NFL star Steve Smith Sr. sued for alleged affair with a man's wife under bizarre law that exists in six states
Former NFL player Steve Smith Sr is being sued in North Carolina for allegedly having an affair with a married Baltimore Ravens marching band member.
The band member's husband, Antonio Martinez, is asking for over $100,000 in damages according to a civil lawsuit that was filed this week at the Mecklenburg County Superior Court.
Martinez is exploring a legal loophole of sorts in North Carolina, which is only one of six states in the United States with the so-called 'Homewrecker law', known officially as the 'alienation of affecation' law.
It allows a spouse to sue a third party for destroying a marriage.
Back in February, allegations first emerged about the 45-year-old Smith when an account seemingly belonging to Martinez shared a screenshot of an array of text messages appearing to confront Smith. The post has since been deleted.
But according to the lawsuit, Martinez also called Smith over his alleged involvement with his wife.
'You've been f***ing my wife, bro,' the lawsuit claims Martinez said. 'Whatcha gotta say for yourself?'
'I'm sorry,' Smith reportedly responded.
Smith met Martinez's wife at her job with the Ravens, the lawsuit says. It also says that Martinez has now split from his wife due to her alleged affair.
Ex-NFL player Smith ended his football career with the Baltimore team but spent the majority of his playing days as a wide receiver for the Carolina Panthers.
Daily Mail has attempted to contact Smith's representatives for comment. He posted a seemingly cryptic comment on Instagram on Friday about feeling fear.
'F.E.A.R has two meanings - Forget Everything And Run or Face Everything and Rise,' it said.
Smith has been married to his wife Angie since 2000. The pair have four children together: Peyton, Baylee, Boston and Steve Jr.
Smith Sr has regularly spoken about his love for his family, even claiming that the 'most important thing he did' in his football career was to 'make sure that my kids don't need to play sports in order to attend college'.
He added: 'They don't need to run, jump, catch or flip.'
Smith isn't the first NFL player to be involved in allegations around the little-known law.
A 2017 report from Associated Press says Fletcher Cox, defensive tackle of the Philadelphia Eagles, said that Joshua Jeffords filed a lawsuit for alienation of affectation.

M&S resumes online orders six weeks after cyber attack
Marks & Spencer has resumed online orders for customers, six weeks after it was forced to halt sales following a cyber attack. Currently, shoppers will only be able to purchase the company's "best-selling fashion ranges" as part of a staggered return to full online operations. On the company's Instagram page, the retailer's managing director of clothing, home and beauty, John Lyttle, wrote: "We are bringing back online shopping this week "A selection of our best-selling fashion ranges will be available for home delivery to England, Scotland and Wales. "More of our fashion, home and beauty products will be added every day and we will resume deliveries to Northern Ireland and Click and Collect in the coming weeks. "Thank you sincerely for your support and for shopping with us." The retailer made the decision to pause online orders over the Easter Weekend after being targeted by hackers. Customer personal data, which could have included names, email addresses, postal addresses and dates of birth, was also taken in the attack. In a statement at the time, the retailer said: "Unfortunately the nature of the incident means some personal customer data has been taken. "Importantly, there is no evidence that this data has been shared and it does not include useable card or payment details, or account passwords, so there is no need for customers to take any action." Customers were prompted to reset their password though the store assured customers this was only for "extra peace of mind." The retail group says 'human error' caused the attack, which is set to cost the firm around £300 million. It is understood that the retailer was targeted by a ransomware called DragonForce, and an employee most likely replied to a phishing email. The National Cyber Security Centre describes ransomware as a type of malicious software that prevents users from accessing their data and systems by encrypting their files. The group deploying the software will then demand a payment or "ransom" in exchange for granting access and unencrypting the data. Attackers can also threaten to leak the data if the ransom is not paid. According to reports, a hacking group known as Scattered Spider is said to be behind the M&S attack, although this has not been confirmed.

Bannerman High headteacher, Seonaidh Black, said Buchan was a "bubbly and enthusiastic" person who "wanted to do a good job". But she added that on a "couple of occasions", Buchan was unclear on boundaries with pupils concerning her social media profiles being "open where pupils could access them". Ms Black said that a colleague told her images of Buchan's OnlyFans profile were seen by S5 and S6 pupils. Senior schoolboys asked Ms Black if she had "heard the news?" and that she should "look out for Jessica Jackrabbit". Ms Black added that it was "obvious everyone knew what was going on". Following a probe, Glasgow City Council said: "The council has a code of conduct that all employees should adhere to and a teacher who has actively pursued a second income on this type of website brings their school, the council and their profession into disrepute."
