SC rejects Justice Varma's plea challenging cash burn inquiry panel

The Supreme Court on Thursday rejected Justice Yashwant Varma's petition challenging the validity of an in-house inquiry committee that had found him guilty of misconduct after the recovery of unaccounted cash from his official residence in Delhi in March this year.
A Bench of Justice Dipankar Datta and Justice A G Masih held that the in-house committee had scrupulously followed the process, except for uploading photographs and video.
The Bench also clarified that a writ petition challenging the conduct of a sitting judge under the in-house mechanism was not maintainable. It stated that the in-house procedure enjoys legal sanctity and is not a parallel mechanism outside the constitutional framework.
"We have held that the CJI and the in-house committee had scrupulously followed the process, except uploading photos and video, and we have said it was not required. But nothing turned on it because you did not challenge it then. We have held that the CJI sending the letter to the Prime Minister and President was not unconstitutional. We have made certain observations where we have kept it open for you to raise proceedings if needed in the future. With this, we have dismissed the writ petition," the Court said.
In the previous hearing, the Court had asked why Justice Varma — a former Delhi High Court judge — was questioning the panel and its formation after participating in its proceedings throughout. Justice Varma, now serving at his parent court, the Allahabad High Court, was transferred from Delhi after the alleged recovery of unaccounted cash from his official residence.
The Court has, however, left open the option for Justice Varma to approach it for appropriate remedies if required.
Justice Varma had also challenged the May 8 recommendation by then Chief Justice of India (CJI) Sanjiv Khanna, urging Parliament to initiate impeachment proceedings against him. His plea alleged that the panel's findings were based on a 'preconceived narrative' and that the adverse conclusions were drawn without affording him a full and fair hearing.
'Whether to proceed or not to proceed is a political decision. But the judiciary has to send a message to society that the process has been followed,' the Bench observed. It also clarified that the post of the Chief Justice of India is not merely ceremonial.
'He (the CJI) has certain duties to the nation as the leader of the judiciary. If materials come before him (regarding misconduct), the CJI has the duty to forward them to the President and the Prime Minister. If on the basis of the material it is found that the misdemeanour is so serious as to warrant action, he would be affirming earlier decisions of this Court which state that the CJI has the authority to do so,' Justice Datta said.
The 'in-house procedure' was the law laid down by the Supreme Court under Article 141 of the Constitution, Justice Datta said. However, the Bench agreed with Varma's contention that the videos showing the burning of cash should not have been leaked during the proceedings.
The in-house inquiry committee examined 55 witnesses and visited the site of the accidental fire, which broke out around 11:35 PM on March 14, 2025, at Justice Varma's official residence, then serving at the Delhi High Court. He now serves as a judge at the Allahabad High Court.
Based on the panel's findings, then CJI Sanjiv Khanna wrote to President Droupadi Murmu and Prime Minister Narendra Modi, recommending impeachment proceedings against Justice Varma.

Delhi police on Monday detained Congress MP Rahul Gandhi, Congress MP Priyanka Gandhi and a host of other INDIA bloc leaders as the police foiled their march to Election Commmission to protest over the Special Intensive Revision of electoral rolls in poll-bound Bihar and allegations of "vote chori" (vote theft) in the 2024 Lok Sabha elections. Rahul Gandhi told reporters while being detained, "The reality is that they cannot talk. The truth is in front of the country. This fight is not political. This fight is to save the Constitution. This fight is for One Man, One Vote. We want a clean, pure voters list." Congress MP Priyanka Gandhi Vadra told ANI, "Dare hue hai. Sarkaar kaayar hai" (They are scared. The Government is a coward). The other leaders who were detained were Shive Sena Shiv Sena (UBT) MP Sanjay Raut, and TMC MP Sagarika Ghose. The detained MPs were coralled into a bus to be taken to the Parliament Street police station. Meanwhile, Samajwadi Party chief Akhilesh Yadav was seen jumping over barricades as Delhi Police stopped the INDIA bloc MPs from marching to the Election Commission's office The Former Uttar Pradesh Chief Minister could be seen climbing over the barricades, installed by the police to block the protesting MPs. Akhilesh Yadav jumped to the other side to continue the protest. "They are using the police to stop us," Akhilesh Yadav shouted after crossing the barricades. "We are protesting peacefully. The MPs began their march to urge the EC to address their concerns on the alleged "voter theft" The MPs were raising slogans of "vote chor" as they marched towards the office of the poll body at Nirvachan Sadan, before being halted by Police. Congress leader and Lok Sabha MP criticised the Election Commission of India (ECI) on Monday for not providing a separate list of the 65 lakh deleted names from the draft electoral roll in poll-bound Bihar, saying that the constitutional body is providing "lame duck excuses" to hide voter fraud. He further criticised the Election Commission for hiding behind "procedural smokescreens" by giving repeated notices to Rahul Gandhi (HT Photo) "Isse kehete hai - chori aur seenachori," Surjewala said in a post on X, taking a jibe at the poll body. "Bihar's 65,00,000 (65 lakh) deleted names: Election Commission's new affidavit: Will not provide details of the 65 lakh deleted names, Will not disclose the reasons why 65 lakh names were deleted, Will not share the list of the 65 lakh deleted names," his post added, sharing a news report on the issue. Earlier in another post, the Congress leader also slammed the poll body for hiding behind procedural smokescreens, and terming it as the "Election Capture of India." "When confronted with evidence of mass manipulation of voter rolls, the Election Commission seeks to hide the "Voter Fraud" with its lame duck excuses, puerile legalese and fake technicalities. No wonder that it is now named as "Election Capture of India" - ECI," Surjewala posted on X. He further criticised the Election Commission for hiding behind "procedural smokescreens" by giving repeated notices to Rahul Gandhi asking him to prove his claims of voter fraud. "To evade scrutiny in favour of procedural smokescreens is not neutrality. It is an abdication of duty that corrodes the very democracy it is meant to protect. It is nothing short of a crime against democracy and the Constitution and these notices will not dilute the unpardonable sin it is committing," his post added. The Congress leader was reacting to the ECI submitting an affidavit in the Supreme Court, where the poll body said that the law does not require it to prepare or share any separate list of names of people missing from draft electoral rolls or publish the reasons for their non-inclusion "for any reason" whatsoever. Responding on the allegations by NGO Association for Democratic Reforms (ADR) that over 65 lakh names had been deleted from Bihar's draft electoral rolls without transparency and without disclosure of whether the deletions related to deceased persons, migrants, or other categories, ECI said no eligible voter in Bihar will be removed from the electoral rolls without prior notice during the ongoing special intensive revision (SIR) in the state. Earlier today INDIA bloc MPs also planned to march from Parliament to the ECI office at Ashoka Road, and were stopped by the Delhi police, with multiple leaders including Rahul Gandhi being detained.
