DCP (Crime) Nikhil Pingale confirmed that the Pune district collector, representing the state government, granted the police permission to move the appeal on July 31. 'We filed the application on August 4 after the district collector gave us permission for the same.'
'We have challenged the Juvenile Justice Board's order on the grounds that it is illegal and arbitrary. Given the gravity of the offence and the accused's age, 17 years and 8 months, a psychological evaluation was necessary to determine whether he should be tried as an adult,' Shishir Hiray, the government's lawyer said.
The appeal, filed under Section 101 of the Juvenile Justice (Care and Protection of Children) Act, 2015, argues that JJB's order is 'illegal and arbitrary.' Advocate Sarthi Pansare, assisting Hiray, said the accident should be treated as an exceptional case, given the severity and surrounding circumstances.
' A psychological assessment was essential to determine whether he had the mental capacity of a minor or an adult at the time,' Pansare said.
The appeal also highlights that the application of Section 467 of the Indian Penal Code (forgery involving tampering with blood samples, considered a form of valuable security) brings the possibility of life imprisonment. 'Even though Section 467 does not carry a minimum sentence, if a minor is convicted under this section, Section 233(2) of the JJ Act provides for a minimum of seven years' imprisonment if tried as an adult,' Pansare added.
The case drew nationwide attention after JJB initially granted bail to the teen with lenient conditions, including writing a 300-word essay on road safety.

The State government on Tuesday gave an undertaking to the High Court of Karnataka that it would neither publish nor circulate the John Michael Cunha Commission report on the stampede outside M. Chinnaswamy stadium in Bengaluru on June 4. State Advocate-General gave this assurance before a Division Bench, comprising Justice Jayant Banerji and Justice Umesh M. Adiga, during the hearing on a petition filed by DNA Entertainment Networks Pvt. Ltd., the event management partner of Royal Challengers Sports Pvt. Ltd., which owns Royal Challengers Bengaluru (RCB). DNA had filed the petition complaining that the commission violated the provisions of the Commissions of Inquiry Act (CoI Act), 1952, in the procedure adopted in conducting the inquiry, while contending that the commission had not given an opportunity to DNA to cross-examine witnesses. While it has been alleged in the petition that the government had leaked the commission's report to the media, the A-G told the court the government had nothing to do with reports in the media. In response to A-G Shashi Kiran Shetty's undertaking, senior advocate B.K. Sampath Kumar, appearing for DNA, told the Bench that the government, while refusing to give a copy of the commission's report to DNA, had responded in writing that the report of the commission was already given to the Criminal Investigation Department (CID), which is probing the stampede incident based on three First information Reports registered on June 5. However, the A-G said that the CID has been investigating the stampede incident from June. Meanwhile, the Bench orally remarked that 'some observations in the commission's report are shocking... they are all not hardened criminals... we are not making any observations at this stage', while adjourning hearing on the petition till September 4 as the A-G stated that the government would file its written objection to the petition. Earlier, the Bench posed some questions to the A-G about certain differences in the procedure followed by the commission and the provisions in the Act.

The Delhi High Court on Wednesday said use of children by criminals to commit wide-ranging crimes had prompted the reconsideration of the juvenility age. Justice Girish Kathpalia made the observations while dismissing an anticipatory bail plea of a man accused of using a child in illicit liquor trafficking. The judge said far more serious than the illicit liquor trafficking was the child abuse in carrying out such crimes. "Over a period of time, it is being observed that criminals use children to commit wide ranging crimes, involving not just liquor and drugs peddling but also arms/ammunition and even acts of extreme violence, which is leading the society to consider re-fixing the age of juvenility. In my view, far more serious than the illicit liquor trafficking is the child abuse in carrying out such crimes," the court noted. In the case at hand, one Narender was booked on the directions of Juvenile Justice Board, when the juvenile in conflict with law was produced before it. The board directed the FIR against the man primarily for the reason that the juvenile in conflict with law could not be the accused and the victim in the same FIR, the prosecution said. The high court denied the relief to the accused, saying it had to be unearthed whether there was a wide network engaged in similar activities using children. "Apart from the gravity of the offence, it is also the requirement of police to carry out custodial interrogation of the accused, which is significant. It is necessary to unearth if there was/is any other incident of similar nature involving the accused/applicant and any child. It also needs to be unearthed if there is a wide network engaged in similar activities using children. Therefore, I do not find it a fit case to grant anticipatory bail to the accused/applicant," the court said.

The Gopalapuram police have transferred the Universal Srushti Fertility Centre child-trafficking and surrogacy case to the Special Investigation Team (SIT) of the CCS, Hyderabad, for further investigation. So far, 25 people, including five doctors, have been arrested in connection with nine cases registered at the Gopalapuram police station. These arrests are linked to an alleged inter-state racket. The main accused, Dr Athaluri Namratha, along with seven others, was arrested on 27 July following an FIR registered on 25 July. The case began after a Hyderabad couple complained that the fertility centre, run by Dr Namratha, had cheated them of over Rs 30 lakh in a surrogacy deal. They alleged that the centre gave them another couple's child instead of their own. After this complaint, seven more couples came forward, leading to seven more cases being registered under the Bharatiya Nyaya Sanhita (BNS) and the Surrogacy (Regulation) Act. Another case was filed by a 90-year-old gynaecologist, Suri Srimathi, who said her name had been illegally used on the centre's letterhead to carry out illegal activities. The victim couples alleged that they had first approached the centre for IVF treatment. As quoted by TOI, they said Dr Namratha convinced them to choose surrogacy instead, charging more than Rs 30 lakh for 'guaranteed babies'. The couples were never told who the surrogate mothers were. In one case, a couple was told their surrogate child had died at birth, while DNA tests in two other cases did not match the babies given to the clients. North Zone DCP Rashmi S Perumal said, as reported by TOI, that Dr Namratha ran a network of clinics in Secunderabad, Kondapur, Visakhapatnam, Vijayawada, Nellore, Rajahmundry, Bhubaneswar, and Kolkata. The alleged method was to attract couples through IVF, then persuade them to switch to surrogacy, promising to handle all legal reportedly convinced financially struggling women to sell their babies, paying Rs 3.5 lakh for a girl and Rs 4.5 lakh for a boy. Victims were charged Rs 30–40 lakh. The DCP added, as quoted by TOI, that the accused faked DNA and medical reports by using the biological mother's DNA in place of the client' arrested include Dr Namratha; her son PSS Jayanth Krishna; doctors from Visakhapatnam and Gandhi Hospital; embryologists; branch managers; nurses; agents; and three parents who allegedly agreed to the illegal sale of their have seized about 50 files from the centre's offices and are checking them for more possible victims. Bank accounts linked to the accused have been frozen. According to police, Dr Namratha was previously involved in 15 criminal cases across Hyderabad, Visakhapatnam, Vijayawada, and Guntur. Some were settled, while others are still in court.'We have invoked provisions of Organised Crime under the BNS against the accused.
