
Court rejects lorry driver guilty plea over assault due to photo discrepancy
GEORGE TOWN: The magistrate's court here today rejected a guilty plea by an assistant lorry driver charged with assaulting a policeman at the state police contingent headquarters, after the accused failed to identify several photographs related to the incident.
S.R. Aingaran, 19, had earlier pleaded guilty to intentionally causing injury to Ahmad Jabarul Yahya Arif, 31, by punching him in the cheek and biting his chest during an incident at the guard post of the headquarters around 9.40pm on Sunday.
However, magistrate Nurul Suhaila Baharin declined to accept the plea after Aingaran was unable to recognise some of the images presented in court.
"The court does not accept your guilty plea as you failed to identify several photographs presented to you," she said.
The charge, framed under Section 323 of the Penal Code, carries a maximum sentence of one year's imprisonment, a fine of up to RM2,000, or both, upon conviction.
The court fixed July 21 for mention and for the accused to appoint legal representation, as well as for document submission.
Deputy public prosecutor Lau Shavin proposed bail at RM5,000, but S. Bommy, a lawyer from the National Legal Aid Foundation, appealed for a lower sum, citing the accused's financial situation.
"My client is only 19 years old and earns RM1,800 a month as an assistant lorry driver," she said.
The court subsequently set bail at RM3,000 with one surety, and warned the accused and his family against contacting or harassing the victim.
"If any complaint is received, the court will revoke the bail," the magistrate said.
It was earlier reported that two men, aged 19 and 20, were arrested for allegedly assaulting a policeman near the main gate of the state police headquarters on suspicion of being intoxicated.
The incident reportedly occurred after the 30-year-old policeman conducted an initial check and brought the duo into the guard post for further inspection. Inside, they allegedly became aggressive, punching the officer and biting his chest, while also hurling verbal abuse.

MACC Probes Alleged Misuse Of RM12 Mln Involving Sapura Energy
PUTRAJAYA, June 25 (Bernama) -- The Malaysian Anti-Corruption Commission (MACC) is investigating the alleged misuse of RM12 million, believed to be linked to two cases involving the oil and gas solutions provider Sapura Energy Bhd. Its Chief Commissioner, Tan Sri Azam Baki said in the first case, statements from 15 witnesses have been recorded, but no arrests have been made so far. He said that the MACC has also frozen assets or properties belonging to a director of Sapura Petroleum and his family, as well as two luxury homes valued at RM5.5 million owned by the company's chief executive officer (CEO). "In this first case, the investigation is ongoing, and we are determining whether the RM12 million constitutes an offence under Section 23 of the MACC Act," he said at a press conference held at the MACC headquarters here today. Azam said the incident took place in 2018, during a time when Permodalan Nasional Bhd (PNB) injected funds into Sapura Energy, thereby making it a government-linked company (GLC). "When we say a GLC, it means the government has a stake in it. Therefore, any misuse of funds will fall under offences stipulated in our act, namely Section 23 of the MACC Act or possibly other offences under the Penal Code," he said. Azam said the second case involves allegations of bribery by a foreign party to a CEO in 2011 in an attempt to secure a project owned by Sapura Energy. "This bribery case involves a total of USD 3.3 million (RM14 million). At the time, the company was known as Sapura Crest, under Sapura Energy. A subcontract was awarded to a foreign company in Brazil. The payment was made by an agent and routed through a (foreign) country, via the Netherlands and channelled through Singapore", he said. He said that the MACC has to submit multiple requests for Mutual Legal Assistance (MLA) to relevant countries to obtain further information.

Syed Saddiq acquitted of all corruption charges [WATCH]
PUTRAJAYA: Syed Saddiq Syed Abdul Rahman has been acquitted of all corruption charges today. A three-judge Court of Appeal panel led by Datuk Ahmad Zaidi Ibrahim allowed the former youth and sports minister's appeal, setting aside his conviction, seven-year prison sentence, RM10 million fine, and two strokes of the rotan. Other members of the bench were Datuk Azman Abdullah and Datuk Noorin Badaruddin. On July 22, 2021, Syed Saddiq was charged, as the then Parti Pribumi Bersatu Malaysia Armada wing chief entrusted with control of Armada funds, with abetting Bersatu assistant treasurer Rafiq Hakim Razali in committing criminal breach of trust (CBT) involving RM1 million of the organisation's funds. The former youth and sports minister was also charged with misusing property for personal benefit, namely, RM120,000 from the Maybank Islamic Bhd account belonging to Armada Bumi Bersatu Enterprise (ABBE), by causing Rafiq to dispose of the money. He was further charged with two counts of money laundering involving two transactions of RM50,000, believed to be proceeds of unlawful activities, from his Maybank Islamic Bhd account into his Amanah Saham Bumiputera account. Reading the unanimous decision, Noorin said the lower court had erred in failing to properly evaluate the evidence and the legal elements required to prove the charges against Syed Saddiq. "The act of telling, instructing, or ordering someone to withdraw money cannot be considered as disposal of the money. "The act of withdrawing the money itself does not satisfy the element of actus reus (the physical act of a crime). "The learned trial judge also erred in referring to Article 24(8) of the Bersatu Constitution and in equating 'withdrawal' with 'expenses' under the same provision. "To read the word expenses (perbelanjaan) as necessarily encompassing withdrawal (pengeluaran) is not a conclusion that must follow from Article 24(8) of the Bersatu Constitution. "As such, the withdrawal of the RM1 million from Armada's account by PW13 (prosecution witness Rafiq Hakim) cannot be said to have been used or disposed of in violation of a direction of law," she said. Noorin said the principal offence of criminal breach of trust in the case was groundless, as it was undisputed that the RM1 million withdrawn was not misappropriated but used for Armada's programmes. She said the appellant could not be said to have abetted the commission of CBT when the offence itself did not meet any of the elements under Section 405 of the Penal Code. "The real issue arising from the abetment charge is whether the alleged instruction or command by the appellant to PW13 to withdraw the RM1 million amounts to abetment to commit criminal breach of trust. "It is our considered view that causing, commanding or instructing someone to withdraw money cannot be equated to 'disposal' or 'conversion' as prescribed under Section 405 of the Penal Code. "There must be actual usage of the money in the first place," she said, adding that no evidence showed the appellant had received a single sen from the impugned sum, as all the monies were spent on Armada's programmes or activities. Regarding the charge of misusing RM120,000 in cash, the court said the money came from fundraising efforts and was intended to fund the appellant's election campaign, she said. Therefore, the money essentially belonged to the appellant. "We find that even PW13 did not say the RM120,000 belonged to ABBE. "Instead, he testified that the account belonged to ABBE and that the money was deposited into it. We find not an iota of evidence showing that the money belonged to ABBE or Armada. There was no attempt by the prosecution to lead evidence that it was ABBE's money, or that ABBE's account was used to receive donations as a result of the appellant's appeal for assistance with his election expenses," she said. The court concluded that the prosecution had failed to adduce credible evidence or facts to support the Section 403 charge in a way that was believable or capable of belief. Syed Saddiq was represented by lawyers Datuk Mohd Yusof Zainal Abiden, Datuk Hisyam Teh Poh Teik, S. Devanandan, Alex Tan, Kee Wei Loon, Low Wei Loke, Khairuzzaman Ridha, and Hing Heng Shen. The prosecution was represented by Deputy Public Prosecutors Datuk Wan Shaharuddin Wan Ladin, Farah Ezlin Yusop Khan, Nurul Qistini Qamarul Abrar, Muhammad Ashraf Mohamed Tahir, and Wan Nur Iman Wan Ahmad Afzal.

Felda land scheme officer charged with cheating senior citizen
SEREMBAN: A Federal Land Development Authority (Felda) Land Scheme officer pleaded not guilty at the Sessions Court here Wednesday (June 25) to a charge of cheating a senior citizen in relation to repair works at a rubber collection centre two years ago. Eddy Khirin Bunaim, 45, entered the plea after the charge was read before Judge Darmafikri Abu Adam. He is accused of deceiving a 68-year-old man into signing a Felda Lui Selatan 1 Village Development and Security Committee cheque, supposedly for a RM12,000 payment to a supplier. The payment was purportedly intended as an advance for repair works at the Felda Lui Selatan 1 and 2 Rubber Collection Centres, even though the said supplier had not been appointed to carry out the works. The offence was allegedly committed at a bank branch in Bahau on March 16, 2023. He was charged under Section 420 of the Penal Code, which carries a sentence of between one and 10 years' imprisonment, with caning, and a fine upon conviction. Malaysian Anti-Corruption Commission (MACC) prosecuting officer Zainab Yahaya proposed bail at RM15,000, with an additional condition requiring the accused to report to the nearest MACC office monthly until the conclusion of the trial. The accused, who was unrepresented, appealed for minimal bail on the grounds that he is the sole provider for four school-going children and is currently pursuing further studies. The court allowed bail at RM5,000 with one surety and imposed the additional conditions. The case has been fixed for mention on Aug 14. - Bernama
