Legal framework for whistleblowers too rigid, says integrity institute chief [WATCH]
IIM president and chief executive officer Datuk Ahmad Ramdzan Daud said more safeguards are needed to protect those who dare to expose wrongdoing from within.
"Who would willingly come forward with information about a syndicate if their own life is at serious risk?" he said.
Ramdzan, a former Special Branch director, said the legal requirements should not discourage the very people the system needed to come forward.
The current internal systems, particularly supervisory roles and structural vulnerabilities, must be reviewed, he said.
Ramdzan, who is also the former Special Branch director, said whistleblowers aren't created overnight.
"A person working inside a syndicate, for example, has likely been involved in its activities for some time. It's not as simple as someone working today and turning into a whistleblower tomorrow. They've likely thought long and hard about the risks involved.
"If they're willing to come forward, then we have to ask: what can we offer them? And more importantly, is that offer worth the risk in their eyes? They know that the moment they blow the whistle, their identity is essentially exposed. They become a target. And that's where we step in — to offer protection and support."
Ramdzan's statement comes as the government is pressing ahead with reforms to the Whistleblower Protection (Amendment) Bill 2025, which were passed in the Dewan Rakyat last month.
Some of the amendments were expanding reporting channels and including the possibility of allowing disclosures to parties other than enforcement agencies, with the aim of encouraging more whistleblowers to come forward without fear.
Civil society organisations and politicians have called for more changes, such as protection for disclosures made in good faith to the media, and for whistleblowers who may have been complicit but are key to exposing systemic abuse.
Under the current law, protection is only extended when disclosures are made to enforcement agencies, such as the Malaysian Anti-Corruption Commission.
Public disclosures — including to the media — are excluded, and whistleblower protection may be revoked if the informant is found to be involved in the offence.
Ramdzan said formalising a "risk-and-reward" mechanism waskey to effective deterrence and could help address the limitations of the existing Whistleblower Protection Act 2010.
He said whistleblowers who help prevent significant financial losses should be fairly compensated.
"If we manage to prevent the leakage of RM1 million in subsidised goods, is it unreasonable to suggest that 10 or 15 per cent go to the informant?" he said.
He said a certificate of appreciation carries little weight and informants who provide information leading to major busts should receive meaningful rewards.
However, he cautioned that whistleblowing must not be driven purely by personal gain.
"If every case involving money turns into a reward opportunity, we risk losing control," he said. "If someone comes forward out of revenge, such as failing to secure a contract, they are an offender too. Integrity must exist even in the whistleblower," he added.

KUALA LUMPUR: Traditional fishing communities risk being sidelined by the e-invoicing policy, which remains bogged down by red tape, says Tanjung Piai MP Datuk Seri Wee Jeck Seng. He urged Putrajaya to address mounting challenges faced by owners and operators of licensed Zone B and Zone C fishing vessels, particularly the costly and time-consuming process of ownership transfers, which is now mandatory for e-invoicing compliance. "This bureaucratic red tape, coupled with high costs, is threatening the livelihoods of traditional fishing operators. Has a proper social impact study been done before implementing this policy?" he asked during the 13th Malaysia Plan (13MP) debate in the Dewan Rakyat on Thursday (Aug 7). He proposed a moratorium on the requirement, especially for small-scale fishermen struggling with finances and documentation. A solution, he said, would be to simplify the process. He also criticised the recent shift in labour policy that bans Zone B operators from hiring foreign workers – previously allowed under the 6P programme – which turned their existing crew illegal overnight. "Most locals are unwilling to work under harsh sea conditions. Will the government review this policy?" he said. On jetty operations, he raised concerns over monopolistic practices at Fisheries Development Authority (LKIM) facilities. He proposed an independent monitoring body to oversee transparent management and prevent abuse. Wee also pointed out that current LKIM jetty operating hours of 8am to 5pm are unrealistic, as fishing schedules are dictated by tides. He urged authorities to review and extend the hours based on actual field needs. "We cannot allow small fishermen to be crushed by rigid and overly technical systems. "Saving this sector is vital – not just for the economy, but for the survival of coastal communities who form the backbone of our food supply," he added. On urban poverty, Wee said the rising cost of living is hitting city households hard, despite Malaysia's economic growth. He cited Statistics Department data showing a stark difference between rural and urban living – RM1,423 per capita monthly in urban areas compared to RM927 in rural zones. He urged the government to reconsider the RM1,700 monthly minimum wage, especially for urban workers and to expand intervention measures in cities like Kuala Lumpur. On healthcare access, Wee highlighted urgent needs at KK3 Serkat health clinic in Pontian, which is operating with an ageing, cramped ambulance lacking CPR equipment. He appealed for a modern, fully equipped replacement and long-term plans for a new facility to serve the growing population.

Guan Eng criticised for opposing minimum wage, EPF for migrants
KUALA LUMPUR: DAP national adviser Lim Guan Eng has been criticised by labour rights groups for opposing the minimum wage and Employees Provident Fund (EPF) contributions for migrant workers. UNI-Malaysia Labour Centre (UNI-MLC) president Datuk Mohamed Shafie BP Mammal said Lim's stance was disappointing and shameful, especially from a former cabinet minister who had previously championed workers' rights. "To deny even the most basic form of social protection to workers doing the dirty, dangerous and difficult (3D) jobs, simply because they were not born here, is inexcusable," he said in a statement today. Shafie, who is also Asean Services Employees Trade Union Council (ASETUC), said migrant workers deserved equal treatment, including a minimum wage and EPF contributions. He commended the Madani government for recognising their contributions to nation-building. "Lim should have been proud of Malaysia under Prime Minister Datuk Seri Anwar Ibrahim for demonstrating progressive reforms by upholding fair treatment for all workers," he said. Shafie added that if Lim refused to acknowledge this, it showed the former finance minister was speaking based on emotion rather than fact. "Lim's comments discredited the government's bold and principled action. He also cited International Labour Organisation (ILO) standards. He should be supporting—not opposing—better treatment for all workers regardless of their origin," he said. Echoing this sentiment, Labour Law Reform Coalition (LLRC) deputy president Andrew Lo said the Bagan member of parliament's remarks were deeply troubling and could further entrench Malaysia's reliance on cheap labour. "He is giving employers a licence to employ foreign workers with lower salaries and therefore destroying the job market for Malaysian workers," said Lo, who is also chief executive officer of the Sarawak Bank Employees' Union. He said such a move would betray the interests of local workers. Lo said Lim lacked an understanding of labour economics and perpetuated 'Malaysians' employer addiction to cheap labour and low wages'. "He has also offended the ILO Convention 100 on equal pay for equal work, which Malaysia ratified in 1997, and he had no respect for anti-discrimination principles. "Singapore does not have a minimum wage framework at all, so it is totally misconceived to compare with Singapore," Lo said. The controversy arose after Lim argued during a debate on the 13th Malaysia Plan in Parliament earlier this week that there was no need to mandate the RM1,700 minimum wage and 2 per cent EPF contributions for migrant workers. He cited Singapore's exclusion of foreign workers from its Central Provident Fund scheme since 2003 and said it had not faced any repercussions from the ILO.
