
Breaking up with Big Oil is hard to do
IT'S COMPLICATED: California still wants to break up with Big Oil — but it needs a ride first.
California Energy Commission Vice Chair Siva Gunda outlined his much-anticipated plan on Friday to keep gas prices from spiking as the state weans itself off of oil. TLDR: Support in-state crude oil production, boost imports of refined oil — and pause a profit cap on refineries passed by the Legislature and signed by Gov. Gavin Newsom in 2023.
Newsom had already previewed the pivot when he asked Gunda to redouble efforts to keep in-state refineries operating profitably in April after two of them announced plans to close amid a long-term decline in demand. The recommendations on Friday not only mark a softening of the state's fight against the oil and gas industry, but also a recognition that attacks from Republicans on gas prices are sticking.
'The gist is, 'We get it,'' Natural Resources Secretary Wade Crowfoot told reporters Friday.
California's climate officials are now on the tightest of political tightropes. For example, Gunda recommended the Legislature waive some environmental review rules to streamline further oil extraction from oilfields in Kern County — while also expanding limitations on new offshore oil and gas development and codifying a ban on well stimulation treatments.
Meanwhile, the California Air Resources Board stuck by its hot-button emissions trading program for transportation fuels, announcing Friday that their changes to the low-carbon fuel standard will take effect early next week despite fears that tightening the restrictions on the carbon intensity of fuels could cause a spike in gas prices.
Senate Democrats are already girding for a fight with the agency. They introduced a bill backed by Senate Pro Tem Mike McGuire on Tuesday to freeze credit prices that encourage the switch to electricity, hydrogen and other non-fossil fuels, cutting the legs out from under the program.

The state's top air quality official pushed back against the bill, SB 237, in an interview Friday, saying the proposal 'is just irresponsible' after the Trump administration already revoked the state's power to enforce its electric car and heavy-duty truck mandates.

This interview has been edited for length and clarity.
What are you concerned about as the news of the LCFS changes taking effect becomes public, and what are you trying to get ahead of?
It's super important to be proactive, to remind people about the importance of this program. It is designed to provide a cost-effective path to support the transition to lower-carbon fuels and to zero-ignition infrastructure that reduces greenhouse gas emissions, right? And so in all of this conversation about cost, I don't want people to forget about the incredible benefits of the program and the fact that it's generated $4 billion in annual private sector investment in the clean transportation sector.
It attracts dollars. It attracts investment in the state. It delivers, under our estimate, $12 billion in health-related savings, and California businesses will see increased revenue of $6 to $8 billion from LCFS credit generation sales through the life of the program. It's really important to emphasize that this program has clear economic benefits.
This news is coming against the backdrop of SB 237, a new bill that would weaken the LCFS program. Do you regret at all how the rulemaking was done and the initial estimate that LCFS would raise gas prices up to 47 cents? Has that put you in the crosshairs of lawmakers?
The LCFS rulemaking was an incredibly robust process. There were multiple workshops, tons of stakeholder engagement, two public hearings in front of the board. So the idea that there was not a robust public discussion about all the pros and cons of all of the complexities of the program is just inaccurate. And we had multiple briefings with legislative staff, outreach from members that we responded to. So it was an absolutely robust public process.
The second thing I'll say is that in this era, when the federal administration is literally taking away every tool that they can think of, the idea that we as a state would attempt to cripple programs that have been effective, that have resulted in economic development and better air quality, cleaner fuels, reduced greenhouse gas emissions, is just irresponsible.
SB 237 is endorsed by Senate President Pro Tem Mike McGuire. How seriously do you take it, have you talked to the governor about this, and what could result from a proposal like this even if it doesn't move forward?
It is a proposal that has the potential to set California back. And I think that it's really important for our elected leaders to be thinking about all the different aspects of how we achieve our air quality and climate goals, and to recognize that we as Californians really should control our own destiny as much as we possibly can. — AN
SEE YA, CEQA: Newsom is asking lawmakers to approve an overhaul of one of California's landmark environmental laws before he signs off on this year's budget.
A trailer bill introduced Friday carves out sweeping exemptions from the California Environmental Quality Act, which mandates environmental reviews of construction and has drawn the ire of pro-building and Republican voices accusing it of slowing down key projects.
Under the bill, environmental review of housing projects would be limited, and many wildfire mitigation projects, including fuel breaks near homes and vegetation thinning near evacuation routes, would no longer need to be reviewed. Improvements to certain community water systems as well as some construction on the state's high-speed rail project would also be exempted.
The exemptions got immediate praise from the California State Association of Counties on Friday.
'No longer will CEQA be leveraged to stall critical county wildfire, water and housing projects,' said CSAC President and Inyo County Supervisor Jeff Griffiths.
They were panned, however, by environmental groups. 'The trailer bill 131 is the worst rollback of environmental and public health protections that we've seen in decades,' said Matthew Baker, the policy director at the Planning and Conservation League, in a press conference Friday.
The bill is expected to be approved Monday in the statehouse and then signed into law by the governor. — CvK
BYE BYE, LOCOMOTIVES: CARB officially repealed its rule to phase out diesel locomotives Thursday night.
Board members voted unanimously to revoke the in-use locomotive rule, six months after the agency announced that it had withdrawn the emissions standard from consideration for an EPA waiver, once it became clear approval wouldn't happen before former President Joe Biden left office.
The rule, approved in April 2023, was projected to reduce 386,300 tons of smog-forming nitrogen oxides by 2050, making it CARB's most impactful vehicle emissions standard.
The loss compounds the blow from car and truck rules being axed, and means regions like Southern California and the Central Valley are all but guaranteed to be out of compliance and face the threat of federal sanctions. — AN
BILLABLE HOURS: A Sacramento County Superior Court judge gave Attorney General Rob Bonta the green light late Thursday to keep his big climate lawsuit against oil and gas companies in the hands of an outside firm, Lesley Clark of POLITICO's E&E News reports.
The decision to outsource the headline-grabbing lawsuit to the San Francisco law firm Lieff Cabraser Heimann & Bernstein got Bonta in a tussle with his own employees. Their union, the California Attorneys, Administrative Law Judges and Hearing Officers in State Employment sued over the decision, arguing in-house lawyers were capable of handling the complex work themselves.
But Judge Shelleyanne Chang wrote in her preliminary ruling that there was not enough evidence of that and that hiring an outside firm was well within state law.
As Lesley has previously reported, the state's contract with Lieff Cabraser Heimann & Bernstein lawyers shows its lawyers billing up to $1,241 an hour; lawyers with another outside firm, Sher Edling, hired to help with the work are making up to $625 an hour. — CvK

California closes $12-billion deficit by cutting back immigrants' access to healthcare
SACRAMENTO — California Gov. Gavin Newsom signed on Friday a budget that pares back a number of progressive priorities, including a landmark healthcare expansion for low-income adult immigrants without legal status, to close a $12-billion deficit. It's the third year in a row the nation's most populous state has been forced to slash funding or stop some of the programs championed by Democratic leaders. Lawmakers passed the budget earlier in the day following an agreement of a $321-billion spending plan between Newsom and Democratic leaders. But the whole budget will be void if lawmakers don't send him legislation to make it easier to build housing by Monday. The budget avoids some of the most devastating cuts to essential safety net programs, state leaders said. They mostly relied on using state savings, borrowing from special funds and delaying payments to plug the budget hole. 'It's balanced, it maintains substantial reserves, and it's focused on supporting Californians,' Newsom said in a statement about the budget. California also faces potential federal cuts to healthcare programs and broad economic uncertainty that could force even deeper cuts. Newsom in May estimated that federal policies — including on tariffs and immigration enforcement — could reduce state tax revenue by $16 billion. 'We've had to make some tough decisions,' Senate President Pro Tempore Mike McGuire said Friday. 'I know we're not going to please everyone, but we're doing this without any new taxes on everyday Californians.' Republican lawmakers said they were left out of budget negotiations. They also criticized Democrats for not doing enough to address future deficits, which could range between $17 billion to $24 billion annually. 'We're increasing borrowing, we're taking away from the rainy day fund, and we're not reducing our spending,' said Republican state Sen. Tony Strickland prior to the vote. 'And this budget also does nothing about affordability in California.' Here's a look at spending in key areas: Under the budget deal, California will stop enrolling new adult patients without legal status in its state-funded healthcare program for low-income people starting 2026. The state will also implement a $30 monthly premium July 2027 for immigrants remaining on the program, including some with legal status. The premiums would apply to adults under 60 years old. The changes to the program, known as Medi-Cal, are a scaled-back version of Newsom's proposal in May. Still, it's a major blow to an ambitious program started last year to help the state inch closer to a goal of universal healthcare. Democratic state Sen. María Elena Durazo broke with her party and voted 'no' on the healthcare changes, calling them a betrayal of immigrant communities. The deal also removes $78 million in funding for mental health phone lines, including a program that served 100,000 people annually. It will eliminate funding that helps pay for dental services for low-income people in 2026 and delay implementation of legislation requiring health insurance to cover fertility services by six months to 2026. But lawmakers also successfully pushed back on several proposed cuts from Newsom that they called 'draconian.' The deal secures funding for a program providing in-home domestic and personal care services for some low-income residents and Californians with disabilities. It also avoids cuts to Planned Parenthood. Lawmakers agreed to let the state tap $1 billion from its cap-and-trade program to fund state firefighting efforts. The cap-and-trade program is a market-based system aimed at reducing carbon emissions. Companies have to buy credits to pollute, and that money goes into a fund lawmakers are supposed to tap for climate-related spending. Newsom wanted to reauthorize the program through 2045, with a guarantee that $1 billion would annually go to the state's long-delayed high-speed rail project. The budget doesn't make that commitment, as lawmakers wanted to hash out spending plans outside of the budget process. The rail project currently receives 25% of the cap-and-trade proceeds, which is roughly $1 billion annually depending on the year. Legislative leaders also approved funding to help transition part-time firefighters into full-time positions. Many state firefighters only work nine months each year, which lawmakers said harms the state's ability to prevent and fight wildfires. The deal includes $10 million to increase the daily wage for incarcerated firefighters, who earn $5.80 to $10.24 a day currently. The budget agreement will provide $80 million to help implement a tough-on-crime initiative voters overwhelmingly approved last year. The measure makes shoplifting a felony for repeat offenders, increases penalties for some drug charges and gives judges the authority to order people with multiple drug charges into treatment. Most of the fund, $50 million, will help counties build more behavioral health beds. Probation officers will get $15 million for pretrial services and courts will receive $20 million to support increased caseloads. Advocates of the measure — including sheriffs, district attorneys and probation officers — said that's not enough money. Some have estimated it would take around $400 million for the first year of the program. Newsom and lawmakers agreed to raise the state's film tax credit from $330 million to $750 million annually to boost Hollywood. The program, a priority for Newsom, will start this year and expire in 2030. The budget provides $10 million to help support immigration legal services, including deportation defense. But cities and counties won't see new funding to help them address homelessness next year, which local leaders said could lead to the loss of thousands of shelter beds. The budget also doesn't act on Newsom's proposal to streamline a project to create a massive underground tunnel to reroute a big part of the state's water supply. Arizona governor caps off quarrelsome legislative session with budget approval
PHOENIX -- Arizona Gov. Katie Hobbs signed on Friday a bipartisan budget that boosts pay for first responders and increases spending on social services, capping a quarrelsome session of the Republican-led Legislature that brought the state to the brink of a government shutdown. The first-term Democrat broke her veto record, sparred with Republicans over agency leadership nominations and got on board with bipartisan proposals that ruffled the feathers of some members of her party. The session unfolded while Hobbs' 2026 bid to hold the reins of the battleground state loomed large. Hobbs began the session with an uphill climb, confronting expanded Republican majorities in the House and Senate. Arizona is one of eight states where the governor's office and legislature are controlled by opposing parties. Hobbs' office chose to negotiate on just a handful of issues this session, including water policy, funding for some of Arizona's most vulnerable residents and renovations to a stadium used by the Arizona Diamondbacks. The Legislature sent the governor a $17.6 billion budget after GOP lawmakers traded barbs with each other and Hobbs' office. The Senate approved one version, but it lacked votes in the House, leaving lawmakers in that chamber to introduce a measure meant to keep state operations running while negotiations continued. On Wednesday, Hobbs vetoed the proposal favored by House Republicans and the continuation measure, calling them partisan and reckless. House Speaker Steve Montenegro introduced amendments to the budget proposal Thursday, and the chamber passed it that night, clearing the way for the Senate to sign off. 'Our principles haven't changed. We've led responsibly in a divided government, fought to preserve conservative priorities, and made this budget better than it would have been without us,' Montenegro said in a statement Friday. Hobbs indicated last fall that she was willing to work with President Donald Trump's administration on border security issues like stopping fentanyl trafficking and followed up in January calling the Laken Riley Act 'an important step forward" in a post on the social platform X. The act requires detention of unauthorized immigrants accused of theft and violent crime. Hobbs' stance drew praise from GOP Senate President Warren Petersen, while members of her own party criticized the measure. She signed an executive order in February to create a task force that would oversee expanded operations at the border, but she later vetoed a measure that would have required local and state officials to cooperate with federal immigration enforcement efforts. Senate Minority Leader Priya Sundareshan, a Democrat, said her caucus pushed Hobbs to limit spending on border support, saying it had 'drawn a hard line' and planned to withhold votes on the state budget until the border funding was reduced. Democratic Senate Assistant Minority Leader Sen. Catherine Miranda, who voted against the budget, said last week that she could not support a budget that has language that opens the door to immigration enforcement. 'And while I know that Gov. Hobbs has promised she will not use the Local Border Support Fund to enforce immigrant laws, the language included in a bill has as much impact as the actual policy implementation,' Miranda said. Progressive lobbyist Marilyn Rodriguez said she would have liked to see Hobbs take a less hawkish posture on border security. Despite some frustrations, House Democratic Leader Oscar De Los Santos said the budget delivers on priorities that include public education, Medicaid and expanded health care for certain patients. 'We also make big investments to bring down the cost of childcare and make college tuition free for Arizona's students from working families,' he said in a statement. Hobbs is no stranger to the veto pen, which she has wielded to knock down what she considers proposals that are out of touch with the state's purple electorate. This year, she vetoed about 170 bills, including an attempt to speed up the counting of ballots. She's repeatedly accused state Sen. Jake Hoffman, who chairs the Legislature's Freedom Caucus, for politicizing the confirmations of her agency head nominees. Her fight with Republicans over funding for a state agency that provides services for some of Arizona's most vulnerable residents led to a moratorium on bill signing, and she has criticized Republicans for hitting the breaks on a proposal that could have led to increased regulation of groundwater pumping in rural areas of the drought-stricken state. Nebraska Republican Don Bacon will not seek re-election to Congress
WASHINGTON — Rep. Don Bacon, a centrist Republican who represents a key battleground district in Nebraska, is planning to announce his retirement from Congress, according to two sources familiar with the situation. He is expected to make a formal announcement as soon as next week, when the House is poised to vote on President Donald Trump's sweeping legislation dubbed the 'Big Beautiful Bill.' Then-Vice President Kamala Harris carried the district by nearly 5 percentage points in 2024 — making Bacon one of just three House Republicans to serve in a district Harris won.
