July 25 (Reuters) - Several social media companies should not be held liable for helping an avowed white supremacist who killed 10 Black people in 2022 at a Buffalo, New York grocery store, a divided New York state appeals court ruled on Friday.
Reversing a lower court ruling, the state Appellate Division in Rochester said defendants including Meta Platforms' (META.O), opens new tab Facebook and Instagram, Google's (GOOGL.O), opens new tab YouTube, and Reddit were entitled to immunity under a federal law that protects online platforms from liability over user content.
The plaintiffs included relatives or representatives of people who died in Peyton Gendron's racially motivated mass shooting at Tops Friendly Markets on May 14, 2022, as well as store employees and customers who witnessed it.

The perpetrator, who is reportedly a 61-year-old man named by police as Nai Noi, took his own life following the attack. In haunting footage taken at the scene, Noi was seen wearing a black T-shirt and cream shorts while wearing a camouflage-patterned backpack on his front. The man, holding a handgun in his right hard, was seen storming towards the popular market. Separate footage, taken from inside the market, showed terrified shoppers screaming and running away as Noi fired off several shots. After carrying out the attack, he reportedly shot himself on a nearby bench. Local cops have now revealed, following interviews with the perpetrator's wife, that the man had a long-standing grudge against a security guard at the market. The feud, which had been ongoing since 2019, began after Noi found his the tyres on the car owned by his wife, who worked at the market, slashed. Noi, who police said was a heavy drinker, believed the guard was the one who slashed his wife's tyres. He is said to have reported the incident to local officials, though nothing came of this. His wife reportedly told police that he was a violent man who sometimes abused her. Pol. Lt. Gen. Sayam told local media: 'The perpetrator is Thai. There was no other motive. It was a personal conflict between him and the security guard of Or Tor Kor. It was not related to the sabotage incident. 'Before the incident, he was still talking to his wife on the phone. There was no contract for the incident. At the time of the incident, his wife was selling things. When she heard the gunshot, she ran away. 'I later found out that the perpetrator who shot and killed the person was his husband. The gun belonged to the perpetrator, a 9 mm. pistol. 'From the investigation, there was one round stuck in the chamber. There was no history of drug use, but he was a heavy drinker.' Five of the people killed by the gunman were security guards at the market, while one was a bystander, police said. Travelers were preparing to disembark when they saw the commotion at the front of the plane. 'We were all shocked and stunned. What was happening?' one passenger, known as Sarah, said. Sarah documented what unfolded on board the aircraft. "They barged through and stormed the cockpit," she said. "They removed the co-pilot, cuffed him, presumably arrested him." Sarah said the co-pilot was then flanked by officers, walked down the aisle, and taken off the plane. She recalled how the cabin crew seemed bewildered by what was going on. "I looked at him [the pilot] and I said 'What's going on?'" one told the Fox affiliate KMSP-TV. The traveler said passengers were standing up on the plane, a Boeing 757-300, getting ready to grab their bags from the overhead lockers. Another passenger told The San Francisco Chronicle that some of the agents who stormed onto the plane were carrying guns. The traveler said the agents had badges and vests with letters on them. More than 50 million people passed through San Francisco airport last year. In 2023, the airport was named the 13th busiest airport in the US.
