Colonel Mathipa's murder: 12 SANDF Special Task Force soldiers released on bail

The Randburg Magistrates' Court in Joburg has released 12 South African National Defence Force (SANDF) members on bail, after they were on several charges, including murder of a police officer.
Last week, IOL reported that the bail application had been postponed to allow for the verification of their residential addresses.
The 12 accused soldiers face multiple serious charges, including three counts of murder, kidnapping, fraud, obstruction of justice, perjury, and theft of a motor vehicle.
The charges stem from the alleged kidnapping of Ethiopian businessman and suspected ISIS funder, Abdella Hussain Abadiga and his bodyguard Kadir Jemal Abotese on 29 December 2022 at Mall of Africa in Midrand.
Previously, National Prosecuting Authority (NPA) Gauteng regional spokesperson, Phindi Mjonondwane, said the victims were reportedly abducted from the Midrand mall and taken to the Zwartkop Military Base, and their whereabouts remain unknown.

'The accused are also linked to the assassination of Lieutenant Colonel Frans Mathipa, a Hawks officer investigating the kidnapping. Mathipa was fatally shot on 6 August 2023 on the N1 Highway by individuals reportedly driving a SANDF vehicle,' said Mjonondwane.
During the court proceedings last week, the defence submitted affidavits in which the accused deny any involvement in the incidents.
A statement from their commanding officer was also submitted in support of the bail application.
Mjonondwane said the NPA views the matter in a serious light, given the nature of the charges and the potential threat to the administration of justice.
The accused SANDF members were arrested in June.
IOL previously reported that some of the soldiers were arrested at different places, including the OR Tambo International Airport and Centurion in Tshwane.
Following the arrests, spokesperson for the Hawks, Lieutenant Colonel Christopher Singo, stated that the arrests were carried out by members of the Johannesburg-based Hawks' Serious Organised Crime Investigation, the headquarters' Serious Organised Crime Investigation, and the Tactical Operations Management Section (Toms).
'The arrests are linked to the murder of Lieutenant Colonel Frans Mathipa, who was fatally shot while driving on the N1 highway near Hammanskraal on August 6, 2023. Following the shooting, his vehicle lost control and veered into a ditch,' Singo said.
Mathipa, who was attached to the Hawks' Crimes Against the State Unit within the Serious Organised Crime Investigation in Gauteng, was on duty conducting an investigation at the time of his death. Get your news on the go, click here to join the IOL News WhatsApp channel.

Suspected cop killers in gun battle with police
Suspected criminals, it seems, have become more brazen in South Africa wanting to engage in gun battles with police. A shoot-out between police and two suspected criminals in Inanda late last night (12 August) points to this. Police were following up on leads that two suspects, linked to the murder of a police officer, attempted murder, a chain of house robberies and armed robberies, when they (police) came under fire. Colonel Robert Netshiunda, SAPS police spokesperson in KwaZulu-Natal said: 'When police arrived at the house [in Maplazini area] they introduced themselves as police officers and instructed the suspects to open the door. 'The suspects responded with gunshots towards police officers from inside the house and police were left with choice but to return fire in self-defence.' In the ensuing gunfight police managed to take control of the situation leading to the fatal shooting of the two suspects. According to Netshiunda the suspects aged 20 and 21 years old sustained fatal wounds. Police officers were not injured during the gun battle. They recovered what might possibly be a stolen firearm from the suspects. The serial number on the gun was filed off. Another brazen gun battle occurred between police and four suspected criminals during a foiled house robbery in Pinetown yesterday (12 August). Police responded to a house robbery in Paradise Valley, Pinetown only to be shot at by the robbers. This is how it played out according to Netshiunda. When police approached the house on Oxford Road, they noticed a suspicious looking VW Polo moving away from the scene. Attempts by police to stop the vehicle were ignored by the driver. 'The driver of the vehicle ignored police instruction's and sped off. A high speed chase ensued and on Underwood Road, the suspects opened fire towards police officers. Police returned fire and a shoot-out ensued,' said Netshiunda. The suspects were wounded during the shoot-out and three were admitted to hospital under police guard. The fourth suspect evaded police and is on the run. The three injured suspects are expected to appear in court when they are 'fit to do so'. In a SAPS Facebook post four days ago, Acting Police Minister, Professor Firoz Cachalia reacted to the dangers police face while undertaking their duty. This, following the deaths of police officers who were ambushed while transporting awaiting trial prisoner, Jabulani Moyo. 'Their [police] sacrifice in the line of duty is a stark reminder of the daily dangers faced by our police officers as they work to uphold the rule of law and ensure the safety of all South Africans. Art heist: R1 million worth of sculptures stolen from Pringle Bay gallery

The stolen works, by celebrated South African artists Anton Smit and Janko de Beer, are not only of significant financial value but also irreplaceable cultural treasures. 'The theft took place during the night of Tuesday 5 August or the early hours of Wednesday 6 August. I was at the gallery until early Tuesday evening and returned at around 09:00 on Wednesday morning, when I immediately noticed that several sculptures were missing and one of our security cameras had been broken,' said de Beer, co-owner of the gallery and a celebrated visual artist and sculptor. 'Later, we also discovered that the camera positioned at the entrance to Pringle Bay, at the main intersection, was not functioning. We cannot confirm whether this was damaged during the incident or was already out of order. 'This does not appear to have been an opportunistic crime. The sculptures are large and somewhat heavy, so the thieves would have needed a suitable vehicle, the right equipment, and enough people to move them. All indications suggest it was a planned and targeted theft.' These works are unique and instantly recognisable to those familiar with South African sculpture, making them difficult to sell openly without raising suspicion. 'This theft is not only a personal blow to the gallery and the artists involved but also to the broader South African art community.' Despite damaged security equipment and no confirmed leads, police have been actively investigating de Beer. Efforts to recover the artworks began immediately. 'We immediately posted details and photographs of the stolen works on social media, which have been shared widely. Our network of collectors, reputable auction houses, and fellow galleries has also been alerted, and we are grateful for the solidarity and support. Because of the distinctiveness of these works, it will be challenging for the thieves to sell them without someone recognising them. 'We are asking members of the public, collectors, and galleries to remain vigilant and report any attempt to resell or transport sculptures that match these descriptions. There is no reward currently on offer, but our focus is on mobilising the art community and the public to help recover the pieces.' For the artists, these sculptures represent months of creative effort, skill, and inspiration, and their theft is profoundly discouraging. For us as a gallery, our sculpture garden is something we are proud of. It brings joy to our community and to visitors, and we have always believed that showcasing art outdoors was worth the inherent risks. Until now, we never felt this kind of targeted theft was a likely threat. 'While the incident is disheartening, it will not stop us from doing what we love. We have already strengthened our security measures and remain committed to making art accessible to the public.' He urged the public to act swiftly if they encounter any of the stolen works. Judicial bias claims arise in Joshlin Smith appeal case

Image: Armand Hough / Independent Newspapers The disappearance of six-year-old Joshlin Smith from Middelpos, Saldanha Bay, returned to the Western Cape High Court on Thursday, this time with defence lawyer Nobahle Mkabayi locked in a heated exchange with Judge Nathan Erasmus over claims of judicial bias. Joshlin's mother, Racquel 'Kelly' Smith, her boyfriend Jacques 'Boeta' Appollis, and family friend Steveno 'Steffie' van Rhyn were earlier convicted of kidnapping and human trafficking after the little girl vanished in February 2024. The State's case centred on witness testimony and statements allegedly made by the accused, but Joshlin has not been found. 'When I was leading my client, the court said Ms Swanepoel (State prosecutor) would make a field day out of you,' Mkabayi told Erasmus, describing the remark as threatening. Erasmus rejected her version: 'Why did you not ask for a special entry? I didn't say Ms Swanepoel was going to 'wipe the floor' with your client. Ms Heeramun was wiping the floor with Mr Harmse's client. Don't make statements that are not true.' The back-and-forth intensified as the judge pressed Mkabayi to explain why another court would view Van Rhyn's testimony differently. 'Tell me why his testimony should have been accepted. Is there a reasonable prospect they will win in the next court?' he asked. Mkabayi insisted her client's right to a fair trial had been compromised and said she wanted the matter heard by a different court to prove his innocence. Erasmus stood firm: 'When the defence closed their case, all we did was manage their case. Are you saying I was biased towards your client by saying that?' Mkabayi said yes.
