SC pulls up Centre, Maharashtra for not setting up new infra for special courts
New Delhi, Jul 18 (PTI) The Supreme Court on Friday pulled up the Centre and Maharashtra government for designating existing courts as special courts as it asked for the creation of newer ones meant for special cases.
A bench of Justices Surya Kant and Joymalya Bagchi informed Additional Solicitor General Rajkumar Bhaskar Thakre, appearing for the Centre and Maharashtra government, if existing courts were designated as special courts for trials under the NIA Act, cases of undertrials languishing in jail for years, senior citizens, people from marginalised sections and matrimonial disputes would be delayed.
The top court underscored the need of the hour to be the creation of more infrastructure, appointment of judges and staff and the government sanctioning the posts.
'If additional courts are not created then courts will be forced to grant the accused booked under special statutes bail as there is no effective mechanism for speedy conclusion of trials," the bench observed.
The Centre and Maharashtra government were offered a last opportunity to formulate a proper proposal for setting up of special courts under special statutes such as the NIA, MCOCA and UAPA among other sand.
They will have to respond to the court's directions after four weeks.
On May 23, the top court underlined the need for dedicated courts for NIA cases while calling for a 'judicial audit" of laws enacted by the Centre and the prospective ones by the states.
It said the cases entrusted to the NIA were heinous cases, having pan India ramifications and each such case contained hundreds of witnesses and the trial did not progress with the required pace as the presiding officers of the court were busy with other cases.
The top court further said the only appropriate course meant setting up special courts where trial of cases only related to special statutes could be carried out with a day-to-day hearing.
The top court was hearing a bail plea of Kailash Ramchandani, a Naxal sympathiser from Gadchiroli in Maharashtra.

India Negotiating Trade Pacts With Several Nations, Including US: Piyush Goyal
India is negotiating trade pacts with several countries, including the US, Commerce Minister Piyush Goyal said on Friday, adding that today, the world recognises the strengths of the country. Speaking at an event in New Delhi, Goyal said several countries are keen to engage with India on the trade front. "We are in dialogue with many countries -- the US, Oman, the European Union, Chile, Peru and New Zealand. According to the Commerce Minister, international agencies look at India as the bright spot in the world economy. "India has signed mutually beneficial FTAs with the UAE, the UK, Australia and the EFTA nations. We want to achieve such FTAs with more countries," said Goyal, adding that India, through its reforms and MSMEs and industry's efforts, is currently the 4th largest economy and will soon become the third-largest economy. "We are constantly working towards protecting and promoting our farmers. The government is confident of achieving Viksit Bharat goals. India is progressing towards 'Make in India' with self-confidence," the minister said. According to the minister, India and the US decided to talk over a mutually-beneficial trade deal aimed to be completed by the fall of this year. India has signed 13 FTAs with its trading partners. The country is currently negotiating the following FTAs with its trading partners: India-EU FTA, India Australia Comprehensive Economic Cooperation Agreement (CECA), India-Peru Trade Agreement, covering goods, services and investment, India-Sri Lanka Economic and Technical Cooperation Agreement (ETCA) and India-Oman FTA.

Karnataka Education Policy Commission proposes sweeping education overhaul
Bengaluru, Aug 8 (PTI) The Karnataka State Education Policy Commission has called for a sweeping overhaul of the state's education system, proposing structural reforms from pre-primary to professional courses, tighter regulation of private institutions, and a substantial increase in government spending on education. The Commission's chairperson Prof Sukhadeo Thorat on Friday submitted his final report in three volumes to Chief Minister Siddaramaiah in the presence of his cabinet colleagues and senior government officers, sources in the office of Higher Education Minister M C Sudhakar said. The 17-member Commission, which also comprises six subject experts, advisors, and one member-secretary, was formed to formulate an education policy. According to a note issued by Sudhakar's office, the panel has proposed adoption of a 2+8+4 system in school education — two years of pre-primary, eight years of primary, and four years of secondary education — coupled with a firm emphasis on Kannada or the mother tongue as the medium of instruction up to class five in all board schools. In its report, the commission recommended that school education be complemented by a bilingual policy pairing Kannada or the mother tongue with English, ensuring children are rooted in their linguistic heritage while gaining access to global language skills. It has also called for residential schools for children from migrant families, a gradual extension of the Right to Education Act to cover those aged between four and eighteen, and the universalisation of secondary education across Karnataka. To enhance the educational quality, it proposed ending the state's dependence on National Council of Educational Research and Training (NCERT) textbooks in favour of locally developed content, boosting government school standards to the level of Kendriya Vidyalayas, and stopping the appointment of guest or contract teachers. Privatisation, it said, must be checked through a dedicated regulator for private schools, while block education offices should be empowered to make academic decisions. Agencies working in parallel should be merged into an integrated commissionerate, the Department of State Educational Research and Training (DSERT) should be transformed into an autonomous State Council of Educational Research and Training (SCERT) with a focus on research and development, and the Directorate of Lifelong Learning revitalised. It also called for raising education's share in the state budget to 30 per cent, ensuring per-student spending grows by five to ten per cent each year. In higher education, the Commission wanted a comprehensive financing framework that guarantees timely and adequate funding, with expenditure on higher education gradually increased to one per cent of Karnataka's GSDP by 2034-35. Further, it recommended raising the share of higher education in the overall education budget between 25 and 30 per cent, and earmarking at least a quarter of this increased funding for infrastructure. For academic structure, it proposed a 3+2 model for undergraduate and postgraduate programmes in general education, a 4+2 model for professional courses, and the continuation of the pre-NEP 2020 re-entry policy. The report sought to keep fees in government and aided institutions within reach, regulate private institutions through a permanent mechanism, and extend full fee waivers and scholarships to girls in government, aided, and unaided private colleges. It urged reservation compliance in private unaided institutions, creation of a State Quality Assessment Board, and the filling of all sanctioned teaching posts within five years. The commission advocated for the introduction of short-term diploma and certificate programmes, government-funded internships, and region-specific skill councils led by industry leaders. Emerging technologies such as quantum computing, artificial intelligence, machine learning, data science, life sciences, and nanoscience should be embedded in engineering and polytechnic curricula. Agriculture studies, according to the panel, should begin at school-level and continue into higher education, with opportunities for dual or joint degrees, international internships, and public-private partnerships with foreign universities. ED files chargesheet against Bengal minister Chandranath Sinha in primary teachers' recruitment scam
PTI West Bengal Minister Chandranath Sinha with TMC supporters leads a 'Tiranga Yatra', at Bolpur, in Birbhum district. The Enforcement Directorate (ED) has submitted a chargesheet against West Bengal Minister Chandranath Sinha and the central agency has reportedly tracked fictitious transactions worth Rs 1.5 crore in two bank accounts while probing the recruitment scam of primary teachers in state-run schools. 'ED had given certain documents to me. A state minister has been implicated and money was recovered from him. I went through the documents and sanctioned them approval,' Governor CV Ananda Bose said today. The ED has filed a charge sheet against Sinha with details the irregularities in the recruitment process. The Central agency has mentioned the details of such transactions in the charge sheet, which it filed against Sinha at a special court of the Prevention of Money Laundering Act (PMLA) earlier this week. Certain fictitious transactions, mainly inward remittances, took place between 2016 and 2021, people in the know said. It has been learnt that Sinha suddenly appeared at the ED office on Thursday. Former West Bengal Education Minister Partha Chatterjee is in judicial custody in connection with the school for job recruitment March last year, the ED officials conducted raid and search operations at the Minister's residence at Bolpur in Birbhum the raid, the ED officials seized cash worth Rs 41 lakh and a mobile phone from Sinha's residence. West Bengal minister Chandranath Sinha had appeared before the Enforcement Directorate last year for questioning in connection with its probe into an alleged school recruitment scam.
