Bank told to clear PF dues of retired manager with interest, pay Rs 75K in compensation

Hyderabad: The Telangana consumer disputes redressal commission has directed a city-based bank to pay Rs 12.7 lakh in provident fund dues along with interest to Kandadai Venkatacharyulu, a retired bank manager.
The commission also awarded him Rs 50,000 as compensation and Rs 25,000 towards litigation costs.
Venkatacharyulu, who worked as a branch manager, was suspended in 2007 and later dismissed from service before retirement. Despite completing 36 years of service by 2008, his retirement benefits were withheld. He alleged that the bank adjusted his provident fund (PF) contributions against a clean overdraft (COD) loan without consent, and denied him interest for nearly five years.
According to Venkatacharyulu, his own PF contribution of Rs 4.37 lakh was transferred in March 2013 to settle the COD account without paying interest from April 2008. The bank's contribution of Rs 7.4 lakh was also held back. Additionally, other amounts, including Rs 37,277 from a National Savings Certificate and Rs 46,072 from an insurance claim were adjusted without informing him.

The commission ruled that Venkatacharyulu qualifies as a "consumer" and the bank as a "service provider" under the Consumer Protection Act.
It noted that the bank failed to prove he alone caused the financial loss it cited to justify the recovery.
"In fact, another employee admitted to using his password to carry out transactions," the commission observed. "There was no proper apportionment of individual liability, and the bank had no legal right to recover the full amount from the complainant."
The panel further said denying PF interest violated Article 300A of the Constitution, which protects a person's right to property. "Withholding dues without interest is unjust," it stated, ordering the bank to pay up with interest from 2008 onwards.

Days after the staff of Diwan Ballubhai High School in Ahmedabad held a dharna on the campus of one of its schools, boycotting teaching work for a day over salary issues, the District Education Officer (DEO) on Thursday penalised the teachers as well as the management of the school. While the management was handed out a penalty of Rs 10,000, the teachers would stand to lose a day's salary. Citing the Right to Education Act (RTE) 2009 rules, Ahmedabad (city) DEO Rohit Chaudhary ordered the school management to deposit the fine within three days. In separate orders issued by the DEO office pertaining to the school's two branches in Kankaria and Paldi, and both its Gujarati and English- medium schools, the teachers have been slapped with a penalty of unpaid one-day leave for not teaching students and going on a strike. The respective school principals have to inform the DEO office for implementation of this order within three days. On August 11, nearly 100 teaching and non-teaching staff of Diwan Ballubhai High School in Maninagar and Paldi sat on a dharna on the Maninagar campus alleging discriminatory annual increment given to them last week. The DEO, Ahmedabad (city), issued show-cause notices to the teachers and management on the same day. Citing violation of the RTE Act, DEO Chaudhary demanded a reply to the show-cause notices issued to teachers and management by Tuesday. 'Teachers quit their teaching work on salary increment issue and sat on a dharna without prior approval or intimation to this office. For their (the teachers') own interests, students had to suffer. Same goes with the management as to why they failed to resolve the issue and not discuss it with the DEO office,' DEO Chaudhary had earlier told The Indian Express. Though the management, in its response to the show-cause notice, stated that the school has introduced a 'performance-based' increment process from this year, it was penalised for failing to resolve the issue. Earlier, a flat increment used to be given to the staff of the school. This was replaced by performance-based evaluation from this year.

Spend management platform Zaggle Prepaid Ocean Services reported a 56.2% year-on-year (YoY) increase in net profit to Rs 26.1 crore for the June quarter, driven by revenue growth across segments and new customer from operations rose 31.6% YoY to Rs 331.9 crore, while adjusted earnings before interest, tax, depreciation, and amortisation (Ebitda) rose 27.9% to Rs 32.7 Hyderabad-based company added several strategic clients during the quarter, including Hindustan Pencils, Apollo Health, Mo Engage, Novozymes, DTDC, CK Birla Healthcare, and Truecaller. Its customer base spans across banking, technology, healthcare, manufacturing, FMCG, infrastructure, and automobile expenses rose to Rs 309.5 crore from Rs 233.9 crore a year earlier, with more than 70% attributed to the cost of point redemption and gift cards. Spending on incentives and cashbacks stood at Rs 95.5 crore.'This is by far our best first-quarter performance, despite being a slower quarter in the year.
