[UPDATED] Govt urged to defer RON95 subsidy rationalisation implementation

KUALA LUMPUR: The Petroleum Dealers Association of Malaysia (PDAM) has urged the government to postpone the implementation of the RON95 subsidy rationalisation until two critical issues that directly affect the sustainability of the industry are resolved.
Representing operators of 4,000 petrol stations nationwide, the association warned that these unresolved concerns could threaten the viability of petrol station operators, particularly those running small and medium-volume outlets.
Its president, Datuk Khairul Annuar Abdul Aziz, said one of the issues involves the Automatic Pricing Mechanism (APM), which no longer reflects current operating costs, having remained unchanged since 2019.
"Without a margin revision, small and medium-volume station operators will face losses from the very first day of the RON95 subsidy rationalisation implementation," he said in a statement.
The second issue, Khairul Annuar said, relates to the Merchant Discount Rate (MDR).
"MDR charges are calculated as a percentage of the sale price, while dealers' commissions are based on litres sold.
"As pump prices increase under the RON95 subsidy rationalisation, MDR rises accordingly, but dealer commissions remain static, resulting in further erosion of margins."
Second Finance Minister Datuk Seri Amir Hamzah Azizan had recently announced that the rationalisation of RON95 fuel subsidies would be implemented in the second half of this year.
He had also said the Finance Ministry would continue with the subsidy rationalisation process, with the current focus on identifying the groups eligible to receive the subsidies.
On another matter, Khairul Annuar also criticised a group claiming to represent Bumiputera fuel retailers, which alleged that no consultation had taken place with dealers regarding the rationalisation plan.
"The claim that there has been no consultation with station operators is inaccurate and misleading to the public.
"As the only association that has represented the industry for over 40 years, we remain guided by the principles of collaboration and transparency.
"PDAM is open to working with any party that genuinely seeks to advance the interests of the industry based on facts and responsible engagement, without misrepresenting public perception or politicising sensitive issues."

He said the roof had been designed with adequate height clearance to avoid obstructing nearby commercial units and shoplots. 'The city council is committed to conducting an immediate survey of the night market site, to assess the current situation and ensure the needs of traders and visitors are taken into account in further planning,' he said. It was previously reported that traders at the site had complained that part of the roof had yet to be put up, causing them to lose business during the rainy season. Zamakhshari said the roof design would address this issue. The first phase of the project, which involved building the roof over 185m of the night market area, was completed in April 2023 at a cost of RM2.9mil, with RM2.6mil coming from the Federal Government and an additional RM300,000 from the city council. 'Work on the second phase began on Oct 14 last year,' said Zamakhshari. He noted that another 171m-long stretch was still without a roof, due to funding constraints. He said MBI had submitted a RM4.25mil funding request to the Prime Minister's Office and the Ministry of Tourism, Arts and Culture for the implementation of Phase 3. 'It includes the construction of additional roofing, the installation of industrial fans and improvements to pedestrian walkways. 'We will continue working to secure additional funds to complete the project for the well-being of traders and the comfort of visitors.' He said MBI was optimistic the request would be approved, adding that 'MBI is committed to overseeing this project comprehensively.' Zamakhshari said MBI was focused on prioritising traders' welfare, enhancing Gerbang Malam's image as a tourist attraction and ensuring that every development project would benefit Ipoh residents. 'MBI deeply appreciates the patience and support of all parties in our efforts to build a more progressive and prosperous city,' he said. Gerbang Malam is one of Ipoh's key tourist attractions where small and medium-sized traders operate daily from 6pm to midnight.

KUALA LUMPUR: The Inland Revenue Board (LHDN) on Thursday (June 5) announced that the implementation phase for e-invoices for taxpayers with annual income or sales exceeding RM1mil but not exceeding RM5mil has been postponed to Jan 1, 2026. In a statement, LHDN also announced that taxpayers with an annual income or sales below RM500,000 are exempted from the implementation of the e-Invoice system. "The implementation phase for taxpayers with annual income or sales up to RM1mil has been postponed to July 1, 2026," LHDN said. The board added that the decision was made after the government recognised the commitments of taxpayers, particularly Micro, Small, and Medium Enterprises (MSMEs), in meeting e-invoice legal requirements, which necessitate adequate preparation time and face numerous implementation challenges. The statement said that, in line with this decision, a new timeline for the e-invoice implementation phases has been established with Phase 3 targeting taxpayers with annual income or sales exceeding RM5mil but not exceeding RM25mil coming into effect on July 1, 2025. LHDN noted that Phase 4 will involve taxpayers with annual incomes or sales exceeding RM1mil up to RM5mil and will begin on Jan 1, 2026 while Phase 5 will cover the income group of up to RM1mil and will commence on July 1, 2026. The previously announced six-month grace period will also apply to these new phases, the agency said. It stressed that during this period, taxpayers will be permitted to issue consolidated e-invoices for all transactions, including self-billed e-invoices. Necessary details, it said, can be included in the "Product or Service Description" field. "If there is a request for an e-Invoice from the buyer, the seller is also allowed to issue only a consolidated e-Invoice without issuing one for each transaction," the statement said. LHDN also said that during this grace period, no prosecution will be initiated under Section 120 of the Income Tax Act 1967 for non-compliance with e-Invoice regulations, provided taxpayers adhere to the consolidated e-Invoice requirements. "Furthermore, starting Jan 1, 2026, taxpayers involved in e-Invoice implementation must issue an e-Invoice for every sale of goods or provision of services exceeding RM10,000, and consolidated e-Invoicing will no longer be permitted," the statement added.
