Cuttack: A special Pocso court here on Tuesday convicted a 41-year-old man of raping a minor neighbour and sentenced him to rigorous imprisonment of 20 years.
"As there is a strong need to take stringent measures to deter the rising trend of child sex abuse in the country, the Pocso (Amendment) Act, 2019 and the Bharatiya Nyaya Sanhita 2023 makes provision for enhancement of punishment to deter the perpetrator and ensure safety, security and dignified childhood for a child," presiding judge P K Das observed while pronouncing the sentence.
The judge also imposed fine of Rs 1.01 lakh on the convict, while recommending the case of the rape survivor to the District Legal Services Authority (DLSA) for granting compensation as per the Odisha Victim Compensation Scheme. The judge has ordered DLSA to pay a compensation of Rs 6 lakh to the seven-year-old rape survivor as per Section 396 of Bharatiya Nagarik Nyaya Sanhita 2023.
According to the trial court order, the case was reported to police in Cuttack district on Sept 17, 2024, a day after the occurrence of the incident.
The child's mother lodged the complaint and the man was arrested on Sept 19, 2024, and has since been in custody as an undertrial prisoner.
On Sept 16, the girl was playing with her friend when the convict, her neighbour, lured her with a chocolate to his house and raped her.
Special public prosecutor Suvendra Prasad Mohanty led the prosecution, while deputy chief legal aid defence counsel B L Mohanty represented the convict.

KOCHI: In an odd move, the Ernakulam Chief Judicial Magistrate Court has directed the Kochi city police to register a case against Malayalam actor Swetha Menon on charges of 'transmitting sexually explicit content' and 'indecent representation' of women through her roles in certain films, some of them widely acclaimed ones. The case, filed on Wednesday by the Ernakulam central police, stems from a complaint filed by activist Martin Menacherry, who claims Swetha earned money from obscene films. The charges, under the Information Technology Act for transmitting sexually explicit content and the Indecent Representation of Women (Prohibition) Act, cite her roles in films like Paleri Manikyam: Oru Pathira Kolapathakathinte Katha, Rathinirvedam, Kalimannu (which included her real-life childbirth), and a condom brand advertisement, alleging clips from these have appeared on social media and pornographic websites. Responding to the controversy, Kalimannu director Blessy suspects the move is planned. 'Even before the release of Kalimannu in 2012, there were controversies and protests against the film and the artists. But once the film was released with a CBFC certificate, those creating issues went silent since there was no obscene content. Now, after 12 years, some people are filing complaints. I suspect a conspiracy behind this,' Blessy told TNIE. Initially, the police reportedly took no action on the complaint. However, Menachery approached the Ernakulam Chief Judicial Magistrate Court, which subsequently directed the police to register a case. Ernakulam central SHO Anish Joy expressed confusion over the court's decision to assign the case to their jurisdiction. He added that the police are proceeding with an investigation, including summoning the complainant for a statement. Commenting on the case, Advocate Vimala Binu of the Kerala High Court stated that the charges are unlikely to stand legally. 'Swetha has performed in films as part of her professional freedom. These are certified films, not banned in India. There is no legal violation in acting in such films,' she said. She further noted that Swetha has the option to approach the HC to quash the FIR and seek a stay on the probe.

A 27-year-old Nepalese woman reported being raped in Patna after arriving from Siliguri in search of employment. She alleges that a bus driver, identified as Kartikeya, gained her trust and then sexually assaulted her for two days, taking her near BSAP-1 building and Gandhi Maidan area. PATNA: An incident rape of a 27-year-old Nepalese woman in the state capital came to light after she filed a written complaint at the Airport police station on Wednesday. She alleged that she reached Patna in search of a job from Siliguri (West Bengal) by a train two days back and was lured by a private bus driver who raped her for two days. In her complaint, the woman alleged, "I reached Patna Junction from Siliguri by a train on Aug 3. After leaving the station, I was sitting outside when a driver approached me and gained my trust. I told him that I came to India in search of a job. The driver said he would help me find one. After that, he took me on a bus to his place and raped me for two days." According to the woman, the accused's name is Kartikeya. He took her by bus near BSAP-1 (Bihar Special Armed Police) building and also near Gandhi Maidan area. She alleged that the accused also snatched Rs 13,000 (Indian currency) and Rs 2,000 (Nepali notes) from her. The first person to learn about the incident was a member of Gorkha Samaj Sewa Service Samiti. Woman left Nepal in search of work He said that around 3pm on Tuesday, he received a call from a person near Gandhi Maidan informing him that a Nepali woman was crying. He arrived at the place with his wife and took the woman to his home. During questioning, the girl shared her story, after which a complaint was filed at the Airport police station on Wednesday. According to police sources, the Nepali woman, under pressure from her stepmother and two stepbrothers to earn money, left her country in search of work. The accused is suspected to be the driver of a private bus hired to transport BSAP personnel to Gandhi Maidan for Independence Day parade rehearsal. Sachivalaya SDPO-1 Anu Kumari said, "The traumatised Nepalese woman is currently not in a condition to provide details about the incident. Her medical examination has been conducted and the report is awaited. Further investigation is going on." The SDPO-1 further added that a Nepali organisation has been informed about the incident. After the legal process is completed, the girl will be sent back to Nepal. Until then, the organisation will take her care. Ongole: The POCSO Court at Ongole has sentenced a computer teacher to 20 years imprisonment and imposed a fine of Rs 15,000 in a case involving sexual harassment of a minor student. The convicted individual, Bommu Pedda Veeraiah (33), from Eguvaramapuram village in Kalasapadu mandal of Kadapa district, was found guilty of sexually harassing a minor girl from Giddalur mandal who studied at the same school where he worked as a computer teacher. According to the case details, Veeraiah had been harassing the girl since seventh grade. Before her tenth-grade examinations, Veeraiah's inappropriate behaviour in the laboratory prompted the girl to inform her mother, who complained to the school principal. However, the harassment continued. During Dussehra holidays in 2018, while the victim was visiting home from Tirupati, where she was pursuing Intermediate studies, Veeraiah threatened to post her nude photographs on social media and demanded money and gold. When the victim brought the demanded items, he lured her to Kachiguda in Telangana state under the pretext of deleting the photos, where he sexually assaulted her at a lodge and later at a rented house. Following the family complaint, Giddalur police registered a case. They conducted investigations under the supervision of then Markapur DSP G Nageswara Reddy and Darsi DSP K Prakash Rao, leading to the arrest of accused. On Wednesday, POCSO Court Judge K Shailaja delivered the verdict after effective prosecution by Special Public Prosecutor Gottipatii Srinivasarao. The court also ordered Rs 2 lakh compensation for the victim through the District Legal Services Authority. Prakasam district SP AR Damodar praised the investigating officers and emphasised that perpetrators of sexual crimes against children and women cannot escape the law.
