195 participate in integrity, anti-corruption outreach programme in Bario
KUCHING (July 4): A total of 195 residents from Bario took part in the Integrity and Anti-Corruption Outreach Programme held at SMK Bario recently, organised by the Malaysian Anti-Corruption Commission (MACC) Sarawak in collaboration with the Bario Secondary School Alumni Association (BSSAA).
The programme began with three concurrent knowledge-sharing sessions, each tailored to students, educators, and community leaders.
The first session, held in the school hall and conducted by MACC senior superintendent Maini William, focused on instilling integrity values among youths while emphasising their role in cultivating a corruption-free culture from a young age.
The second session, conducted by MACC Sarawak deputy director (prevention) Wan Ahmad Nidzam on the first floor of the public library, targeted teachers from SMK Bario and SK Bario.
The session highlighted the responsibility of educators as agents of change in shaping a culture of integrity within schools and the wider community.
Simultaneously, the third session was held on the ground floor of the public library for local community leaders and government department heads.
Led by MACC Sarawak director Hasbilah Mohamad Salleh, the discussion centred on strengthening clean, ethical, and corruption-free governance at the community and departmental levels.
The event continued with speeches from SMK Bario principal Robin Amir, BSSAA president Datin Pearl Masna Mohan, and Bario Sub-District administrative officer Richard Usah, representing Deputy Minister in Sarawak Premier's Department (Labour, Immigration and Project Monitoring) and Mulu assemblyman Datuk Gerawat Gala, also an alumnus of SMK Bario.
The programme's official launch was performed by Hasbilah, who also officiated at the opening of 'The Lentern Nook', an open reading corner established in SMK Bario.
Souvenirs were presented to the school and BSSAA, followed by a Corruption-Free Pledge (Ikrar Bebas Rasuah) led by the community and witnessed by Richard.
In the evening, the MACC Sarawak delegation led by Hasbilah visited the Bario Asal Longhouse upon special invitation from the BSSAA.
Pearl, hailing from the longhouse community, facilitated the visit.
'The spirit of honesty and cooperation that has long been central to Kelabit culture is in line with the principles of integrity championed by MACC.

PUTRAJAYA, July 5 — The prosecution has listed 24 grounds in its petition of appeal on why the Court of Appeal erred in acquitting former Felda chairman Tan Sri Mohd Isa Abdul Samad of nine corruption charges. In the petition filed at the Federal Court on June 26, the prosecution is seeking to reinstate the High Court's 2021 decision, which found Mohd Isa guilty and sentenced him to six years' imprisonment and a fine of RM15.45 million, in default 18 years in prison. A check on the Court e-Filing System Malaysia showed that the case management has been scheduled for this Monday. In the petition of appeal, the prosecution argued that the Court of Appeal erred in law in overturning the High Court's findings, which established that Mohd Isa had instructed his former special political officer, Muhammad Zahid Md Arip, to solicit bribes from a Board Member of Gegasan Abadi Properties Sdn Bhd, Ikhwan Zaidel. The prosecution contended it had presented evidence that following two meetings, Mohd Isa had indirectly instructed Muhammad Zahid to solicit bribes from Ikhwan, and that Muhammad Zahid acted on the instruction and then handed over the bribes in stages to Mohd Isa. The prosecution also said the Court of Appeal was wrong in law in finding there was evidence from Ikhwan indicating that Mohd Isa had never requested gratification from him in the two meetings with him in his office. 'The judges of the Court of Appeal erred in law and in fact when they disturbed the factual finding made by the High Court judge that Mohd Isa had instructed Muhammad Zahid to request and receive bribes from Ikhwan indirectly when the respondent (Mohd Isa) uttered the words 'If they give anything later, you just take it' (kalau diorang bagi apa-apa nanti kau ambil lah) to Muhammad Zahid,' it said in its petition of appeal. The prosecution said Muhammad Zahid, who was one of the prosecution's witnesses, had understood the words to mean that anything given by Ikhwan should be accepted by him on behalf of Mohd Isa. It said the Court of Appeal made a contrary finding that the statement could not, in a literal sense, be interpreted as a specific request or directive to Muhammad Zahid to solicit a bribe from Ikhwan. The prosecution also argued that the Court of Appeal's findings of fact were inconsistent with the factual findings made by the High Court, which were based on evidence adduced through Muhammad Zahid and Ikhwan, both of whom were found to be credible witnesses. According to the prosecution, Muhammad Zahid's testimony regarding the words spoken had a factual basis following a second meeting between Mohd Isa and Ikhwan, where Ikhwan had expressed gratitude for the approval of the purchase of the Merdeka Palace Hotel & Suites by Felda Investment Corporation Sdn Bhd (FICSB). It said Mohd Isa had also informed Muhammad Zahid that Ikhwan had told him that he (Ikhwan) could assist Parti Bumiputera Bersatu Sarawak. The prosecution said the statement made constituted a specific instruction from Mohd Isa to Muhammad Zahid to request and receive bribes on his behalf from Ikhwan. On March 6 last year, the Court of Appeal three-member bench, comprising Justices Datuk Ahmad Zaidi Ibrahim, Datuk Vazeer Alam Mydin Meera (now Federal Court judge) and Datuk S.M. Komathy Suppiah, acquitted and discharged Mohd Isa after allowing his appeal. It overturned the February 3, 2021, decision by the High Court, which found Mohd Isa guilty of nine corruption charges, allegedly committed on the 49th floor of Menara Felda, Platinum Park, No. 11 Persiaran KLCC, Kuala Lumpur between July 21, 2014, and December 11, 2015. The prosecution filed its notice of appeal on March 7 last year. The former Negeri Sembilan Menteri Besar was accused of dishonestly receiving gratification for himself, in cash totalling RM3,090,000 from Ikhwan, through Muhammad Zahid, as gratification for helping to approve the purchase of the hotel by FICSB for RM160 million. The charges were framed under Section 16(a)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, punishable under Section 24(1) of the same law, which provides a jail term of not exceeding 20 years and a fine of at least five times the bribe amount, or RM10,000, whichever is higher, upon conviction. — Bernama

Court grants Thomas' bid to disqualify Justice Roz Mawar
PUTRAJAYA: Former attorney general Tan Sri Tommy Thomas has succeeded in disqualifying a High Court judge from hearing a defamation suit filed against him by Umno veteran Tan Sri Shahrir Ab. Samad. A three-judge panel of the Court of Appeal allowed Thomas' appeal to disqualify Justice Roz Mawar Rozain from hearing the case in its future proceedings. In the unanimous decision, read out by Justice Faizah Jamaludin, the panel ruled that the findings of the High Court judge were neither based on the book written by Thomas nor the pleadings filed by Shahrir. The panel chaired by Justice Supang Lian, found that the statement made by the judge when dismissing Thomas' striking out application of the main suit was based on an opinion that she formed rather than by merits of the case. 'As an informed and fair-minded bystander, given the facts and circumstances of the case, we perceive that these findings and observations do give rise to a risk of real danger of bias by the learned judge even though the bias may be unintentional. 'We allow this appeal and set aside the decision of the High Court judge dated Jan 14 with order that the learned High Court judge recuse herself from all future proceedings in the trial,' Justice Faizah said. Justice Ahmad Fairuz Zainol Abidin is the third judge of the panel. Thomas filed the recusal application on Aug 26 last year, claiming that Justice Roz Mawar had made numerous baseless findings and contradictory statements to the claims in the lawsuit and the evidence presented in court. On Jan 14, Justice Roz Mawar dismissed Thomas's application, saying that an unhealthy trend had emerged of litigants seeking to disqualify judges from hearing their cases which is capable of eroding public confidence in the judicial arm of the state. Thomas then filed an appeal at the appellate court. The application stemmed from Shahrir's lawsuit against Thomas over what the former claimed was a malicious prosecution. Shahrir was charged at the Sessions Court on Oct 21, 2020, for allegedly failing to declare a RM1mil cheque he received from former prime minister Datuk Seri Najib Razak to the Inland Revenue Board (LHDN) for restoration work on the Puri Langkasuka housing project in Larkin, Johor. On Jan 5, 2023, High Court judge Justice Muhammad Jamil Hussin acquitted the former Johor Baru MP of the charge. In December the same year, Shahrir filed the lawsuit and named Thomas, former Malaysian Anti-Corruption Commission (MACC) chief commissioner Latheefa Koya, the MACC, and the government as defendants, for alleged malicious prosecution against him. Thomas, who served as AG from June 4, 2018, to Feb 28, 2020, refuted Shahrir's allegations of abuse of power, describing them as 'unsustainable'. He stated that the discretion to charge could only be exercised after the AG receives the investigation papers from agencies like the MACC. Thomas said he resigned on Feb 28, 2020, and that Shahrir's criminal trial for the charges began on July 26, 2022.
