Dana Stubblefield released from prison after December reversal of rape conviction

Dana Stubblefield has been granted his release from custody more than four years after the former NFL star was convicted of rape and more than six weeks after that conviction was reversed by a California appellate court because of 'racially discriminatory language' used by the prosecution during the trial.
California Superior Court Judge Hector Ramon made the ruling Friday in Santa Clara, allowing Stubblefield his freedom, without having to post cash bail, as the next steps are determined. Stubblefield is required to wear an ankle monitor, can not possess firearms and is not allowed to contact his accuser.
"He has simple conditions that are pretty common," Allen Sawyer, who represented Stubblefield, along with fellow attorney Kenneth Rosenfeld, told The Times by phone after the hearing. "He has to show up to court dates if there are any future court dates, which we don't even know if there will be. But as this finalizes and we march toward a retrial or the D.A.'s office comes to their senses and does not retrial Mr. Stubblefield, ... he's released on his own recognizance.'
Santa Clara County assistant district attorney Terry Harman told The Times in a statement following Friday's hearing:
'A jury unanimously found Mr. Stubblefield guilty of raping a woman at gunpoint, he was given an appropriate sentence, and we felt that justice had been served. That justice has been interrupted and although we are disappointed that the judge released Mr. Stubblefield from custody while we await a decision from the California Supreme Court, we remain focused on the sexual assault that occurred, the victim, and the need for accountability and community safety.'
Stubblefield — a former defensive player of the year who spent his 11 NFL seasons with the San Francisco 49ers, Washington Redskins and Oakland Raiders — was charged in May 2016 with raping a woman at gunpoint the previous year. During his trial, Stubblefield's defense argued that the sex was consensual.
In October 2020, Stubblefield was sentenced to 15 years to life in prison after a jury found him guilty of forcible rape, forcible oral copulation and false imprisonment, and that he had used a firearm in committing the first two offenses.
The 6th District Court of Appeal reversed Stubblefield's conviction late last year based on the California Racial Justice Act of 2020, which prohibits judges, attorneys and aw enforcement officers, among others, from exhibiting 'bias or animus towards the defendant because of the defendant's race, ethnicity, or national origin.'
The appellate court's decision was based on language used in the prosecution's closing argument
After Friday's hearing, Stubblefield had to return to Corcoran State Prison to complete some paperwork. But Sawyer said he expects Stubblefield to be back in Santa Clara by Friday evening.
"We expect him to be home tonight," Sawyer said. "As my partner said, he'll be having a late dinner with his kids tonight.'

Each time he was asked about it, Garrett said that he preferred to discuss football. "I'd honestly prefer to talk about football and this team than anything I'm doing off the field other than the back-to-school-event that I did the other day," Garrett said when first asked about it. When pressed that "people want to know about that," Garrett again deflected. "People want to know a lot of things," Garrett continued. "I try to keep my personal life personal. And I'd rather focus on this team when I can." "Again, you're asking the same question, and I've answered it two different times," Garrett said when pressed again. Garrett's 8th speeding ticket since joining Browns Garrett was cited on Aug. 9 for driving 100 mph in a 60 mph zone in the Cleveland suburb of Strongsville, Ohio. The incident took place on Saturday morning, a day after the Browns returned home from a preseason road game against the Carolina Panthers. The citation came with a $250 fine. The speeding citation was Garrett's eighth since he joined the Browns as the No. 1 pick in the 2017 NFL Draft. In 2022, Garrett flipped his Porsche and was cited for driving 65 mph in a 45 mph zone leading up to the rollover crash. Garrett sustained a shoulder sprain and biceps strain among other minor injuries in the crash that took place in September that year and sidelined him for Cleveland's Week 4 game against the Atlanta Falcons. Garrett returned to the field the following week and played the rest of the season en route to earning second-team All-Pro honors. Garrett, 29, is entering his ninth season with the Browns as their best player and the veteran leader on the team. He signed a four-year, $160 million extension with the Browns in the offseason and will entered the 2025 season among the favorites to win Defensive Player of the Year for the second time in his career.

The NFL has suspended wide receiver Demarcus Robinson three games for violating the league's substance abuse policy, coach Kyle Shanahan said on KNBR. It is a suspension the 49ers anticipated when they signed Robinson in the offseason. Robinson was playing for the Rams when police pulled him over Nov. 25 for driving his car at a speed in excess of 100 mph. He refused a field sobriety test. In July, Robinson pleaded no contest to a misdemeanor DUI charge. A judge sentenced Robinson to 36 months of probation and imposed a $390 fine. Robinson also was given penalty assessment and was ordered to complete a series of programs, including a three-month alcohol program and a hospital and morgue program. Robinson had two other charges — driving with a 0.08 percent blood alcohol content or higher and driving without a valid license — dismissed. The 49ers open the season against Seattle, New Orleans and Arizona, games Robinson will miss before he can return for a Week 4 game against Jacksonville.

The NFL has suspended San Francisco 49ers wide receiver Demarcus Robinson for three games for violating the league's substance abuse policy, coach Kyle Shanahan said on KNBR radio Wednesday. The suspension comes a month after Robinson pleaded no contest to a misdemeanor DUI charge stemming from an arrest last November. Advertisement Shanahan said Robinson could appeal the suspension, but that the team is planning for a three-game absence. Robinson was with the Los Angeles Rams when he was arrested on Nov. 25 on suspicion of a DUI after a game against the Philadelphia Eagles. Patrol officers said his vehicle was traveling over 100 mph and that they observed 'objective signs and symptoms of alcohol impairment.' Robinson was cited and then released to a 'responsible party,' but the Rams did not suspend the receiver. The 30-year-old was charged with a misdemeanor DUI on Jan. 10. In addition to Robinson's suspension, the 49ers will likely be without receiver Brandon Aiyuk for the first few games of the regular season as he recovers from a torn ACL suffered in 2024. Meanwhile, Jauan Johnson has missed time during training camp with a calf injury, and rookie Jordan Watkins' status for Week 1 is in doubt because of a high-ankle sprain. San Francisco general manager John Lynch noted at the NFL owners' meetings this spring that he was aware Robinson could be suspended for the first three games. 'There's an opportunity that he may miss some time,' Lynch said of Robinson. Robinson signed a two-year deal with San Francisco in March after spending the last two seasons in Los Angeles.
