Nishikant Dubey's remarks on judiciary: Don't need our nod to file contempt plea, SC to petitioner

on Monday told a petitioner that he does not need its permission to file a
contempt petition
against BJP MP
Nishikant Dubey
over his criticism of the apex court and Chief Justice of India (CJI) Sanjiv Khanna. The matter was mentioned before a bench comprising Justices B R Gavai and Augustine George Masih.
The petitioner's counsel referred to a recent news report about Dubey's comments and said he wanted to file a contempt petition with the court's permission.
"You file it. For filing, you don't require our permission," Justice Gavai said.

Dubey launched a broadside against the Supreme Court on Saturday, saying
Parliament and state assemblies
should be shut if the apex court has to make laws.

He also took a swipe at CJI Khanna, holding him responsible for "civil wars" in the country.
Dubey's remarks came following the Centre's assurance to the court that it would not be implementing some of the contentious provisions of the Waqf (Amendment) Act till the next day of hearing after the court raised questions over them.
Later, Anas Tanveer, a Supreme Court lawyer representing one of the litigants in the Waqf Act case, wrote to
Attorney General R Venkatramani
seeking consent to initiate contempt proceedings against Dubey over his "grossly scandalous" remarks "aimed at lowering the dignity" of the top court.
"I am writing this letter under Section 15(1)(b) of the Contempt of Courts Act, 1971, read with Rule 3(c) of the Rules to Regulate Proceedings for Contempt of the Supreme Court, 1975, to humbly seek your kind consent for initiating criminal contempt proceedings against Nishikant Dubey, Member of Lok Sabha from Godda parliamentary constituency in Jharkhand, for statements made by him in public that are grossly scandalous, misleading, and aimed at lowering the dignity and authority of the Hon'ble Supreme Court of India," the letter said.
The BJP on Saturday distanced itself from Dubey's criticism of the Supreme Court, with party president J P Nadda calling the comments his personal views.
He also affirmed the ruling party's respect for the judiciary as an inseparable part of democracy.
Nadda said he had directed party leaders not to make such comments.

Supriya Sule rules out alliance with Ajit Pawar or BJP in upcoming municipal elections
Nationalist Congress Party (Sharadchandra Pawar) leader Supriya Sule has ruled out any alliance with the Ajit Pawar-led NCP or Bharatiya Janata Party (BJP) in the upcoming municipal elections. Sule is on a tour of Pune district during which she visited newly-appointed municipal commissioner Naval Kishore Ram to discuss various issues related to her Lok Sabha (LS) constituency, Baramati. At Rs20.21cr, NMC hikes civic poll budget by a record 167%
Nagpur: With the Nagpur Municipal Corporation (NMC) functioning without an elected general body since March 2022, the civic administration has steadily increased its budgetary provision for holding the impending 2025-26 civic polls, earmarking a record Rs20.21 crore. This allocation marks a significant 167% rise over the Rs7.56 crore spent during the last civic elections held in 2017 and a 242% increase compared to the Rs5.90 crore spent in 2012. The enhanced provision also reflects a 68.4% jump from the Rs12 crore NMC used to routinely set aside since 2021-22. However, with no elections announced until now, the civic body was diverting the earmarked funds towards providing basic amenities during mid-year budget revisions. Municipal commissioner and administrator Abhijeet Chaudhari, who presented a Rs5,438.61 crore budget for the 2025-26 fiscal, increased the provision anticipating State Election Commission (SEC) announcing the long-delayed polls this year. The new poll provision accounts for about 0.37% of NMC's total budget. Considering the rise in operational and administrative costs, Rs20.21 crore has been earmarked this time," the official said. The govt has now ordered ward delimitation, reviving expectations of elections after three years. Once delimitation is finalised, the SEC is expected to issue the election schedule. Civic activists have welcomed the increased allocation but warned that elections must be held without delay. "This year's enhanced poll provision shows the administration is preparing seriously," said a source. However, the election department has a staff strength of only four officials. Even though election procedures have already commenced, the civic administration is yet to increase the manpower required for the election process. Sources said the department needs at least a workforce of 20, including computer operators. An official privy to the development admitted the shortage of manpower and clarified that the manpower too would be enhanced in a couple of days.
