MUMBAI: A 75-year-old man was severely injured after a drunk policeman on a two-wheeler allegedly rammed into him at JK Kapoor Chowk in Worli on July 1. While the policeman was booked, the victim's family claimed that he was shown leniency and not booked under relevant sections pertaining to drunk driving and hit-and-runs. The Worli police said that they will look through medical records of the constable and take appropriate action. According to the police, the victim, Dashrath Ramlakhan Yadav, lives with his family at the Hiraseth Chawl in Worli village, and works as a security officer at The Cliff hotel. Yadav's son, Ramakant, a civil contractor, who was in Pune when the accident occurred, said that his father was on his way back home when the biker rammed into him. Locals rushed the victim to the nearby MA Podar Hospital in Worli.
Ramakant's son Ravi informed him about the accident, and he rushed to the hospital. 'I was told that the biker was trying to run away after the accident, but he was caught by local youths who knew my father and who brought him to the hospital,' Ramakant said. He added that once the Worli police arrived at the hospital, the accused fled, but local youngsters traced him and caught him. According to his son, the victim suffered serious head injuries due to which he had to get 16 stitches on his head, and was admitted to KEM hospital where he still remains.
The police booked the driver under sections 125(a) (endangering life or personal safety of others) and 281 (rash or negligent driving or riding on a public way) of the Bharatiya Nyaya Sanhita, and sections 134 (A) (not taking all reasonable steps to secure medical attention for the injured), 134 (B) (not reporting the circumstances of the occurrence in case of accident) and 184 (dangerous driving) of the Motor Vehicles Act. According to the police, they later found out that he was a police constable.
Ramakanth said, 'They added no sections for drunk driving nor any sections relating to serious offences despite him being a policeman and having full knowledge that drunk driving can lead to serious accidents. They also added no sections for hit-and-run.'
According to the Worli police, the accused constable was Vasudev Kanojia, a resident of Worli police colony who worked in the local arms unit in Naigaon, Dadar. Senior police inspector of Worli police station, Nilesh Salunkhe Patil, said blood-alcohol test reports of the accused had indicated that he was indeed drunk and the police will add the sections related to drunk driving and update the chargesheet.
Ramakanth said, 'We went to the police station but they hardly cooperated with us and are favouring the accused.' He added that the police were claiming the accused was also injured and had gotten him admitted to a hospital. Patil said the constable had suffered injuries on his ribs and claimed that the victim's injuries were minor and he was kept at the hospital just under observation.

Three persons were arrested in Uttarakhand's Pauri Garhwal district for allegedly assaulting a man after he refused to chant 'Jai Shri Ram', The Indian Express reported on Monday. The police filed a first information report on Saturday based on a complaint by Rizwan Ahmad, a resident of Saharanpur in Uttar Pradesh. Ahmad said that the incident took place on Friday evening near Dungripanth. In his complaint, Ahmad said that he had gone to a tea shop where three men were under the influence of alcohol. 'One of them, named Mukesh Bhatt, asked me to chant 'Jai Shri Ram',' The Indian Express quoted him as saying in his complaint. When he refused, Ahmad alleged, Bhatt and his two companions abused and assaulted him. 'They caught hold of my beard, pulled it violently, and shouted: 'Cut this man's beard.' They also made a video of this assault,' Ahmad added. 'I was forced to chant 'Bharat Mata ki Jai' and 'Jai Shri Ram'.' A video of the incident has been circulated widely on social media. Ahmad said he managed to escape through the back of the shop. He also alleged that the three men had threatened another resident of Saharanpur the same day, attempting to force him to chant the slogan. Apart from Bhatt, the accused were identified as Naveen Bhandari and Manish Bisht. The FIR was filed under sections of the Bharatiya Nyaya Sanhita pertaining to voluntarily causing hurt, promoting enmity on religious grounds, outraging religious feelings, criminal intimidation and intentional insult to provoke a breach of peace at the Srinagar Police Station in Pauri, The Indian Express reported. An unidentified official also told the newspaper that all three men were arrested for 'assaulting and misbehaving' with Ahmad. They were later produced before a court, the official added.

Two men have been booked for allegedly raping a Class 12 student when she was returning home after attending the Independence Day celebration at her school here, a police officer said on Monday. The 17-year-old girl was returning home after attending Independence Day programme in her school, when the accused forcibly took her to a farm house and allegedly raped her.(Unsplash/representational) A case has been registered against Amarjit Singh (35), who hails from the minor girl's village, and his uncle Gautam Singh (45), he said. According to Bairia Station House Officer Moolchand Chaurasia, the 17-year-old girl was returning home after attending the Independence Day programme in her school, when Amarjit forcibly took her to his farm house and allegedly raped her. Later, Amarjit and Gautam threatened to kill her if she told anyone about the incident, the SHO said. Chaurasia said the girl's mother has filed a complaint, based on which a case has been registered under relevant sections of the Bharatiya Nyaya Sanhita and Protection of Children Against Sexual Offences Act. He said efforts are on to arrest the accused.

Guwahati Police summons ‘The Wire' editor despite Supreme Court protection

The Crime Branch in Guwahati has issued a summons to The Wire 's founding editor Siddharth Varadarajan in a first information report pertaining to an article on Operation Sindoor. The summons, issued on August 12, came despite the Supreme Court granting protection from arrest to Varadarajan and members of the foundation running the news outlet in another FIR filed by the Assam Police. Ankur Jain, the joint commissioner of police in Guwahati, told Scroll that the summons was issued as the Supreme Court order had come on a case filed in 'some other district'. In the latest notice, Varadarajan has been directed to appear before the investigating officer at the Crime Branch Police Station in Panbazar on August 22 at 11.30 am. The earlier case against Varadarajan was registered at Morigaon police station on July 11 under Section 152 of the Bharatiya Nyaya Sanhita, which pertains to acts endangering the sovereignty, unity and integrity of India. It followed the publication of an article about Operation Sindoor titled ''IAF Lost Fighter Jets to Pak Because of Political Leadership's Constraints': Indian Defence Attache'. The fresh summons issued to Varadarajan cites the same charges, in addition to the Bharatiya Nyaya Sanhita sections pertaining to promoting enmity between different groups, publishing false or misleading information and criminal conspiracy. On August 12, a Supreme Court bench of Justices Surya Kant and Joymalya Bagchi granted protection from arrest to Vardarajan while hearing a writ petition challenging the constitutionality of Section 152. The petition was filed by the Foundation for Independent Journalism, which owns The Wire, and Varadarajan. The petitioners argued that the law was a repackaged version of the colonial sedition law. The bench issued a notice to the Union government and tagged the plea with another petition challenging the validity of the provision. Advocate Nitya Ramakrishnan, appearing for the petitioners, argued that the news article was a factual report of a seminar organised by a university in Indonesia and statements made by an Indian defence attaché on the military tactics used during Operation Sindoor. She added that the article also carried the Indian embassy's response to the defence attaché's remarks, which had also been reported by several other news outlets. In May 2022, the Supreme Court had ordered proceedings and criminal prosecutions for sedition under Section 124A of the erstwhile Indian Penal Code to be kept in abeyance. Critics have argued in the Supreme Court, in a separate matter, that Section 124A was slipped in again into the law in the guise of Section 152 when the Bharatiya Nyaya Sanhita replaced the Indian Penal Code in July 2024.
