners improve their financial management. The company has launched an expansion programme to grow the market in the US, and there are plans to increase its physical presence there and establish partnerships with hardware wholesalers, similar to its relationships with Carters, ITM and Mitre 10 in New Zealand. The Professional Builder will be exhibiting at a roadshow in Texas in several weeks, to be followed by six seminars in the state. Need help?
