from the list of prosecution witnesses. During a hearing held on Wednesday at the magistrate's court, officials stated that Malaika does not support their case, leading to her exclusion from the witness lineup.
Malaika appeared in court with her lawyer, Archit Jaykar, after a bailable warrant was issued against her on April 7 for ignoring earlier summons. This wasn't the first time she faced such a warrant in connection with the ongoing 2012 hotel assault case involving Saif Ali Khan.
Despite her appearance in court, the Additional Public Prosecutor (APP) requested an adjournment, which was promptly denied by Magistrate K S Zanwar. Citing the age of the case and noting that Arora appeared only after 'due pursuasion,' the court emphasized the need to proceed. It also pointed out that two other witnesses, including her sister
Amrita Arora
, had recently testified—making the delay unjustifiable.
Following the proceedings, the prosecution submitted a formal request to drop Malaika as a witness, stating that she was unwilling to support the case. Magistrate K S Zanwar accepted the application and accordingly cancelled the previously issued bailable warrant against her.
With Arora no longer part of the case, the prosecution will now focus on its next key witness—NRI businessman Iqbal Sharma, the complainant in the 2012 hotel assault case.
The Additional Public Prosecutor (APP) requested that summons be sent to Sharma via email, which the court approved. The matter has been adjourned to August 22.
The case dates back to February 22, 2012, when Saif Ali Khan was dining at a luxury South Mumbai restaurant with

A heated exchange followed, during which Sharma accused Saif of punching him and fracturing his nose. He also claimed that Saif and his companions assaulted his father-in-law, Raman Patel.
Saif Ali Khan has consistently maintained that Iqbal Sharma provoked the situation by using abusive language toward the women in their group. Following the altercation, Khan and his friends Shakeel Ladak and Bilal Amrohi were arrested but later granted bail. All three have been charge-sheeted under Section 325 of the Indian Penal Code, which deals with voluntarily causing grievous hurt.

Declaring that the offence of penetrative sexual assault can be alleged even against a woman under the Protection of Children from Sexual Offences (POCSO) Act, 2012, as this law is gender-neutral, the High Court of Karnataka on Monday refused to quash a criminal case against a 52-year-old woman, who allegedly compelled a 13-year-old boy for sex with her at her residence here during 2020. The two instances of sexual assaults had allegedly taken place between May and June, 2020, when the accused woman Archana, an artist aged around 48 and the boy who was around 13 years and 10 months old then. The accused, who was the boy's neighbour, had come in contact with him through his mother, who initially sent him to the house of the accused to help her post her paintings on her Instagram account following the request made by the accused. To a therapist The boy, who was psychologically distressed, had immediately not disclosed the alleged acts to his parents, who later decided to settle down in Dubai and shifted there in August, 2020, along with him and his younger sister. He disclosed the alleged acts only in 2024 and narrated details to a therapist in Dubai, and then the complaint was lodged with the HAL police station by the boy's mother in June, 2024. The boy was aged around 17 when his statements were recorded by the magistrate and the child protection officer. It was alleged that accused woman had convinced the boy not to disclose the acts with anyone, stating that both of them would be in trouble. The accused woman's husband and daughter are said to be living abroad. Though the pronoun 'he' and its derivatives were not defined under the POCSO Act, which only states that a child is any person below the age of 18, Justice M. Nagaprasanna, relying on the definitions in the Indian Penal Code (IPC), held that the pronoun 'he' and its derivatives in POCSO will also have to be used, 'of any person, whether male or female.' 'The language of the provision clearly indicates inclusivity,' the court observed. It was argued on behalf of the accused that the victim boy could not have had an erection if he was in shock when the accused had allegedly made sexual advances. However, the court said, quoting a study, 'State of shock is a psychological concept. Erection is purely a physiological or a biological concept. Psychological concepts would not sometimes control physiological and biological actions.' No stereotypes To the submission that in an intercourse the woman is only a passive participant and a man is an active participant, the court pointed out that 'this thought itself is archaic'. It said that the jurisprudence of the present times 'does not allow stereotypes to cloud legal scrutiny'. The delay of four years in registering the complaint and non-conduct of potency test of the boy, cannot become the reason for quashing the case, owing to the alleged offence and the age of the victim boy, the court said.

Pregnant ‘Bangladeshi' woman held after she escapes custody from hospital: Mumbai Police
The Mumbai Police Monday arrested a 20-year-old woman who was nabbed during a crackdown on illegal Bangladeshi immigrants and later had fled a hospital. The woman, Rubina Shaikh, who is five months pregnant, had fled the JJ hospital where she was taken for treatment on August 14. She was nabbed from Navi Mumbai and placed under arrest on Monday. Rais Shaikh, senior inspector of JJ Marg police station ,where an FIR was registered for fleeing police custody, said that the team got details of where the woman resided and places where she went to work. 'For three days the team disguised themselves at these places and got information about her. Eventually with technical intelligence we had information that she was to come to place in Ghansoli,' the officer said. The officer said that they laid a trap at Navghar Ali Road in Ghansoli where she was expected at her friend's residence. Accordingly, on Monday as the woman reached the spot, they detained her and placed her under arrest. She was produced before the court and sent to judicial custody. The woman had earlier been arrested by the Vashi police station while conducting a drive against illegal Bangladeshi nationals. Since there is only one prison for women in Byculla, the woman was sent there till the time procedures were underway to deport her. She was brought to JJ Hospital for treatment on August 14 for treatment. Around 11 am, she had escaped from the legal custody of JJ Hospital.
